X. sTATq"eNT or THe FACTS.
'I.'hil1 action ariaes out ot a motor vehicle collision
that occurred on December 21, 1991\. On or about September
26, 1996, Plaintiffs filed a Complaint against Defendant.
On September 29, 1996, the parties filed a Stipulation
amending the Complaint. On or about May 22, 1996, the
depositions of both Plaintiff and the Defendant were taken,
By letter dated October B, 1997, def~nse counsel informed
Plaintiff's counsel that he wanted Plaintiff to submit to an
independent medical examination (IMIil) conducted by Howard
Senter, M,D. in Pittsburgh, Pennsylvania on December 9,
1997, Attached hereto is a copy of said letter marked as
Exhibit "1\."
Plaintiff, Richard DeLuca, worked at Holy Spirit
Hospital as an emergency room physician up until early 1995.
In November of 1995, the Plaintiffs, Richard DeLuca, and hie
wife, Patricia DeLuca, moved to Providence, Rhode Ieland.
Plaintiffs have not lived nor worked in Pennsylvania for
over I:wo years,

"Whenever the mental or physical condition of a person
is material to any claim for medical, income 101111 or
oatalltrophic loss benefits, a court of competent
jurisdIction, .. may order the person to submit to a mental.

Under the good cause standard, an insurance company's
petition must contain factual allegations showing that a
medical examination is warranted,
The samo argument holds true that an insurance company
or defense counsel should also establillh good cause for a
plaintiff to submit to a defense medical examination in the
geographic location it has chosen, In this case, the
Defendant has not established good cause to have Plaintiff
submit to n medical exam in Pittsburgh, Pennsylvania,
In her Motion to Compel and Reply to New Matter
Contained in Plaintiff's Answer to Motion to Compel,
Defendant argues that a medical examination of Plaintiff by
Dr, Senter, a neurosurgeon who practices in Pittsburgh, is
necessary because of potential bias in Central Pennsylvania
if Plaintiff is examined by a neurosurgeon in this area.
There are several reasons why Defendant's argument of
potential bias fails. First, Richard DeLuca worked as an
emergency room physician at Holy Spirit Hospital, Camp Hill,
Pennsylvania, He did not work in any other hospitala in any
of the surrounding counties and his worked was confined to

Second, there are upproximately twelve neurollurgeonll
listed in the HanillbuJ:g (and Sunounding Communitiell) Bell
Atlantic phone book, seven of which are board certified
neurollurgeonll practicing at lIerllhey Medicnl Canter,
According to the Pennsylvania Medical Society, there are 26
neurosurgeons currently pJ:acticing in Pauphin, Cumberland,
Lancaster, and YOJ:k Counties cQmbined,
In Nacev v. Sauihb & sons, 38 P. & C, 3d 201 (1985),
the plaintiff objected to being forced to take a trip to
Boston, Massachusetts for a medical examination, Tbe Court
held that plaintiff was not required to travel to Boston for
the examination because the Pefendant did not file any
information to establish that there were not similar
specialista in Western Pennsylvania who could examine the
Plaintiff and prepare an expert report. Id~ at 200,
Third, RJ.chard PeLuca stopped practicing medicine in
Pennsylvania in the spring of 1995, and in November of 1995,
he moved to Rhode Island and continues to reside there,
Neither he not' his wife have lived nor Iwrked in Central
Pennsylvania since 1995,
Furthermore, it would be unreasonable and burdensome
for Plaintiff to have to travel to Pittsburgh for the
medical examination, First, this collision occurred in
Cuml::-erland County and will be tried in Cumberland County,

have the penefit of meeting, in person, with his counsel
prior to the examination since Plaintiff will have to travel
dirl!ctly from Providence, '~hode Island, to PittsblJrgh,
Pennsylvania.
A one.way trip by car from lJrovidence, H,I, to
Pittsburgh, PA. would be approximately 542 miles or tak~ 9
hourll and 46 minutell, If Plaintiff were to travel by car
from Providence, R.I" to a medical exam in Central
Pennsylvania, then this trip, by car, would be approximately
349 miles or 6 hours and 20 minutes - 3 hours and twenty
eight minutes shorter than travelling to Pittsburgh,
It is alBo counsel's custom to have a representative
from his office attend the medical exam, Plaintiff's
counsel feels that a representative's preaence will be
needed to protect the legal rights of his client and the
examination will involve physical injuries not readily
demonstrated by x-raya or other objective means. MsIchinski
v. Schaaf, 35 D & C 3d at 574 (1964),
It will be a aignificant cost for a representative from
Plaintiff's counsel's office to attend the medical exam in
Pittsburgh which will ultimately be borne by the Plaintiff,
Richard DeLuca, On the other hand, the insurance company

doctor has agreed to do this, While defense counsel haa

expenses to Pittsbur.gh, he has not agreea to do so, agreeing
only to discuss it,
Presumably, if this court makes sn order compelling
Plaintiff to go to Pittsburgh for this examination,
Plaintiff's counsel will be forced to go to Pittsburgh if
Dr, Senter dO/la not come to cumberland County to testify,
which Plaintiff submits is a highly unlikely prospect, since
even local physicians do not appear in court aa a general
rule when they havo the option of giving a deposition,
In the alternative, if thia Court compels the Plaintiff
to attend a medical examination in Pittsburgh, the Plaintiff
respectfully requests this Honorable Court to require the
Defendant to pay for the following I
(1) all reasonable and necessary travel and incidental
expenses incurred by Plaintiff to attend the
defense medIcal examination, inclUding round trip
flight, meals, transportation and lodging,

Facts Aoolicable to All Cou~
1. Plaintiffs, RICHARD DELUCA, M.D. and PATRICIA
DELUCA, are husband and wife and are adult individuals who
currently resides at 2407 Woods Estate, Kingwood, Texas
77339.
2. Defendant, MICHELLE L. WESSTF.R, is an adult
individual whose last known address is 333 Peitrick Road,
Halifax, Dauphin County, Pennsylvania 17032.
3. The facts and circumstances hereinafter set forth
took place on Oecember 21, 1994 along Routes 11 and 15 in
Camp Hill, Cumberland County, Pennsylvania at or around 6150
atm.
4. At the above referenced time and place, Plaintiff,
RICHARD DELUCA, M.D., was operating a 1991 Podge Stealth on
Route 11 and 15 in camp Hill, Cumberland County, Pa,

MICHELLE L. WEBSTER, was operating a vehicle with license
plata number AJV9B15 behind the Plaintiff on Route 11 & 15
in Camp HUl.
6. At the above-referenced time and place, traffic
proceeding in the same direction as plaintiff and Defendant
was governed by a traffic light as traffic approached the
intersection of 21st Street with Route 11 and 15 in Camp
Hill.
7. At the above referenced time and placa, as
Plaintiff approached the intersection with 21st Street he
brought his vehicle to a complete stop behind other traffic
stopped at a trafflC light.
e. At the above referenced time and place, Defendant
failed to see Plaintiff's vehicle stopped in traffic along
the roadway and collided with the rear of Plaintiff's
vehicle.
9. The aforesaid collision was the direct and
proximate result of the negligence of Defendant, MICHELLE L.
WEBSTER in operating her vehicle in a careless, reckless,
and negligent manner as follows I
a. In failing to drive at a speed and in a
manner that would allow her to stop within
the assured clear distance ahead;
b. In driving her vehicle at a speed greater
than would permit her to bring her vehicle to
a stop within the assured clear distance
ahead in violation of 53361 of the Motor
Vehicle Code of the Commonwealth of
Pennsyl vania I
c. In failing to stop at a steady red traffic

Mostly where the neck and back muscles connect to
the shoulder, the upper shoulder area and down the
arm.

The numbness, tingling, uneasy eeeling, almost
like you tell asleep on it,

sensation going up the arm into the shoulder or
was that more of a pain?
That wae more of a pain from the neck to the arm.
What medication did they prescribe?
They prescribed eome anti-inflammatory. I torget
the name of it at this point.

And what happened aa ot the Qnd oe March of 1995
when you quit working?
I quit working bacause ot discomforts interfered
dramatically more and more with my working, the
quality ot care that I could give the patients,
the type of care that I could give, thll procedurea
that I could do. Doing a simple skin graft on
som~one's finger became very difticult as tar as
physical pain and discomtort and concentration
related to my neck injury in this accident.
Have you returned to work atter March 31, 1995?
No, I have not.
When were you involved in the second automobill
accident or subsequent automobile accident?
The second automobile accident I believe occur
August 16th, '95.
Less than a year after the December 21, '94
accident?
Almost eight months approximately.
The reason I say that is somewhere along the line
I've looked and I've seen ditterent dates and I
thought I saw a date in '96, and actually the date
that I thought was september ot '96. Is the date

Since the time of the accident to the present,
have you lived at any other place other than the
Harrisburg address or the smithfield Road address
in Rhode Island?
Yes.
Could you basically just-- The easiest way to do
it is if when you left from Harrisburg, tell me
where you went and how long you stayed and all of
the other places you lived from the time of the
accident until today.
The other place would be 2407 Woods Estates,
Kingwood, Texas. And since moving from here, it's
been between those previous two mentioned, the
Texas and Rhode Island.
When did you leave the Harrisburg area following
the accident?
I believe we sold our house in November of '95 and

YItI, I do occas ionally.

Yes, I do.
Why did you move from Harrisburg to Rhode Island?
Well, that's where most of my family is and some
of my wife's family i6, and being unable to work,
that seemed to be the best location.
And is there any family connection with Texas?
Yes, there is.

Are there specific periods of time that you spend
in Rhode Island versus Texas?
Generally wintertime in Texas and summertime in
Rhode Island.
