6. Plaintiff has participated as a part or witness, or
in another capac,lty, in other litigation ooncerning the custody of
the child in this or another court. This custody matter was
pending in the Court of Common Pleas York County at docket Number
94 - SI1 - 02439 - 03. When I:he action was oommenoed both parties
lived in York County. For the past few years the parties have
lived in Cumberland County. Plaintiff has filed to disoontinued
his action in York County and initiated this Gustody complaint.
Plaintiff does not know of a person not a party to the
prooeedinqs who has physical (lultody of the ohild or claims to have
aUltody or visitation rights with respect to the child.
7. The b.11: interGSt and permanent welfare of the ohild will
be served by granting the relief requested beaausel
A. Plaintiff oan provide a better environment for
raising his daughter,
B. Plaintiff can ~ive a stable lOVing home,
C. Plaintiff will foster a better relationship between

l. 'rhe parties shall lIublnit themselves, the Child and any relatives
ot the parties (deemed necesiSary by the llvaluator) to a custody evaluation.
This evaluation ehall be an independllnt evaluation perfotmed by a
profesllional who shall be selllcted by IIgreemllnt of thll partiea and counsel.
Th~ costs of the evaluation shall be shared equally by the partiell. Upon
the conclusion of the evaluation and in thll event the parties are not at
that time able to rllach an agrellment on custody, either party may petition
the Court to have this CIlSll again scheduloo with thll Custody Conciliator
for a Confllrence.
2. 'rhe Father, Eric R. Smith, and the Mother, Rllnee L. Vaughn
(tol:111erly shoop), shall have sharlld legal cllstody of Samantha Nicole Smith,
born March 3, 1994.
3. The Mother shall have primary physical custody of thll Child.
4. The Father shall have Iil6rUal physical custody of the child on
weekends when he doea not have to work from Friday at 7100 p.m. until
Sunday at 7100 p.m. The Father shsll have custody of the child three
consecutive weekende out of every eix weekends. The Father shall also have
custody of the Child on all other days when he is off work. A day off work
shall be defined as the 24 hour period beginning at 7100 p.m. on the day
before his day off work and ending at 7100 p.m. on his day off work. The
Father shall provide the complete work schedule for each calendar year to
the Mother upon receipt from his employer.
5. The Mother shall have cuetody of thll Child on the three
consecutive weekends whlln the Father is working end also at all other times
not specified in the preceding paragraph.
6. The plirties shall have custody of the Child on an alternating
basis on the tollowing holidays 1 Labor Day (9100 a.m. until 7100 p.m.),
Thanksgiving Day (9100 a.m. until 7100 p.m.), Christmas holiday Segment A
(Decembllr 23 at 5100 p.m. until DecGmber 25 at 12100 noon) I Christmae
holiday Segment B (December 25 at 12100 noon until December 27 at 7100
p.m.), 1'111\0/ Year, OIly (9100 a.lI1. unt;il 7100 p.m.), Memorial Day (9100 a.m.
until 7100 p,m.), and thl! 4th of July (9100 a,lI1. until 7100 p,m.).
The parties shall continue to alternate the forll\loin<J holidaya on
thl! edating schedule which begon with the FlSther havir19 custody on Lsbor
Pay in 1994 ond ths Mother haVing custody on ~~snksgiving OIly in 1994.
7, 'l'he Fathor shall havo custody of the Child for four weeks of
vacation each year. I\a long as the Child is not in school, the wllllks do
not have to be taken in the SlJJlJ1ler, '1'he vacation periods IIhould be taken
in seven day incrementa unlells the Fllther hall planned to travel away frQf11
Cunberland county for a period of two weekll or longer for vacation. 'rhe
Mother shall also have custody cf the Child for two weekll of vacation
during each lIunmer upon providing thirty days advance notice to the Father.
The regular custody Ilchedule ahall be sUllpended during vacation weeks. The
parties should IIchedule vacation periods in such II way as to avoid
interferin<J with the other party's waokend custody periods. However, the
vacationing party may taka the other party'lI period of weekend cUlltody if
the vacationing party addll lIeven days to craate s ten day vacation period
and travels on both weekands.
8. The noncustodial party Ilhall have rllallonl!ble telephone contact
with the Child at all titnell. 'l~o partiell shall keep aach other appriaed of
their telephone numbers and addredllell 1St all times.
9. 'l~e party receiving cUlltody shall be responsible for providing (or
making arrangements for anot;her responsible adult familiar to the Child to
provide) transportation for the exchange of custody.
10. 'rhe Mother IIhall keep the Father apprised of any daycare
arrangements made for the Child, inclUding the provider's nlltn8 and address.
l1. The parties shall cooperate with lIach other in addressing custody
illsues betweClln the part1ell to the fullest extent possible rather than
involving the partiell' spouses.
l2. The parties IIha11 cooperate with each other in insuring that
custody exchanges arEl conducted in an atmosphere conducive to the Child's
well being.

2. A Conciliation Conference was held un October 29, 1996, with the
following individuals in attendance I The ~'ather, Eric R. smith, with his
counsel, Thomas D. Gould, Esquire and the Mother, Renee 1... Vaughn, who is
represented in this matter by Mic'hae.l A. Koranda, but appeared without
counsel at the Conference.
3. Two Orders were previoualy entered in this matter on July 15, 1994
and May lB, 1995 by the York County Court of CotmlOn Pleas, where tnis
custody action was initiated. Both parties currently reside in Cumberland
County and neither party has resided in 'lark County for a period of at
least six months. Both Court Orders in 'lork County were entered as a
result of agreements reached at Conciliation Conferences. Copies of the
prior Court Orders and Conciliator's Reports are attached to this Report
for the Court's reference.
4. The Father filed this Petj,tion to Modify the prior. Court Ordel:'
dated May lB, 1995. Under the exi:sting custody arrangement, the partiea
share custody on an approximately 45/55% basis with several custody
exchanges taking placEl each week. The Father proposed at the Confel:'ence
thaI: the pal:'ties share custody on a weekly basis to simplify the existing
schedule. The Mother did not agree to an alternating weekly schedule and
proposed instead that the Order be modified to provide that the Father have
partial custody on alternating weekenda and holidays only. Although the
parties were unable to establish a mutually acceptable ongoing custody
