4. Luke HUling, who wa. standing on a chair adjacent to his
brother, suttered signitioant injuries when a piece of the gla.a
from the eKploding bottle lodged into his right eye.
~. Luke HUling was required to undorgo emergency surgery to
remove the piece of glass and repair a prolapsed iris.
6. The Grape Slice soda iB a product of Pepsi-cola company
who was notified of the exploding bottle.
7. Luke HUling was in good health and had no eye problem.
prior to this incident. As a result of this incident, he we.
required to seek medical attention I undergQ surgery, and wear
protective lenses. At this time, there does not appeer to be any
permanent damage to Luke Huling's vision.
a. Pepsi-Cola Companies, through their insurance carrier,
Kemper Inaurance company, and subject to the approval ot your
Honorable Court agree to settle the claim ot Luke Thomas Hulinq for
the Bum of $20,000.00.
9. In view of the issues which arise in any suoh claim with
respect to liability, damages, and compensation, your Petitioners
believe it is in the best interest of LUke Thomas HUlinq that the
proposed settlement be accepted and approved.
10. should the Court then deem it necessary to schedule a
hearing to approve the settlement and, if a hearinq is scheduled,
LUke Thomas HUling, a minor, Carol and Miohael HUling, parents and
natural guardians of Luke Thoma. HUling, and their counsel wl.ll be
present at the hearing.

11. The Petitioners have retained the law firm of Angino ,
Rovner, P.c. to prosecute this aotion, have entered into a
oontingenoy fee agreement with said attorney. whereby .aid
attorneys are to reoeive for personal servioss 30t of any amount of
recovery prior to filing a law suit, whioh has occurred in this
oaBe. (Bee attaohed exhibit Ad However, counsel has agree to
reduce thiB fee to 25t.
12. PetitionerB have agreed, Bubject to the approval of your
Honorable court, to pay Angino , Rovner, P.C. the sum of $e,ooo for
legal rees.
13. Petitioners have agreed, subjeot to the approval of your
Honorable court, to reimburBe ^ngino , Rovner, P.C. the sum of
$616.80 for the out~of~pocket expenses incurred in proseouting this
claim.
14. As a result of this inoident, Plaintiff. Carol and
Michael HUling inourred medioal expenBes totalling $1,112.10 whioh
they paid personally. (Medical bill Bummary is attaohed as
Exhibit "B"). Plaintiffs requeBt that they be reimbursed for these
expenses out of the settlemont funds.
15. Additionally, Plaintiffs have an outBtanding balance of
$319.98 owed to Pennsylvania Eye ABsociates for LUke Huling's
medioal treatment. PlaintiffB request that this amount be paid
directly to Pennsylvania Eye ABBooiates from the Bettlement funds.
16. Petitioners agree that remainder of the Bettlement,
$12,951.12 iB to be held in trust for Luke ThomaB HUling in an

attached ia a photocopy of 11 certifioete of Deposit issued on
Decembor 3, 1996 trom the PNC Bank to Miohael B. Huling as Guardian
tor LUke Thomas Huling, a minor as proof ot deposit ot the
sottlement proceeds.
No withdrawal oan be made from any such acoount until the
Minor attains majority, except as authorized by a prior Order of
Court.
