1. Plaintift Walter W. Philipson is an adult individual who
currently resides at 125 Kost Road, Carlisle, cumbarland county,
PennSYlvania 17013.
2. Defendant Ronnie c, Freeland is an adult individual who
currently resides at 55 cotteetown Road, Oillsburg, Cumberland
county, Pennsylvania 17019,
3. Defendant Joseph Winters is an adult individual who
currently resides at 6419 Laurie Lane, Enola, cumberland county,
Ponnsylvania 17025.
4, Defendant Ronald 6. Benner is an adult individual who
currently resides at 10-C creekside Lane, Carlisle, Cumberland
county, Pennsylvania 17013.
5. At all times relevant hereto. Joseph Winters pertormed
auto ~ervicin9 and mechanical repairs to vehicles out of ,his garage
at 5419 Laurie Lane and charged money tor his services.
6. On or about February 22, 1995, Plaintiff entrusted his
1990 Chevrolet automobile to Deflilndant Joseph Winters tor the
purpose of having pre-inspection repairs performed, and so
Defendant Winters could take the vehicle to be inspected tor
Plaintiff .
7. In e~change for these services, plaintiff paid Detendant
Winters .
8. On or about February 23, 1995, Defendant Ronniu Freeland
took his 1979 Ford truck vehicle to Defendant Winters' garage for
services and/or repairs.
9, In e~chl\nge for that service, Defendant Freeland paid
Defendant Winters.
10. On or about February 23, 1995, at appro~imat.ly
10 o'clook a.m., Defendant Ronald E. Benner started Defendant
Winters' vehicle and drove the vehicle from the garage to the front
of Defendant Winters' house.
11, He then left the vehicle in front of Defandant Winters'
house with the motor running, and he proceeded to go inside
Defendant Winters' house,
12. Defendant Freeland's vehicle slipped out of gear and
proceeded to drive down Laurie Lane and hit Plaintiff's vehicle,
whioh was parked on Laurie Lane.
13. When Defendants Benner and Winters oame outside from
Defendant Winters' house, they found Defendant Freeland's vehiole

had smashed into Plaintiff's vehiole, oausing damage to Plaintiff's
vehicle.

1&. When Plaint:1tt pioked up his vehiole from Detendant
Winter.' 9arage on February 23, 1996, his vehicle was damaqed, and
Oetendant Winters J.nformed him that Defendant f'reeland's vehicle
had hit his vehicle, oausing the damages.
lIS. As a result of the aforesaid inoident, Plaintiff incurred
neoessary repair.s to his vehiole in the amount of $2,303.7&.

have been aware that his vehiole contained a broken gearshitt,
oausing the car to oooasionally slip out of gear.
19. Plaintiff's damages were incurred as a direot and
proKrmate cause of Defendant f'reeland's negligence, inoludin9 but

aocordanoe with the Pennsylvania Motor Vehiole Code.

vehicle inspected.
'22. Plaintiff compensated De fondant Winters monftarily in
exchange for Detendant Winters' service to plaintiff's vehicle.

28, On February 23, 1995, Defendant Benner was llBsistin9
Detendant Winters in performing service/repairs to the vehicles
then at Mr. Winters' 9arage.
29, on the aforesaid date, D'Ifendant Benner did start the
en9ine of the Freeland vehiCle, parked in front of Mr. Winters'
home/9arage, and leave the engine running while he went into the
Winters' residence,
30. Pleintiff's damages were incurred as a direot and
proximate result of Defondant Benner's ne9ligence, including but
not limited to the followingl
