8. One such adverti.ement I' deBcribed in p.ragraph 7 was plllced in
the periodical 'ent..y Pootball.Iad.x '96, with publillhing otticell in
Seattle, Washington, and distribution centers all acrollll the United Statss
and C.nada. (Copy ot advertiBement is marked as Bxhibit UAU)
9. On or about June 1996, Plllintittll purcha.ed s.id periodic.l at II
news.tand located in Cumberl.nd County.
10. Plaintittll responded to the Detendantll advertillltment and ordered
a tree brochure highlighting the .ervicell and det.illl ot the Detendants
solicitation.
11. DetendantB responded by lIending Plaintitt Nichael J, Rman, Jr. a
two-sided tive (5) pago brochure which promised certain services and
highlighted the tantasy game details. (Copy ot brochure is m.rked lIB
Exhibit "S")
12. Upon receipt Detendant. cont.cted Det~ndant TD F.ntasy Sports and
spoke to Detenaant Andrew DeDomenico regarding claritic.tionll. Detendant

Andrew DeDomenico intormed Plaintittll that Detendant Nanette DeDomenico
"handled all that" and transterred the call to Detendant Nanette
DeDomenico. At which time Detendant Nenette DeDomenico proceeded to anBwer
all quelltionll IInd verity intormetion cuntained in the brochure.
13. lurlluant to and reliant upon the advertil1ement, brochure and
telephone converllation Plaintitts Nichael J. Kman, Jr, and Robert "
Gruschow contrllcted with Detendantll by completing the Team Intormation
section ot the brochure and mailing along with check number 1475 payable to
TD Fanta.y SportB in the amount ot One Hundrad Twenty dollarll and sixty
cents (f120.60) to Detendants.
14. On or about August 1996 Ilaintitts participated in a telephone
draft and subllequently participated in the tantasy game as dellcribed in the
brochure.
15. On or about September 9, 1996 Plllintitts contacted other current
and tormer client. ot Detendants in regardB to Detendants tailure to
provide the servic~s promised and also relative to the lIullpected collusion.
16. On or about September 9, 1996 Plaintitts in speaking with a
current client ot Detendantll (Mr. Ko.era) were intormed that PlaintittB
have indeed conducted some untair game practicell and had long lIuspected
collusion. Further, Mr. Ko.era intormed Plaintitts ot specitic instances
and turther provided names and intormation ot such sUllpicions.
17. On or about September 10, 1996 Plaintittll contronted Detendants
regarding .everal breaches ot their agreement (which include but are not
limited to lack ot a voice mail system all advertised IInd lack ot additional

Mich.el J. Kman, Jr, particip.t.d in a thr..-w.y conterence call with
D.tendant Andrew DeDomenico regarding the breach'lI and 6;l.p.cted collullion,
19. During .aid confer.nce clIll a. av.rred in paragraph 18, D.tend.nt
DeDomenico agre.d with rellpect to the breach.. in agreement and turther
agreed that Plaintittll would resign trom the tan tallY game l.ague tor the
conuideration ot a retund in the amount ot One Hundred Thirty-five dollar.
($135.00) to the Plaintitts within one week,
20. Pursuant to the agreament regarding a retund ot $135.00
Detendants cell sed all lIervices to Plaintitt. regarding the participation in
the tan tallY game league and in return the Plaintittll cealled all
participation in the tantasy game league in wait tor the $135.00 lIettlement
to arrive.
21. On or IIbout September 20, 1996, having not rec.il..d the $135.00
as previouBly agreed, Plaintitt Nichael J. Kman, Jr. sent Detendants a
memorandum requellting lIaid moniell on or betore September 24, 1996.
22. On September 25, 1996 Plaintittll sent a Final Demand letter, via
tacBimile, tor the nloniell owed and agreed upon, Said tinal demand asked
Detendant to contact Plaintitts during Detendant. po.ted bUllinell. hourll
that evening.
23, De.pite demand, Detendantll have retused to repay the money owed,
