attorneys, Fowler, Addams, Shughart & Rundle, and files the

1. The Plaintiff is Jennifer M. Brinton, an adult
individual residing at 110 Petersburg Road, Carlisle, Cumberland
county, Pennsylvania,
2. The Defendant is Robert D. Clements, an adult individual
residing at 29 North East street, Apt. 4, carlisle, cumberland
county, Pennsylvania.
3. On September 20, 1995 the Plaintiff woe the owner of a
1985 Toyota truck which, at about 6130 p.m. was being operatect by
William arinton traveling North on Route 74 in Carlisle,
Cumberland County, PennsYlvania, in the vicinity of the Carlisle
Plaza Mall.
4. At said time and place tho Pefendant was driving a 1986
rord pickup truck traveling South when he negligently and
carelessly crossed the center of the road into the northbound
lane and collided with the Plaintiff's vehicle resulting in the
damages herein after set forth.

D. FailinCj to see the Plaintiff's vehicle in time to
avoid a collision.
6. As a result of the negligence and carelessness ot the
Detendant, the Plaintiff's vehicle was rendered a total loss.
Said vehicle had an actual cash value of $5,700 prior to the
accident and a net salvage value of $384 resulting in a loss in
the amount of $5,315.
7. The Plaintiff incurred expense in the amount of $274.64
as a result of the loss of. use of her. vehicle.
WHEREFORE, the Plaintiff demands judgment against the
Defendant in the amount of $5,490.64 plus interest and costs of
suit, an amount within the jurisdiction of arbitration under the
local rules oe court.
