THE MASTERt
XN DIVORCE
Today is Thursday, October 14,
1999. This is the date set tor a Master's hearinq in the
above captioned divorce proceedinqs.
Present are the Plaintiff, Kay B. Eshenour,
and her counsel Andrea c. Jacobsen, and th~ Detendant, Jack
R. Eshenour, and his counsel Andrew C. Sheely.
This action was commenced by the filinq of
divorCe complaint on September 30, 1996, raisinq qrounds for
divorce of irretrievable breakdown of the marriaqe. Both
counsel are qoinq leave with the Master today affidavits ot
consent and waivers of notice of intention to request entry
of divorce decree so that the divorce can be concluded under
Section 3301 (c) of the Domestic Relations Code. The
Master's office will file the affidavits with the
Prothonotary.
The complaint also raised economic claims of
equitable distribution, alimony, alimony pendente lite, and
counsel fees and expenses.
Husband also raised an alimony claim by
~now~r and counterclaim filed on September 17, 1999.
The parties were married on July 2, 1966 and
np.nated 5eptemlJer 30, 1 !}!}6,

pareies have advised the Master that they have reached a
settlement with respect to the outstanding economic issues,
The settlement is going to be placed on the record in th,
presence of tht parties and counsel.
The a9reement as
stated on the record Will be conSidered the substantive
a9reement of the parties not sub~eot to any changes or
modifications except for correction of typographical errors
which may be msde dur~ng the transcription.
After the
agreement has b~en transcribed, the court reporter will
provide a draft to counsel to review for typographical
errors. Any corrections will be made as required and then
the parties will be asked to sign the~r signatures as an
affirmation of the terms of the agreement which are being
placed on the record at this time, When the parties leave
the conference room today they will be bound by the terms of
this agreement even though their signatures have not been
,
affixed to affirm the terms of settlement as stated.
After the Master has received a signed copy
of the agreement as placed on the record, he will prepare an
order vacating his appointment so that counsel will then be
able to prepare a praecipe transmitting the record to'the
Court requesting a final decree in divorce. Ms. Jacob$en.

1. Their Orrstown escrow account pre5ently in eXoes~
ot 099,000.00 shnll be awarded totally to wite,
2, The T. Rowe Price inveatment a~count presently in
title of hU5band shall be awarded totally to husband,
3. The title to the real estate property ot the
parties situate at 106 Cold Sprinqs Road, Carlisl~,
Pennsylvania, shall be transferred to wife. A deed shall
be prepared by wife's attorney and forwarded to husband's
attorney within th~ next five days and husband shall eXecute
that deed within seven days of his attorney's receipt of it
and forward it baCK to wife's attorney,
4, The cash value of the life insurance pres~ntly
held on wite's life shaLl be awarded to wife and husband
shall release any claim to that cash value.
5, The cemetery lots of the parties shall be awarded
to wife. In the event that the cemetery lots are i~ wife's
name, this aqreement will be effective as a release of any
interest that husband has in the lotsl if the lots are in
husband's name or joint names, husband will 8i9n whatever
documents are necessary to transfer title to the cemetery
lots to wite.
6, The Pontiac Grand Am presently in the joint names
of tha parties shall be transferred to wife's name. Husband
shall execute within seven days of his attorney's receipt, a
power of attorney authorizing a transfer of the title from
joint namea to wife's sole nsme.
7. The parties aqree that title to the 1990 ford
Escort presently in husband's name shall be transferred to
their dauqhter, Jenny ~shenour.
e, Wife will release any claim to the proceeds
received by husband on account of his t~tle or former title
to a 1990 Jeep Cherokee and a 1976 Chevy truck, both owned
a~ or about the time of th~ separation of the parties.
9. Wife will release to husband any claim to the
assete held in a certificate of deposit based on asseta
removed from jOlnt savings of ~he parties by husband just
prior to da~e of separation,
10. The pa~ties respectively ~eles4e each other from
any ala1m to the pe~sonsl p~operty p~esently in the
possess1on or title ot the othe~ pa~ty other than as set
torth heuin.
11. The parties agree that the retirement benetits
reae1ved by hUsband shall be distributed between the parties
in equal shares accordin9 to a coverture fraction. The
coverture traction shall be a number less than one, the
numerator ot Which will be the number ot Months f~om the
date ot marriage to the dote of aeparation of the parties.
The denominator sholl be the number of months from the date
ot husband's hire at IBH to the date of separstion of the
pal:ties.

The parties acknowledge and agree that
benefit of the IBH pension shall be the
p~operty of wife.

13. The amount of the pension to be distributed
presently shall be the cur~ent benefit of $2,342.97 per
month from now until October 1,2007, wife's shar.e not to
increase from her interest in the current monthly benet1t
oven thOUgh the total benefit increases, until SUch time a8
it may decrease as a result of husband's receipt of social
security benefits and/or husband's death when wife's po~tion
shall decrease.
14, Wife releases any claim to the pension or
retirement benefits received by husband subRequent to the
date of separation up to Bnd to todsy's date,
15, Each party waives their respective rights to
alimony, alimony pendente lite, and counsel fees and costs,
16. Th~ partie~ agree that husband may make use of the
sheds on the former marital property to be conveyed to wife
tor a period of thirty (30) days from, the date of deHvery
to husband's attorney of a deed.
17. Husband shall be entitled to all items of
personalty presently stored in the sheds at the former
marital residence. Any item not removed within thirty (30)
days after presentation of the deed shall be deemed
abandoned and/or wife's personal property.
lB. This shall constitute a full and complete
settlement of all of the respective marital claims that
either party may have against the other,

21. The parties have presented in ~heir reapective
pretrial statements full and fair disclosure of marital
assets, and in the event that either party should diacover
an item which was not properly presented in the pretrial
statements of both psrties, then either party shall have the
option ot pursuinq the material nondisclousre throuqh
appropriate judicial remedies,

Plaintiff and Defendant lI'ere married on July 2, 1966.
Plaintiff is Kay Barbara Eshenour (McNeely). Plaintiff's
date of birth is June 26, 1945. Plaintiff graduated from Central
Dauphin High School in 1963, She has no college education.
Plaintif f obtained employment in June of 1990 whera she worked for
Carlisle Publishers, Inc. (The Sentinel) t,hrough September of
1996. In September of 1996, Plaintiff obtained employment through
TSR Inc. where dhe works as a receptionist. Plaintiff's estimated
income is approximately $25,000.00 annually. Plaintiff may have

Defendant is Jack Roger Eshenour. Defendant'll date of birth

The parties are the pnrentlJ of two children, Karen L.
Eshenour, O.o.l!. Pecember 26, 1971, and Jenny Lynn Eshenour/

education. This is the first mar.riage for poth parties.
plaintiff moved from the marital residence in octobar of
1996, taking the majority of all personal property with her. The

Jenniter. 1'he car was purchased in May ot 1993.
7 The oor was purchased in July ot 1995 for $16,000,00, The
car has been used by Plaintiff since separation.
8 At separatJ.on from IBM, Def.endant received a separation
paokage ot approximately ~97, 000.00. An amount of app/;'oximately
$51,000,00 was invested by Defsndant. Defendant is uncertain as
to the location of the additional $46,000.00 and believes that
Wite has knowledge as to the whereabouts of these sums.
9 Gitt from IBM to Defendant,
10 Fluctuating with market conditions. This item was a gift
from Husband's employer to him at reHrement.
11 Defendant retired in 1993 and began receiving a net monthly
retirement benefit of approximately $1,905.00 per month. The
retirement benefit is a combination of a retirement benefit and an
estimated Social Security benefit. The combination is known as
"income leveling" which yields a temporary, higher monthly
benefit, until retirement age when tho benefit is permanently
reduced for the rest of the employee's lifetime. Defendant j,1I
currently attempting to obtain more specific information liS of the
fiUng of this pretrial memorandum. However, a copy of the
retirement plan which discusses these issues is attached hereto.
It is believed that Defendant' II benefit will fall to approximately
$1,006.54 per month all of October 1, 2004, when he may be eligible
for social security.
Plaintiff performed a pension analysis by Pension Appraiser,
Inc. However, the pension analysis does not reflect the leveling

^ divorce complaint was filod on Soptember 30,
1996, raising grounds for divorce of irretrievable breakdown of
the marriage. Although an affidavit under section 3301(d) wae
filed on November 9, 1998, averring two years of separation,
oounsel have indicated that the parties will most likely sign
affidavits of consent and waivers of notice of intention to
request entry of divorce decree so that a divoroe can be
ooncluded under section 3301(0) of the Domestic Relations Code.
The oomplaint also raised tho economio claims of
equitdblo distribution, alimony, alimony pendente lite, and
oounsel foee and expenses. Thoue claims Were raised by wife in
the oomplaint. Husband's attorney has indicated he is probably
going to file an alimony claim on behalf of. his cliont. In I1ny
event, counsel have indicated that there will be no testimony
offered on the factor of marital misconduct.
The parties were married on July 2, 1966, and
separated September 30, 1996. They are the natural parents of
two emancipated children. This is the first marriage for both
parties.
Wife is 53 yearo of age and resides at 302 West
Maplewood Avenue, Mechsnicsburg, where she lives with one of the
emancipated daughters. Wife is a high school graduate and work.
as an I1dministrative assistant for TSR, Inc. Her annual gross
income is around $33,000.00. Her net bi-weekly is $828.94. She
is also working part-time at the Bentinol in the classified
department wh~ra she earns about $200.00 per month. Wife has
not raised any health issues.
Husband is 66 years of age and resides at 285
West High street, Hummelstown, PennsylvaniB, where he livllB with
his sister I1nd her husband. He hAS a Bachelor's degree from
Shippensburg University. He worked for IBM from Novombor 19G3
through June 30, 1993, and t'E/tired from that company. 110 thon
got a job with Morrison Knudsen from July 1993 through June 1995
when he retired from that position. sinco that tim~ husband hilS
not had any gainful employment but has been rf,lclliving Ii not
monthly benefit of el,905.00. According to counsel, lit the time
that he attains the age of 65 And starts receiving his monthly
benofit, his retirement will be reduced to $1,005.00 por month.
This will occur on October 1, 2004. Husband has raised certain
health issuos inclUding a claim that he has diabetes, glaucoma,
ooronary hear.t disease, and early symptoms of lIuntington'a
disease. In ardor to help clarify husband's health concerns and
deal with the issues, counsel are probablY going to arrange to
take the deposition of husband's family physician. Also, wife
has raised a question as to husband's earning capacity since he
has not had any employment since his retirement in June of 1996.
It is wife'S contention that husband shOUld be ablo to have some
minimal earnings at least based on a minimum wage scale since
his retirement from Morrison Knudsen. According to wife husband
simply has choeen not to engage in any employment activities but
rather spends his time doing those kinds of things which he
enjoys like hunting and fishing.
Wife claims that the pension benefit which
husband has received from the date of separation is a marital
asset and that she is entitled to a PQrcentage of that benefit
from the date of separation until the hearing as part of her
distribution of marital assets. According to Attorney Jacobsen,
husband has received, since separation, from his pension benefit
the sum of approximately $61,000.00. The number that Ms.
Jacobsen has provided apparently is a gross payment using the
gross monthly benefit as opposed to the net benefit of
$1,985.00.
There is also an issue regarding the valuo of the
sur-vivor annuity which has been provided for wife. Ilusband
reserves the right to have that annuity valued by an export of
his choosing. He can then provide the results of his evaluation
to Ms. Jacobsen who had the initial valuation of tho pension
done. The valuation that Ms. Jacobsen had performed showed a
pension value as of the date of the separation of e326,ooO.00.
Ms. JaQobsen has indicated there may have to be some adjustment
to that number based on some inaccuracies.
The parties owned a property at lBB Cold Springs
Road, Dickinson Township, which consisted of two tracts of land
and a dwelling. The houae was consumed by fire in Oecember
1996, I1nd I1tter negotiations with the insurance company, the
pl1rties received $63,000.00, I1nd, in I1ddition, a sum of money
necessl1ry to payoff tho mortgl1ge on the property. I\lso the
parties reoeived $23,000.00 fo~ tho pe~sonI11ty. currently, the
total amount of money in escrow from the payout for the house
I1nd the contents is around $96,000.00.
The property where the dwelling is located is
still owned by the parties, and wife has valued tho property at
$30,000.00. She would be willing to take the lot as part of her
equitable distribution. Mr. Shoely does reserve the right to
have the lot appraised if he chooses to contest the value whioh
hils been placed on the lot by wife.
Husband claims that he made the mortgage payments
on the house in the amount of $4,800.00 total following the fire
which he was required to do until the settlement with the
insurance company. He believes he should be entitled to some
oredit for those payments which he made to the mortgagee.
According to wife, husband received a sum of money for living
expenses from the insur.ance company which would be compensation
for some or all of the expenses which he incurred reSUlting from
the continuation of the mortgage obligation.
Husband and wife own a 1990 Ford sedan which is
used by the parties' daughter. Counsel need to advise whether
Qr not they want to include that vehicle in the equitable
distribution computation or whether they can agree that that
vehicle shall become the property of the daughter by gift.
Wife has a 1993 Pontiac Grand Am which she has
valued at $8,000.00. Husband had a Jeep and a Chevrolet truck,
which according to his counsel he traded in to purchase his
current vehicle. According to wife the value that he received
on the trade in for the two vehicles was a total of $6,600.00;
$6,000.00 for the Jeep and $500.00 for the truck.
At the time of husband's retirement ho received
approximately $97,000.00 from Mellon Bank as part of his
retirement package from IBM. currently there is around
$56,000.00 of that money in a CD at Mellon Bank and husband
claims that he does not know what happened to the balance of the
funds since they were under wife's control during the time that
she was handling the finances. It is noted, however, that the
money that husband claims cannot be accounted tor was spent
during the time the parties were married and living in a viable
relationship from 1993 to 1996. It is the Master's position
that he will generally not look into the mrtter of how a family
handles its finanoes l1>>d p~.sum.s thl1t husband had as much
cont~ol o~ knowledge about where the money was going o~ had the
ability to know where tho money was going during the time that
h. Wae living in the ma~ital relationship with wire.
Husband rocoived a gitt at nine sh8~us ot IBM
stock on his roti~eme>>t. There is a queBtio>> as to whether we
should tredt that stock a9 a non-marital asset or as a seVerl1n08
package and consider it n marital aBset. Counsel con make th.i~
I1pp~opriate arguments on that issue at the time of the he8~ing,
but, in any event, we will need to have evidence ae to the value
ot the stock or the increase in value ot tho stock, as the case
may be, depending on how we treat the stock.
There are funde in a T. ~owe Price account and
there are 46 shares of Morrison Knudsen stock. Tho pnrtieo alBo
own an ATV and have Bome burial plots. Wife roceived certain
tunds trom the eBtate of her mothur. 60me of thoBe fundB are in
a co in the amount of 82,500.00, and she also received a
proceedB check in exceBS at $29,500.00. Wife'S contention is
that she received those funds after the separation, and, in any
event, they were never coming led with marital aesets and would
~etain their non-marital character.
Wife inquired as to whether or not husband has an
interest in a hunting camp in Potter county, and husband claims
that he has no interest and that, therefore, there is no value
to him in any ownership in that camp.
Mentioned above were the burial plots at Rolling
Green Cemetery which wife valued at $700.00 and hUBband valued
at $2,600.00. Counsel and the parties can determine how they
want to distribute the cemetery plots. In any event tha plots
will most likely be distributed to one of the parties BO we will
need a value that is reasonable to charge against the party
receiving the plots.
With respect to the household tangible per.sonal
property, there are a number or iSBues. Wife claims that she
took property before the fire and around the time at separation
with a value of $551.00. Husband presented an apprilisal which
was apparently performed on September 30, 1996, showing tangible
personal property with a value of $5,700.00. We neod to have
the parties determine whether or not all of that property
remained in the house after wife left or whether or not any of
that property was non-marital.
A further issue involves the receipt by the
parties of the monies for the personal property and whethsr or
not husband should be yiven soms oredit tor the taet that seme
ot that money was reoe vod by him ter property whioh he cll1ims
he purehl1sed I1tter the sepl1ration and betore the tire. HUsband
will have the burden of preving what property he reoeived or
what property he purohased to establish his ulaim tor credit on
the personalty as non-marital.
Husband claims that wife used marital assets to
purohase items frem her mother's estate, namely some gold ooins
I1nd a ring totaling $500.00. If, in faot, this is correot then
those items trom the mother's estate are to be considered
marital I1S opposed to the charaoterization ot the oOBh whioh
wite reoeived as noted above which would most likely be
oharaoterized as non-marital.
Aside from the mortgage which was paid ott at the
time ot the tire which was against the marital residenoe, there
is no marital debt.
On the issue of husband's health and his el1rninq
oapl1oity, the Master haa noted that counsel are going to try to
arrange a deposition of husband's physician, and after the
deposition wife will be able to rebut or proceed with any issues
whioh she feels were not properly addressed based on the
testimony of husband's doctor. Further, on the matter of
husband's earning capacity, wife may want to consider having
husband evaluated by a vocational expert. This would be most
likely better accomplished after there is some conclusion as to
husband's health situation because certainly the health issues
would have some bearing on any recommendation which the
vocational expert might make regarding husband's earning
capacity. In preparing any rebuttal on behalf of wife in
response to husband's medical testimony, wife reserves the right
to request that husband be examined by a physician or physioians
of her own choosing and also that husband submit to an
evaluation by a vocational expert of her choice.
Wife's attorney has indicated that husband may
have had hunting equipment and rifles and shotguns outside ot
the home I1t the time of the fire, and that if he did they should
be accounted for in th. total value of the personal property.
