S. At all times material hereto, Defendant acted through its agents, servants
and/or employees within the course and scope of their agency or employment.
6. On February 2. 1996 at approximately 10:30 a.m., Plaintiff was caused to
fall on snow and ice on the steps of said door number 24.
7. As a result of the accident, Plaintiff sustained injuries and damages,
including but not limited to, injuries to his nerves, bones, muscles, joints and fascia, pain
and suffering, mental and emotional distress, which may be continuing.
8. As a result of his injuries. Plaintiff incurred medical bills and expenses for
care and treatment, suffered lost earnings and/or loss of earnmg capacity, suffered loss of
life's pleasures and diminution of activities. which may be continuing.
9. The said accident was due to the negligence of Defendant, including:
A. Allowing dangerous substances to accumulate on the
said steps:
B. Failing 10 relnove dangerous snow and ice accumulation
C. Failing to salt or cinder the said steps under snow and
ice condiuom;
D. Failing 10 warn persons such as Plaintiff of an unreasonable
risk of harm:
