1. Plaintiff is JUCJWlD .. POWBLL ("hereinafter Powell"), an
adult individual residing at 686 Front street, Weat Fairview,
CUmberland County, Pennsylvania 17025.

CRAPr...., (hereinafter "Harder"), an adult individual with an
addre.. of 425 Bolton Drive, Harrisburg, Dauphin County,
Pennsylvania 17112.
COUNT I /Breach of Contractl
3. On or about June 4, 1995, Powell and Harder entered into
a written agreement entitled "Estimate/Agreement" (hereinafter "the
Agreement"). A true and correct copy of the Agreement is attached
hereto as Bxhi~it A.
4. Under the Agreement, Harder agreed to design and provide
the labor and materials to complete certain renovations to Powell's
home, as specified in the Agreement (hereinafter "the project").
5. In exchange for providil19 the work on the project, Powell
agreed to pay Harder the amount of $34,675.00.
6. The Agreement was subsequently amended by a writing on or
about June 29, 1995 (hereinafter "the Amendment"), by which the
parties mutually agreed to increase the scope of work and to
increase the contract alllOunt by $3,093.60, making the revised
contract amount $37,768.60. The Amendment is attached hereto as
bhi~lt B.
7. Under the Agreement, Harder expressly and/or impliedly
agreed to, and obligated hi..elf to:
(a) properly and efficiently manage the project:
(b) properly d..i9ll the work to be done on the project:

(c) perform the work under the Agreement in a
workmanlike mannerl
(d) invoice/charge Powell only for labor actually
performed and materials actually providedl
(e) perform the work as depicted on the plans provided
to Powell and agreed to by Powelll
(f) provide Powell with an as-built drawing showing the
new electrical wiringl and
(g) pay his subcontractors on a timely basis.
8. Harder breached the Agreement in that he, among other
things, but not limited to:
(a) failed to perform the work in a workmanlike mannerl
(b) failed to perform the work in accordance with the
plans which were agreed upon by the partiesl
(c) billed Powell for materials that were not actually
installed in the projectl
(d) failed to provide Powell with aU of the uteriala
for which Powell was billedl
(e) double-charqed Powell for certain uterial.,
(f) failed to properly d..ign the work to be done,
)
(g) tailed to provide Powell with an as-built drawing
showing where Harder ran the new electrical wiring;
(h) tailed to manage the construction in an etficient
manner;
(i) tailed to reimburse Powell for materials paid tor
by Powell but never provided to the project;
(j) tailed to properly install electrical wiring;
(k) tailed to properly install several doors;
(1) tailed to properly install cable television and
telephone wiring;
(m) failed to properly install laundry room lights and
light switches in the dining room; and
(n) tailed to properly pay subcontractors for work done
on the proj ect.
(0) failed to secure Powell's property/holle when not at
the site.
9. Powell made several complaints to Harder regardinq the
ator--.ntioned breach...

10. On or about July 15, 1995, but before Harder completed
the contract work, Harder requested that the contract be
terminated.
11. Powell agreed to terminate the contract effective
July 15, 1995, as to the remaining contract work only.
12. A substantial portion of the defective work performed by
Harder was discovered after July 15, 1995.
13. As a result of the aforementioned breaches of contract by
Harder, Powell was:
(a) forced to incur additional expenses in repairing
Harder's substandard work:
(b) forced to incur additional expenses in locating new
wiring installed by Harder:
(c) forced to incur additional expenses in having
Harder's substandard electrical installation
redone:
(d) forced to incur additional and unanticipated
expenses in resolvil'l9 the problem. brouCjht about by
Harder's aforeaentioned breache., and
(e) forced to incur unjustified expense. by payincJ
Harder for aaterials not actually incorporated into

the project, and by paying twice tor the same
materials.
14. As a result ot the atorementioned breaches ot contract by
Harder, Powell suttered total damages ot $7,455.00 Cnot including
interest) to date as follows:
Ca) cost of corrective work: $3,062.50
Cb) master electrician charges: $340.00
Cc) estimated cost of turther necessary rework: $700.00
Cd) cost of materials billed for, paid for, but not
received: $685.29
Ce) double payment tor materials: $768.21
Ct) Plaintiff's costs in resolving the problems caused
by Harder's breaches: $1,781.50
Cg) court costs to date: $117.65
15. Powell has paid Harder $23,875.00, of which Harder haa
reimbursed Powell the amount ot $1,003.22.
16. Powell haa performed all conditions precedent for the
bringing ot this action.

17. Powell incorporates by reference herein paragraphs one
(1) through sixteen (16) above as if set forth fully.
18. Harder owed a duty to Powell to perform the construction
in a workmanlike manner.
19. Harder breached his duty to Powell to perform the
construction in a workmanlike manner as more specifically and fully
set forth in Count I of this Complaint, which is herein
incorporated by reference.
20. Harder performed his work in a negligent manner in that
he failed to perform his work under the terms of the Agreement in
a substandard and less than workmanlike manner, as is more fully
set forth in Count I of this Complaint, which is herein
incorporated by reference.
21. As a result of Harder's ne<Jliqence, Powell bas suffered

22. Powell incorporates by reference herein paragraphs one

23. Harder held himself out to Powell as a construction
contractor, capable of performing the necessary construction work
under the Agreement in a workmanlike manner.
24. Harder impliedly warranted that he would perform the
construction work under the Agreement in a workmanlike manner and
with reasonable workmanship.
25. Harder has breached the implied warranty of reasonable
workmanship by failing to perform his work in a workmanlike manner
as is more fully set forth in Count I of this Complaint, which is
incorporated herein by reference as it set forth fully.
26. As a result of Harder's breach of the implied warranty of
reasonable workmanship, Powell has suffered damage. as are aore
