WHEREFORE, answering defendants, Subaru of America, Inc. and
Cumberland Valley Motors, demand that plaintiff's Complaint be dismissed
with prejudice with costs and fees assessed against plaintiff.

15. Defendants discharged each and every obligation, if any. which
they may have owed to the plaintiff, and otherwise defendants owe no duty
to the plaintiff.
16. The damages alleged in the Complaint were not proximately
caused by any act or omission by defendants.
17. Any damages sustained by the plaintiff as alleged in the
Complaint may have been caused or contributed to by the plaintiff's own
negligent acts or omissions and/or the negligent acts or omissions of
persons or entities other than defendants.
18. The negligent acts and/or omissions of individuals or entities
independent of defendants may have constituted intervening. superseding
causes of the damages alleged to have been sustained by the plaintiff in
the Complaint.
19. The Subaru vehicle in question may have been substantially
altered after it left the possession, custody. and control of defendants.

20. The Subaru vehicle in question may have not been properly
maintained and/or may have been misused or abused.
21. If it is determined that any warranties, whether express or
implied, exist between defendants and plaintiff, defendants deny that
they breached any such warranties.
22. The condition of the subject vehicle as described in the
Complaint does not substantially impair the vehicle's use, value, or
safety.
23. If it is determined that plaintiff is entitled to a refund of
the purchase price of the vehicle in question, then answering defendant3
are entitled to a recoupment of the vehicle.
24. Plaintiff's Complaint fails to state a caUSi! of action for
which recovery may be sought against defendants.

6. On May 25, 1995, the Plaintiff, while driving on Bloserville Road in Upper Frankford
Township, Cumberland County. Pennsylvania, applied the brakes which failed to respond. This
episode was accompanied by an especially strong odor of burning rubber.
7. On February 7. 1996. on Creek Road in North Middleton Township. Cumberland
County, Pennsylvania. Plaintiff again applied the brakes as she was approaching an intersection,
and the brakes, once again. failed to respond.
8. Plaintiff attempted to have the problems described in Paragraphs 5, 6 and 7 above
corrected on the following occasions:
A. On March 2. 1995. the 7,500 mile service;
B. On May 25. 1995 at 15.684 miles;
C. On November 10. 1995 at 22,579 miles; and
D. On February 12. 1996 at 26.376 miles.
9. All referenced repairs were attempted by authorized Subaru repair faCilities.
