Marlin E. Wagner, Jr. and Peggy V. Wagner, Plaintiffs, by and
through their attorney, Edward E. Guido, Esquire, and Heather M.
Parks and Shawn A. Parks, Defendants to stipulate as follows:
(1) Plaintiffs, Marlin E. Wagner, Jr. and Peggy V. Wagner
are adult individuals who currently reside at 1480 Newville Road,
Carlisle, Cumberland County, Pennsylvania.
(2) Plaintiffs will soon be residing at 2112 Woodfield
Drive, Sophia, North Carolina.
(3) Defendant, Heather H. Parks is an adult individual who
currently resides at 203 Fairfield Street, Apartment No.4,
Newville, Cumberland County, Pennsylvania.
(4) Defendant, Shawn A. Parks is an adult individual who

currently resides at 604 Second Street, First Floor, Cresson,
Pennsylvania.
(5) Plaintiffs are the maternal grandparents of Spencer
Wil~iam Parks, age 8 (d.o.b. August 17, 1~88).

I (6) The partiea agree that Plaintiffs, Marlin E. Wagner,

1 custody of the said Spencer Wi 11 iam Perks.

(7) The parties further agree that the said Spencer wi lliam
Parks shall accompany Plaintiffs to their new home in North
Carolina.
(8) Daniel Cutchall is an adult individual who currp.ntly
resides at 340 Wertz Run Road, Carlisle, Cumberland County,
Pennsylvania.
(9) Said Daniel L. Cutchall had physical custody of the
child, Spencer William Parks from November 30, 1995 through
September 1, 1996.
(10) The said Daniel L. Cutchall joins in this Stipulation
to acknowledge his consent to placing legal and physical custody
of Spencer William Parks with Plaintiffs.
(11) The parties desire that this Agreement be evidenced by
an Order of Court.
WHEREFORE, the parties hereto request Your Honorable Court
to enter an Order awarding full legal and physical custody of
Spencer William Parks to his maternal grandparents, Marlin E.
, Jr. and Peggy V. Wagner.
