COMPLAINT
AND NOW, comes Plaintiff, Debora Enterprises, Inc., by and
through its attorneys, the Law Offices of Stephen C. Nudel, and
respectfully makes claim for declaratory and injunctive relief as
follows:
1. Plaintiff, Debora Enterprises, Inc., is a Pennsylvania
corporation with a business address of 310 Bridge Street, New
CUmberland, CUmberland County, Pennsylvania 17070.
2. Defendant, Charles Crone, is an adult individual with
an address of 312 Bridge Street, New CUmberland, CUmberland
County. Pennsylvania 17070.
3. Defendant is the owner of the premises located at and
known as 310 Bridge Street. New CUmberland. CUmberland County.
Pennsylvania ("PREMISES"'.
4. On July 1. 1995. Plaintiff as Lessee and Defendant as
Lessor executed a Commercial Lease ("LEASB"' for the Premises. A
true and correct copy of the Lease is attached hereto and made a
part hereof as "Exhibit A",
5. The term of the Lease ends June 30, 1998,
6. The Lease provides, inter alia, that rent is due on the
first day of each month.
7. Paragraph 3 of the Lease provides, inter alia, for
default when any installment of rent is not paid for a period of
ten days.
8. On August 8. 1996. Plaintiff issued check number 1545
for payment of August rent.
9. Defendant claims he did not receive the check until
August 14, 1996.
10. Defendant is in receipt of check number 1545.
11. A controversy has arisen between Plaintiff and
Defendant relative to their legal rights and duties under the
Lease in that Defendant claims under paragraph 3 that he may
accelerate rent and evict Plaintiff.
12. By letter dated September 4, 1996, Defendant. through
his counsel, has. inter alia, notified Plaintiff that the Lease
has been terminated and that Plaintiff must vacate the Premises
on or before October 4, 1996. A true and correct copy of the
September 4. 1996. letter is attached hereto and made a part
hereof as "&xhibit B".
13. Plaintiff has paid all sums due and OWing under the
Lease.
14. Plaintiff is current with all obligations under the
Lease,
15. The Lease is in full force and effect between the
parties and there are no other agreements, written or oral, which
in any manner change or vary the terms and conditions of the
Lease.
16. Plaintiff desires to remain in possession of the
Premises until the natural termination of the Lease.
17. Defendant on occasion has entered the Premises after
hours and without Plaintiff's consent.
18. Plaintiff has unsuccessfully attempted to confirm
Defendant's intentions with respect to possession of the
Premises.
19. It is believed and therefore averred that Defendant
will attempt to exercise unconscionable. unconstitutional and/or
unlawful self-help remedies to regain possession of the Premises.
20. It is believed and therefore averred that Defendant is
unlawfully attempting to regain possession of the Premises so
that his wife may have the use of the Premises.
21. In the alternative, it is believed and therefore
averred that Defendant is unlawfully attempting to regain
possession of the Premises so that he may relet the Premises for
a higher rent amount.
22. This action is brought under the Declaratory Judgments
Act. 42 Pa.C.S.A. 55 7531. et seq.
