under the intestate laws, or the right to take against the
spouse's Will, or the right to treat a lifetime conveyance as
testamentary, or all other rights of a surviving spouse to
participate in a deceased spouse's estate, whether arising
under the laws of the Commonwealth of Pennsylvania or any other
state or any country, as well as any and all other claims,
demands, damages, actions, causes of actions, or suits at law
or in equity, of whatsoever kind or nature, for or because of
any matter or thing done, omitted, or suffered to be done by
said party prior to and including the date hereof; except that
this release shall in no way exonerate or discharge either
party hereto from the obligations and promises made and imposed
by reason of this Agreement, and shall in no way affect any
cause of action in absolute divorce which either party may have
against the other party.
4. MARITAL PROPERTY, The parties hereto acknowledge and
agree that they acquired various assets during their marriage,
whether the same were held jointly or individually by the
parties hereto, including but not necessarily limited to:
(a) A residence at 715 North 19th Street, City of
Harrisburg, Dauphin County, Pennsylvania, which the parties
purchased in 1985, the same being titled in Wife's name alone.
(b) Household goods, contents, furniture and
furnishings.

(c) Various bank accounts.
(d) Various motor vehicles.
(e) Husband's retirement benefits through the Federal
Employees Retirement System, having a estimated value as of
June 11, 1996 (based upon an accrued benefit of $163.00 per
month as of the date of separation) in the amount of $9,041.61,
and Husband's Thrift Savings Plan having an estimated value of
$1,000.00 as of the date of separation.
5. DISTRIBUTION OF MARITAL PROPERTY. The parties hereto
covenant and agree that the assets described in Paragraph 4,
above, together with any other property that the parties
acquired individually or jointly prior to the marriage, have
been or are hereby being divided and distributed between them
as follows:
(a) The parties agree to liquidate the property known
and numbered as 715 North 19th Street, City of Harrisburg,
Dauphin County, Pennsylvania, through public or private sale,
including but not limited to the sale of the property for
delinquent real estate taxes. The parties shall share equally
in the gains or losses from such disposition of the property,
and the parties further agree to share equally in the expenses
attributable to the real estate; provided, however, that
neither party shall voluntarily incur any expense related to
the real estate without the knowledge and consent of the other

Order of Court or Agreement with respect to equitable
distribution or alimony as set forth in the Pennsylvania
Divorce Code or other similar statute ncw in effect and as
amended or hereafter enacted.
12. INDEMNIFICATION FOR FUTURE DEBTS. Each of the parties
hereby covenants and agrees with the other party not to make,
incur or attempt to make or incur any debt or obligation for or
on behalf of the other party hereto, or for which the other
party may be held liable, from and after the date hereof, and
each of the parties hereto hereby covenants and agrees to
indemnify the other party and save him or her harmless from all
liability or claim on account of said debt or obligations from
and after the date hereof.
13. OTHER DOCUMENTS, Each of the parties hereto shall,
from time to time, at the request of the other party, execute,
acknowledge and deliver unto said other party any and all
further documents or instruments which may be reasonably
required to give full force and effect to the terms and
provisions of this Agreement.
14. DIVORCE. This Agreement shall not be construed to
affect or bar the right of either Husband or Wife to an
absolute divorce on legal and truthful grounds if they now
exist or may hereafter arise. This Agreement is not intended
to condone and shall not be deemed to be a condonation on the

part of either party hereto of any act or acts on the part of
the other party which have occurred prior to or which may occur
subsequent to the date hereof. It is understood, however, that
Husband is pursuing an action in divorce in the Court of Common
Pleas of Cumberland County, Pennsylvania, filed to No. 96-5479
Civil, pursuant to Section 3301(c) of the Divorce Code of
Pennsylvania, on the grounds that the marriage is irretrievably
broken, and that both parties agree to execute and file the
appropriate affidavits of consent and waivers necessary to
conclude said action in divorce on the basis of mutual consent
as quickly as possible.
15. SEVERABILITY, The waiver of any term, condition,
clause or provision of this Agreement shall in no way be deemed
or considered a waiver of any other term, condition, clause or
provision of this Agreement, and if any provision of this
Agreement is held to be invalid or unenforceable by a court of
competent jurisdiction, all other provisions shall nevertheless
continue to be in full force and effect.
16. LAW OF PENNSYLVANIA APPLICABLE. This Agreement shall
be construed under the laws of the Commonwealth of
Pennsylvania.
17. ADVICE OF COUNSEL. Both parties covenant and agree
that they have had ample and sufficient time to carefully and
fully review the terms and provisions of this Agreement and to

seek and obtain the advice and counsel of an attorney with
respect to the same. Wife has engaged the services of Mindy S.
Goodman, Esquire, and Husband has engaged the services of
Marlin R. McCaleb, Esquire, and each party has carefully
reviewed the terms and conditions of this Agreement with his or
her respective counsel. Both parties covenant and agree that
they fully understand the facts upon which this Agreement is
premised and based, that they believe this Agreement to be
fair, reasonable and equitable, that said Agreement is being
entered into freely and voluntarily by each of them, and that
the execution of this Agreement is not the result of any duress
or undue influence and that it is not the result of any
collusion or improper or illegal agreement or agreements.
18. INSURANCE. Husband agrees to include the parties'
son, Joseph Kreiner, in the medical insurance coverage provided
through his employer, but only if, so long as and to the extent
that said son is eligible for such insurance coverage as a
dependant of Husband and the insurance carrier agrees to insure
said son.
19. INTEGRATION. This Agreement constitutes the entire
understanding between the parties and supersedes any and all
prior agreements and negotiations between them. Both parties
further agree that there are no covenants, conditions,
representations or agreements, oral or written, of any nature

whatsoever, other than those contained herein.
20. ENFORCEMENT. In the event of a breach of this
Agreement by either party, the non-breaching party shall have
all remedies available at law or in equity for breach of
contract, including but not limited to the right to sue for
damages, the right to specific performance of the Agreement and
all remedies as provided under Section 3105(a) and Section
3502(e) of the Pennsylvania Divorce Code or other similar
statute now in effect and as amended or hereafter enacted. In
addition, any party breaching this Agreement shall be liable to
the other party for all costs, including counsel fees,
reasonably incurred by the non-breaching party to enforce his
or her rights under this Agreement.
21. AGREEMENT BINDING UPON HEIRS. This Agreement shall be
binding upon the parties hereto and their respective heirs,
executors, administrators and assigns.
IN WITNESS WHEREOF, the parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals
the day and year first above written.

NOTICE TO DEFEND AND CLAIM RIGHTS
You have been sued in court. If you wish to defend against
the claims set forth in the following pages, you must take
prompt action. You are warned that if you fail to do so, the
case may proceed without you and a decree of divorce or
annulment may be entered against you by the court. A judgment
may also be entered against you for any other claim or relief
requested in these papers by the Plaintiff. You may lose money
or property or other rights important to you, including custody
or visitation of your children.
If the ground for the divorce is indignities or
irretrievable breakdown of the marriage, you may request that
the court require you and your spouse to attend marriage
counseling prior to a divorce decree being handed down by the
court. A list of marriage counselors is available in the
Office of the Prothonotary at Cumberland Country Court House,
Carlisle. You are advised that this list is kept as a
convenience to you and you are not bound to choose a counselor
from the list. All necessary arrangements and the cost of
counseling sessions are to be borne by you and your spouse.

1. Plaintiff is PAUL L. KREINER, JR., who currently
resides at 442 South York Street, Mechanicsburg (Borough of
Mechanicsburg), Cumberland County, Pennsylvania 17055, since
January 17, 1992.
2. Defendant is SHARON L. KREINER, who currently resides
at 5031 Lancaster Street, Apt. D, Harrisburg, Dauphin County,
Pennsylvania 17111, since September 3, 1994.
3. Plaintiff and Defendant have been bona fide residents
in the Commonwealth of Pennsylvania for at least six (6) months
immediately previous to the filing of this Complaint.
4. Plaintiff and Defendant were married on July 9, 1976,
in Havre de Grace, Maryland.
5. There have been no prior actions of divorce or
annulment between the parties.
6. The marriage is irretrievably broken.
7. Plaintiff has been advised that counseling is available
and that Plaintiff may have the right to request that the Court
require the parties to participate in counseling.

AFFIDAVIT OF CONSENT
1. A Complaint in Divorce under Section 3301(c) of the
Divorce Code was filed on October 4, 1996.
2. The marriage of Plaintiff and Defendant is
irretrievably broken and ninety days have elapsed from the date
of filing the Complaint.
3. I consent to the entry of a final decree of divorce
after service of notice of intention to request entry of the
decree.
I verify that the statements made in this affidavit are
true and correct. I understand that false statements herein
are made subject to the penalties of 18 Pa. C.S., Section 4904,
relating to unsworn falsification to authorities.

Associates and files this petition for Leave of COUl.'t to \Hthdraw
as Counsel for Defendant, as follows:
1. Petitioner, the offices of Fenstermacher and
Associates, has represented Defendant Sharon L. Kreiner
("Kreiner") in the instant action since in or about June, 1996.
2. At this time Kreiner is sulHltantlalJy in arrears on
payments due Fenstermacher and AssociatlJH for legal services
provided.
3. On November 19, 1996 the Court entored an Order
awarding alimony pendente lite to I<reiner in the amount of Two
Hundred Fifty ($250.00) Dollars per month. That Order is still
in full force and effect.
4. Despite tlw pn!rwnco of such incLlme, Kreiner has

AND NOW, comes the Defendant Sharon L. Kreiner, by her
attorneys the offices of Fenstermacher and Associates, and files
the following Answer and assets the following allegations:
1. Admitted upon information and belief.
2. Admitted.
3. Admitted.
4. Admitted in part and denied in part. It is
admitted that the date of the marriage at issue was July 9, 1976.
It is denied that the parties were married in Havre de Grace,
Maryland. To the contrary, the parties were married in Bel Air
(Harford County) Maryland.
5. Admitted.
6. Plaintiff is asserting a conclusion of law to which
no response is deemed required. To the extent a response is
deemed necessary, the same is denied.
7. Plaintiff is without knowledge sufficient to form a
belief as to the validity of the allegation and the same is
therefore denied.
8. No response is deemed necessary. To the extent a
response is deemed necessary, Defendant requests this Honorable
Court enter judgment in her favor.
COUNTER-CLAIMS
COUNT I - DIVORCE SECTION 3301(a)(2)
9. The averments of paragraphs 1 through 8 above are
incorporated herein by reference as if set forth in full.
10. Plaintiff has committed adultery in violation of
the marriage vows.
WHEREFORE, the Defendant requests this Honorable Court
enter a Decree of Divorce in her favor.
COUNT II - DIVORCE SECTION 3301(a)(3)
11. The averments of paragraphs 1 through 10 above are
incorporated herein by reference as if set forth in full.
12. Plaintiff has offered cruel and barbarous
treatment so as to endanger the life or health of the injured and
innocent spouse.
WHEREFORE, the Defendant requests this Honorable Court
enter a Decree of Divorce in her favor.

13. The averments of paragraphs 1 through 12 above are
incorporated herein by reference as if set forth in full.
14. Plaintiff has offered such indignities to the
person of the Defendant, the innocent and injured spouse, as to
render her condition intolerable and life burdensome.

enter a Decree of Divorce.

COUNT IV - EOUITABLE DIVISION, DISTRIBUTION AND
ASSIGNMENT OF MARITAL PROPERTY
15. The averments of paragraphs 1 through 14 above are
incorporated hereby by reference as if set forth in full.
16. The parties are the owners of various items of
property which qualify as marital property as defined in Section
401 of the 1980 Divorce Code.
17. Said marital property is subject to equitable
division, distribution and assignment by the Court.
WHEREFORE, the Defendant requests this Honorable Court
equitably divide, distribute and assign the parties' marital
property.
COUNT V - ALIMONY PENDENTE LITE. SUPPORT.
COUNSEL FEES AND EXPENSES
18. The averments of paragraphs 1 through 17 above are
incorporated hereby by reference as if set forth in full.
19. By reason of this action, Defendant will be put to
considerable expense in the preparation of her case, in the
employment of counsel and the payment of costs.
20. Defendant is without sufficient funds to support
herself and to meet the costs and expenses of this litigation and
is unable to appropriately maintain herself during the pendency
of this action.
21. Defendant's income is not sufficient to provide
for her reasonable needs and pay attorneys' fees and the cost of
this litigation.

net income which is within the limits set in the Consumer Credit Protection Act, 15
V.S.C. ~1673.
7. The term "income" as defined by law includes compensation for services, including, but
not limited to, wages, salaries, fees, compensation in kind, commissions and similar
items; income derived from business; gains derived from dealings in property; interest;
rents; royalties, dividends, annuities; income from life insurance and endowment
contracts; all forms of retirement; pensions; income from discharge of indebtedness;
distributive share of partnership gross income; income in respect of a decedent; income
from an interest in an estate or trust; military retirement benefits; railroad employment
retirement benefits, social security benefits; temporary and permanent disability benefits;
worker's compensation and unemployment compensation.

GENERAL INSTRUCTIONS

amount must not be deducted from the attachment. It must be paid from the employee's
net earnings after the income attachment deduction has been made.

transmittal fonn to the Domestic Relations Office.
3. If you choose to make payments via an electronic funds transfer, instructions may be
requested from the Domestic Relations Office.
