13. 765 Poplar Church Road was purchased by the
Plaintiffs with the intent of locating the daily operations of
its sole tenant, Greenberg & Company, P.C., a certified Public
Accounting firm, at such location.
The facilities will
include adequate parking for the occupants of the building and
will be attractively landscaped.
14. Prior to the purchase of 765 poplar Church Road by
the Plaintiffs, such property \-Ias utilized as a medical office
for twenty five (25) years,
15. Presently, the parcels of land knOlvn as Long Meadows
Northern section, Section A, Lot Nos. 1 to 11 and section c,
Lot No.1 are utilized as fo110\-ls:
a. On Lot No, 1 and C(l) exists a large office
complex \-lith approximately eleven (11) individual tenants as
evidenced by a large vertical sign along and visible from
Poplar Church Road.

c. The Covenilnts a re unenforceable against the
Plaintiff because of vagueness ilncl ambiguity which yields
alternative interpretations, 1~e Covenants must be strictly
construed against any party seeking to enforce the
restrictions, and any doubt and ambiguity in the language or
application must be resolved in favor of the owner of the
property burdened by the Covenants.
d. Of the tvlel ve (12) lots expressly controlled by
the Covenants prohibiting any use of a lot for any purpose
other than residential purposes, at least ten (10) lots,
including Plaintiffs' parcel, currently have commercial or
professional tenants utilizing their respective lots in
furtherance of commercial or professional Objectives.
e. Because of the substantial changes in the
surrounding areas and the conversions of residential
properties to commercial use, Defendants derive no value from
the enforcement of the Covenants against Plaintiffs.
Enforcement of the Covenants against the Plaintiffs' property
will not reverse the changes to the poplar Church Road area of
real property.

The Architectural Control Committe. will be composed
of three members, all of whom are lot owners 1n the Plan of Lot.,

event of death or resignBtlo~ or any member of tbe committee, the
remaining member shall have full authority to deslgD~te a successor.

November 1, 1965, as recorded in the Office of the Recorder of
Deeds in and for Cumberland County, pennsylvania, at Volume
21, Book U, Page 593,
