HomeMy WebLinkAbout02-4974STIPULATION AGAINST LIENS THIS AGREEMENT made the 10th of October, 2002, by and between J. W. MUMPER, CONSTRUCTION, INC. DOUGLAS E. WISEHAUPT and WEN-DY L. WISEHAUPT, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Silver Spring Township, Cumberland County, being Lot #2 on the Final Subdivision Plan for Hillside Farms, as per attached legal: NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to J. W. MUMPER CONSTRUCTION, INC. in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. ALL THAT CERTAIN tract of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being shown as Lot No. 2 on the Major Final Subdivision Plan for Hillside Farms (formerly Hempt/Mumper Subdivision) Phase I, Silver Spring Township, Cumberland County, Pennsylvania, prepared by H. Edward Black and Associates, P.C., recorded with the Cumberland County Recorder of Deeds Office in Plan Book 72, Page 77 (the "Plan"). Said Lot No. 2 is more bounded and described, according to the Plan, as follows: BEGINNING at a point in the westerly line of Chantilly Court, said point being the dividing line between Lot Nos. 1 and 2; thence by a curve to the left having a radius of 95.00 feet, an arc distance of 110.79 feet, the chord of which is South 05 degrees 39 minutes 52 seconds East, 104.62 feet to a point; thence along the northwesterly line of Lot No. 3, South 50 degrees 55 minutes 34 seconds West, a distance of 130.04 feet to a point; thence along lands now or formerly of David W. Penwright, North 29 degrees 19 minutes 10 seconds West, a distance of 169.03 feet to a point; thence along the easterly line of Ridge Hill Road (T-578), North 26 degrees 44 minutes 08 seconds East, a distance of 114.99 feet to a point; thence along the southerly line of Lot No. 1, South 62 degrees 15 minutes 19 seconds East, a distance of 137.47 feet to the point and Place of BEGINNING. CONTAINING 0.61 acres of land, according to Plan. UNDER AND SUBJECT, nevertheless, to all easements, restrictions, encumbrances and other matters of record or that a physical inspection or survey of the premises would reveal. BEING THE SAME PREMISES WHICH Michael L. Martin, Inc., a Pennsylvania Corporation, by Deed dated April 18th, 2002 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book 251, Page 2093, granted and conveyed unto Douglas E. Wisehaupt and Wendy L. Wisehaupt, husband and wife.
