1. plaintiff is Kathleen M. Soward, an adult individual who
resides at 221 Z Camelot Arms, York, pennsylvania 17402.
2. Defendant is Larry A. Soward, an adult individual who resides
at 2755 Spring Road, Carlisle, Pennsylvania 17013 (subject real estate) .
3. plaintiff is the owner of subject real estate, having
acquired her title by deed dated september 19. 1994 and recorded in
Cumberland County Deed Book 112, Page 218.
4. Plaintiff and Defendant are husband and wife. albeit
estranged, with a divorce now pending.
5. Plaintiff gave notice to Defendant to vacate these premises
by no later than September 30, 1996, but Defendant has failed and refused
to do so.
6. Since Defendant has no title to subject real estate, no
further abstract of title is herein set forth.
7. The status of Defendant's present possession of subject real
estate is that of a trespasser.
8. The fair rental value of subject real estate is $800.00 per
month.
WHEREFORE, plaintiff demands judgment against Defendant:
1. In ejectment for possession of subject real estate, and,
2. For money damages in the amount of $800.00 times the number
of months Defendant continues to occupy subject real estate subsequent
to September 30, 1996.
