Plaintiff's Allegations of Anticipatory Repudiation and Material Breach
5. The prior paragraphs of this Complaint are incorporated by reference thereto.
6. On or about June 1996, plaintiff contacted defendant via telephone to inquire about
the status of the security deposit. Defendant failed to provide an accounting of the security and
when plaintiff demanded the return of the deposit, defendant refused.
7. Subsequent to defendant's refusal to pay, plaintiff filed a civil complaint III
Magesterial District 09-1-01.
8. A hearing was held on August 27, 1996 at which a default judgment was entered
against defendant.
9. Defendant filed an appeal to this court and a rule upon the plaintiff on October 8,
1996.
WHEREFORE, Plaintiff. Paul A. Plante, respectfully requests that this Honorable Court grant
the following rei ief:
(I) A judgment in favor of plaintiff for two hundred seventy nine and 50/100 ($279.50)
dollars plus costs and double damages in accordance with Title 68, Chapter 8, Article 5, *
250.512 of the Pennsylvania Code.
(2) pre and post-judgment interest at 6 % per annum;
(3) reasonable attorney's fees;
(4) any other or further relief that the court finds just and proper under the
circumstances.

ANSWER
1. Plaintiff, (hereinafter "Plaintiff"), is Paul A. Plante. an adult individual, sui juris,
who resides at 922 State Street, Apartment B, City of Lemoyne, County of Cumberland,
Commonwealth of Pennsylvania 17043.
2. Defendant, (hereinafter "Defendant"), is John Sopensky, and adult individual, sui
juris, with a mailing address of 30 East Maplewood Avenue, City of Mechanicsburg, County
of Cumberland, Commonwealth of Pennsylvania 17055.
3. Defendant does not recall any transaction with the Plaintiff on or about November
1995, and has no records thereof, and has never entered a leasehold with an individual by this
name.
4. Defendant owns no leasehold premises nor regularly conducts any business in
District 09-1-01.
5. Plaintiff has filed to submit any proof of sueh transaction.
WHEREFORE, Defendant, John Sopensky, respectfully requests that the court dismiss
the complaint.
