By order of Court of president Judge Harold E. Sheely
dated July 22, 1997, the full-time Master has been appointed in
the above referenced divorce proceedings.
The motion for appointment of Master indicated that
attorney Walters is representing the Defendant; however, Mr.
Walters has not entered his appearance and if he is, in fact,
going to be representing Mr. Leo, I request that he file a
praecipe entering his appearance of record.
I am unable to determine from the file as to whether
grounds for divorce are an issue. The complaint filed on
October 9, 1996, raised grounds for divorce of irretrievable
breakdown of the marriage. I assume, therefore, that the
parties will file affidavits of consent and that the divorce can
be concluded under section 3301(c) of the Domestic Relations
code.
The complaint also raised the economic issue of equitable
distribution. An amended complaint filed on July 21, 1997,
raised the additional economic claim of alimony.
In accordance with P.R.C.P. 1920.33(b) I am directing
each counsel to file a pre-trial statement on or before Friday,
August 29, 1997. Upon receipt of the pre-trial statements I

duration of the payments required herein, Participant shall not elect and is not permitted to elect, a lump
sum refund of Participant's contribution to the Plan, Participant shall bear the costs of the survivor

10, Upon Participant's retirement from this employment with the federal government, and
pursuant to the parties' Separation and Property Settlement Agreement dated August 29, 1997, the
United States Office of Personnel Management shall designate the sum of FIVE HUNDRED FORTY.
ONE AND 00/100 DOLLARS ($541.00) as the marital portion of Participant's monthly gross
retirement benefit to which Alternate Payee is entitled, This portion of Participant's monthly benefit is
due and owing to Alternate Payee and shall be so paid directly from the United States Office of
Personnel Management or its designated pay center or appropriate federal personnel payroll office to
Alternate Payee, This portion of the retirement benefit received by Alternate Payee is subject to all CDst
of living allowances or increases from the date the benefit is in pay status, through the duration of the
payments required herein, Payments to the Alternate Payee so designated, shall be so distributed
effective with the first annuity payment made following receipt and approval of this Order by the United
States Office of Personnel Management. The balance of the monthly gross retirement benefit is due to
Participant.

12, Payments of monthly benefits to Alternate Payee shall coincide with payments of benefits
to Participant and shall continue as long as Alternatc Payee is alive, If Alternate Payee dics before
Participant, the $541,00 per month designated in paragraph 10 is payable to Participant as part of his full
earned pcnsion benefit. If Participant dies befDre Altcrnatc Payee, and Participant has designated a
pDrtion of his benefit to another spouse and/or has a new spouse at the time of his death, that spouse
andlDr designated beneficiary shall receive all gross retircment benefits in excess of the $541,00 with
applicable cost of living allowances or increases designated in paragraph 10 as being paid to Alternate
Payec, If Alternate Payee and Participant both predecease another spouse and/or a new spouse of
Participant, then that spouse and/or designated beneficiary shall receive all gross retirement benefits
including the $541.00 designated in paragraph 10, Each party shall pay all federal, State and local taxes,
as applicable, from their distributive share of the Plan payments they receive, which amount will be
deducted from their respective share prior to distribution as required by law,
13, Participant shall have no right or authority to modify the distribution provided for herein
to the Alternate Payee,
14, The remarriage Df Alternate Payee shall not affect her receipt of payments or distribution
as herein described,
15, This Order docs not require thc Plan to providc any type or form of benefit, or option not
otherwisc provided under thc Plan; or requirc the payment of any bcnefits lor the Alternate Payee which

against that party requiring the servitudes of that Oflice, In the event both parties require services of the
United States Office of Personnel Management, such expenses shall be divided equally between them,

Management for approval as a Qualified Domestic Relations Order,
19, A copy of this Order shall be mailed promptly, return receipt requested, to the United
States Office of Personnel Management. If this Order has been predetermined by United States Office
