By order at Court ot president Judge Harold E. Sheely
dated Oeoember 9, 1996, the tUll-time Haster has been appointed
in the above reterenced divorce prooeedings.
A divorce complaint was filed on October 9, 19~6, raiBing
groundB tor divorce of irretrievable breakdown of the marriage.
I am unable to determine from the complaint whether or not there
is any issue with resp~ct to grcunds for divorce.
I am going to proceed, however, on the basis that grounds
tor divorce are not an issue and direct the filing of pre-trial
statements. The complaint raised the economic claims of
equitable distribution, ~limony, alimony pendente lite, and
oounsel fees and expenses.
In accordance with P,R.C.P. 1920,33(b) I am directing
eftch oounsel to file a pre-trial statement on or betore Friday,
January 10, H97, Upon receipt of the pre-trial statements I
will immediately schedule a pre-hearing conference with counsel
to discuss the issues and, if necessary, schedule a hearing.
It I am advised by counsel that the parties will not consent to
a divorce and that the partiQs have not been separated tor a
period in excess of two years, the directive to file pre-trial
statements will be considered withdrawn. At the time that

A problem hae ariaen regarding the above-referenced action.
I had previously issued a Notice to Produce to Sam Andes,
Es~ire, on July 25, 1997, thereafter I received his answers to
aaid Notice to Produce on October 14, 1997. Upon review of the
information, I determined that I needed to take Mr. Spat~'s
deposition, Accordingly, I promptly scheduled the deposition for
November 4, 1997. I was thereafter advised by Sam Andes' office
that this was not good a date and the deposition was resoheduled
for November 5th. I thereafter spoke with Sam Andea in court, on
another case, and he advised that he was also not available for
depoaition on November 5. At that timet I advised Sam that I
needed a good half day for the deposition of Mr. Spat2.
Since that time I have contacted Sam Andes' office to
reschedule the depoaition and have been advised that the only
available time for the deposition is approximately an hour and a
half on November 17, 1997, which is the day before the hearing
preaently scheduled before you. Sin~e I cannot take hiB
deposition and obtain a transcript, etc., to prepare for trial on
the next daYt I am requesting that the hearing be rescheduled
from November 16, 1997 to a mutually agreeable date and time for
all involved. If this reschedUling is acceptable to yourself, I
will schedule Mr. Spat2's deposition for November lB, since
certainly Mr. Andes would then have this day clear on his
calendar,

The parties were married on May 2B, 1993, and
separated on July 1, 1996. There iB no issue with respect to
the date of separation,
There are no children ot this marriage I however,
wife has two children of a prior marriage, namely, Jonathan,
born August 29, 19B3, and Jennifer, born February 16, 19B6.
currently husband is paying to wite as alimony
pendente lite the sum of $375.00 per month. Husband is also
maintaining health insurance for wife's benefit through his
employer,
Wife is 41 years of age and resides at 126 North
26th street, camp Hill, Pennsylvania, where she lives with her
two children from a prior marriage. She is a college graduate
with a degree from Juniata College in early childhood education.
She has taken some courses in a master's d~gree program at
Shippensburg University but is not currently involved in that
pursuit, Wife is not employed although has had some part-time
employment as a clerk in an interior decorator business, There

ossentially selt-employed although receives a compunBation
statement from IDS which does not include any deduction for
taxes or social security, When tho parties went into the
Bupport conference in Cumberland county husband's net monthly
income waD computed to be $1, '191. 00, Husband has 110t raised any
health issues which would affect hia ability to earn income.
The parties refinanced the property where wife was
living prior to the marriage at 126 North 26th street, Camp
Hill, Pennsylvania, As part of the refinancing arrangements,
that property was placed into joint namos and the parties
received $35,000,00 aB a result of the refinancing, Thero ia no
issue with respect to the characterization of the property as
mar.itall nevertheless, wite's counsel indicated that it is her
position that because the property was an asset which wife
contributed to the marital eBtate, that she should be given
consideration in the percentage ot distribution based on the
fact that the house was in her name before the marriage and then
subsequently titled in joint names after the marriage,
Husband had a home at 1228 Wood Road, Hummelstown,
Pennsylvania, which he sold on December 10, 1993, and received
approximately $60,000,00 in proceeds. Husband claims that the
monies were used to payoff debts and contributed to the
expenses related to the houBehold with his current wife and
children, He has indicated that he has no funds left from the
proceeds although attorney Saltzgiver has requested some
.
veritioation a. tu how the monies were expended. To date Ihe
ha. not reoeived any .pecitio .tatem.n~ or etat.mente showing
that the $60,000.00 was utlized toward tho ellpense. in the
present marriage. Mr. Andel uontends, however, that he did
provide listings of the how the monie~ were Ipent and attorney
Salt~giver, on the other hand, is aaying that she needs more
specitio data, In any event, attorney Salt~giver is going to
pursue her rights to disoovery and reque~t additional
intormation specifioally to Mr. Andes for production of
dooumentl.
There are no vehioles lubject to distribution in
this case although there il a question al to th~ status of a
19B6 BMW which husband traded in and received $3,000.00 as a
result of the trade in. There is a question as to whether or
not the $3,000.00 received as a trade in ahould be characterized
as a marital asset, Mr. Andes ia goil1g to inquir~ of his client
as to the status of that vehicle, whether marital or nonmarital.
HUsband has a Purchase Money Retirement Account
with IDS and attorney Andes has valued that account for marital
purposes at $2,000.00. Attorney Baltzgiver will l1eed to have
veritication of the history of that account inasmuch as
appnrently some funds from the sale of husband's home went into
that account and Were subsequently withdrawn, Husband claims
that the withdrawals were made to support the nceds of the
family during the marriage,
There are 110 specific lists for the household
tangible personal property which would be marital or nonmarital,
Counsel and the parties ore going to develop lists so we can try
to determine what property the parties may have acquired during
the marriage that would be in the household and who has
possession of the respective items of property. There is also a
question that Mr, Andes has raised regarding the return to
husband or certain items of nonmarital proper.ty which his client
claims remains in the household. Mr, Baird is going to provide
a list of that property as Well. If the parties cannot agree os
to a value for the marital household tangible personal property,
then that property will most likely have to be appraised.
Mr, Andes has listed numerous marital debts on his
pre-trial statement totalling approximately $17,000.00,
Attorney Saltzqiver. has asked for verification of those debts to
determine whether or not they are all properly characterized as
marital.
The Mastor has mentioned to counsel that there is a
conoern that he has in being able to effect a distribution

lived in that residence as husband and wite. said residence is

payment of approllimately $114,000 which were the proceeds from a

Baird, and her counsel Laurie A. saltzgiver, and the Defendant/
Jo.eph L. Baird, and hil oounsel Samuel L. Andes.
Tho aotion wes oommenoed wicn a divoroe oomplaint
bein9 filed on October 9/ 1996, raisin9 9rOund" for divoroe of
irretrievable broakdown of the marriage. Immediately tollowing
the atntement ot the a9reement on the reoord, the parties are
goin9 to si9n, affidavits ot oOllunt and waivers of notioe ot
intention to request entry of divoroe deoree whioh will be filed
by the Master's offioe. Therefore, the divoroe will be able to
be oonoluded under Seqtion 3~Ol(o) of the Domestio Relations
Code.
The eoonomio olaims raiaed in the oomplaint were
equitable distribution, slimony, alimony pendente lite, alld
oounsel fses and expenses.
Tho parties were married on Hey 28, 1993/ and
i.parated on July 1, 1996. There were no ohildren born ot the
marriage. However/ wife has two ohildren from a prior marriage,
Jonathan, born Auqult ~9, 1983, and Jennifer, born February 14,
19815 ,
The Malter haa been ~dvi.ed that after ne9otiationa
this morning, th~ partie. have reaohed an agreement with re.peot
to the outstanding economhl is/Jues, 'l'he agreement is 90ing to
be plaoed on the reoord in the presenoe of the parties. The
agreement as plaoed on the reoord will bo oonsidered the
substantive agreement of the parties not subjeot to any ohanges
or modifications exoept for oorrection of typographical errors
whioh may be made during the transcription,
Wu are going to return later this morning to have
the parties and oounsel review the draft for any typographioal
errors whioh we will oorrect, and then wo will lIak that they
affix their signatures by way of affirmation of the terme of
agreement as stated on the reoord here in the oonference room,
It is speoifically understood that after the parties leave this
room upon the statement of the agr.eement on the record, the~e
will be no changes that can be made to the agreement of a
substantive nature.
After the agreement has been roviewed for
typographical errors and affirmed by signatures of the partied
and counsel, the Master will prepare an crder vacating his
appointment and counsol will be able to prepare a praecipe
transmitting the r.eoord to the Court requesting a final decree

will do that promptly upon presentation ot a deed to be
preparod by wife's attorney.
2. Within 90 days of today'S date, wife will refinanoe the
mortgage owod to Affinity National Mortgage company so
that that debt is satisfied or that husband i9 otherwioo
unconditinal1y released from that debt, and shall pay
huoband the sum of $30,000.00.
In the event thut wife does not accomplish tho
retinanoing and make the payment to husband within 90
days of todav's date, the parties will promptly sell the
residence. Upon SUch sB1e, the mortgage owed to Affinity
National Mortgage Company will be paid and satiofied in
tu11, husband shall receive $30,000,00 and wife shall
receive and retain the balance of th~ proceeds of the
sale.
In the event that the parties cannot agree upon the sale
ot the property, if that becomes necessary, either party
may petition the Court to supervise the sale process,

The order for alimony pendente lite shall terminate
absolutely on 'l'uesday, March 31, 1990, Wife hereby
waives any further claim to alimony pendente lito,
alimony, or support from and atter the last day of March
1998, The parties will execute any documents necessary
to formally terminate that order.

Husband currently provides health insurance on wife and
her two children through his employer, Husband shall
continue that insurance on wife and both of her
children through the 31st of May 199B, After that date,
ho shall have no further obligation to provide that
insurance on wife or the children.
The parties hereby specifically waive any further claim
to the equitable distribution of marital assets, the
distribution or allocation of marital debts, all

lite, counsel fees or expl!nses, it being the intention of
both parties to accept the terms of this agreement in
