OIVIL ACTION - LAW
NO. 96-6609 CIVIL
BEaaIO RICARDO POHA,
Defendant
IN REI PRETRIAL CONFERENCE
A pretrial conterenoe wa* held be for. the Honorable
aeorge E. Hoffer, PreBident JUdge, on Wednesday, August 26,
1998.
In this auto accident oase, Miohael E. Kosik, Esquire,
represents the plaintiff, and James a. Nealon, III, Esquire,
represents the defendant.
Plaintiff was traveling south cn Route 74 and
defendant was driving northl plaintiff olaims defendant's oar
came over the oentftr line into plaintiff'S line of travel and
negligently struok him. Defendant admits liability, and the
sole jury question is the extent of plaintifr.'~ damages, and, of
oou~se, the question of substantial factor as to oausation. The
injuries appear to the Court to be all of a Boft tissue variety,
and plaintiff claims various work lOBS items. Counsel relate to
the Court that they oan sit down and agree on the work loss
amount to be presented to the jury as an exhibit olaim.
Obviously, the extent of any injuries alleged by the plaintiff
POINT FOR ~H~Ram NO~ 2
In civil oases such as this one, the Plaintiet ha. the burden
of proving those contentions which entitle him/her to relief,
When a party has the burden of proof on a particular iSBUe,
h.ia contention on that iSSUft IIlUst ba established by IJ fair
preponderance of the evidenoe,
The evidence establishes a
Clontention by a fair preponderance of the evldenoe .if YOll are
persuaded that .it is more probably accurate and true than not.
'1'0 put it anothe): way, thinlt, if you will. of an ordinary
balance scale, with a pan on each side.
Onto one side of the
scale, place all of the evidence favorable to the Plaintiff, onto
the other, place all of the evidence favorable to the Defendant,
If, after considerlng the comparable weight of the evidence, you
feel that tho scales tip, ever so sliHhtly or to the slighte~t
degree, in favor of the Pla..tntif f, your verdict must be for the
Plaintiff,
If the scales tip in favor of the Defendant, or are
equally balanced, your verdict must be for the Defendant.
In this case, the Plaintiff has the burden of proving the
followin'lJ propositions I that the Defendant was negligent, and that
that l1Il!gligence was a flubstantial factor in bringing about the
accident.
If, after considering a 11 of the evidence, you feel
persuaded that these propositions are more probably true than not
true, your verdict must be for the Plaint iff,
verdict should be for the Defendant.
