Today is Wednellday, Augullt 25, 1999.
Thi. i. the date that we set for a oonference with ooun..l and
the parties to attempt to resolve the Qutstandinq economio
olaims in the above refer~noed divoroe prooeedings.
Present are the Plaintiff, Traoey R. Asper, and her
oounsel Matthew--tT.- E..h..lllll1l1, "rid the Defendant, steven L. Asper,
and his or,lunsel Rebecca R. Hughes.
This action was commenced by the filing of a
divoroe complaint on October 11, 1996, raising grounds for
divoroe of irretrievable breakdown of the marriage. The divorco
oomplaint was served on October 16, 1996, by certified mail
restricted delivery. Mr. Eshelman has p~eBented a return
receipt card and he can prepare and file an affidavit of servioe
to complete the record.
Counsel have provided the Master with affidavits of
consent and waivers of notioe of intention to request entry of
divorce decree signed by both parties which will be filed by the
Master's office. The affidavits and waivers are dated August
26, 1999.
The complaint also raised the economic claims of
equitable di.trib~tion, alimony, alimony pendent. lite, and
aoun.el tee. and CO.tll.
The partie. wore marr iIld 01'1 July 9, 197fl, and
.eparated AU9ust 23, 1996. They are the natural parents of two
children, Alee.ha who is now emanoipllted, Ilnd BrYl5n who i. a
minor livil,g with the Oefondant.
After negotiations thirl morning, the Master has
been advillCld thot the partiee and oounsel have reaohed an
agreement with respeot to the outstanding Buonomio olaimll. The
agreement is going to be plaoed on the reoord in the presenoe of
the partiea. Tit.. ..\jr....m..nt. "It plao..d on tho reoord wi 1), be
oonsidered the substantive agreement of the partie. not subject
to any ohanges or modifioations exoept for correotion of
typographioal errors which may be made during the transoription.
Later this morning the partiDs and oounsel are going to return
to the Master's offioe to review the draft of the agreement for
typographioal errors, they will make oorrections as neoessary,
and then affill their signatures by way of affirmation of the
terms of the agreement whioh is being plaoed on the record at
this time.
FOllowing reoeipt by the Ml5ster of the signed
agreement, the Master will prepare an order vacating his
appointment and counsel can then file a praecipe transmittinIJ
the reoord to the Court requesting that the Court enter a final
decree in divorce. Mr. Eshelman.

waivers. The Plaintiff has agreed to tinali~e the
divoroe and ageumo the ooete tor the same.

alimony pendente lite, fees and costs, and waive any

to Bgrlleing to permit thia withdrawal. The Plaintiff
will perform such withdrawals by praecipe to tho Court.
The part ills Qxpressly agree that tho agreement as set
forth would constitute the fAir and equitable
distribution of the economio claims anCillary to the
divorce. All property which is currontly in the
possession of a pl1rticulllr spouse or which has been
transferred to a third party by that specific apoUse

spouse in accordance with the crLteria Bet forth in
Section 3501 of the lJivorce Codo.
4. The Plaintiff wife specifically wAives any claim for a
rental credit or any claim versus any potential interest
in a business known as Chesapeake Mmdical Systems.

15. The Defendant husbnnd opecifJcnlly waivrHI lIny
claims to the retirement pursuant to the following
paragraph.
Recogni~ing that the Office of Personnel Management
(OPM) encourages courts to utilize model language in
drafting court orders which affect a federal employee or
annuitant's benefits under the civil service Retirement
System (CSRS), Federal Employees' Retirement System
(FEHS), Thrift Savings Plan, ('1'SP), Federal Employees'
Health Benefits (FEUB) program, or Federal Employees'
Group Life Insurance (FEGLI) coverage I and it appearing
that OPM haA promulgated only language designed to effect
such benefits; the parties expressly stipulate that there
shall be no award, assignment, apportionment, or division
of Plaintiff's CSRS, FERS, TSP, FEUB, or FEGLI benefits
as a result of divorce, legal separation, or annulment of
the partie~. OPM shall not pay Defendant under any

by the entireties to the ownership of husband as an

refinancing of the loan and mortgages as set forth

The parties agree upon request of husband to execute a
memorandum of said transaction to be recorded with the
York county Recorder of Deeds. The escrow agent shall

subsequent to the refinancing of the two mortgages and

title to the 1989 Chevrolet conversion van from husband
and wife to husband. It is expected that this transfer

As proviously noted, husband is reoeiving
child support from wife for the two children. There is no
support order in effect being paid by husband for spousal
lIupport. Huoband has not raisod any health issues. Ho is
covered under wife's medical insurance through her
employment, upon the entry of a divorce decree the co~ts to
husband for oontinuing medical insurance coverage tor
himselt will be ~150.00 per munth.
The parties own real estate at 10G5 Zeigler
Road, Wellsvllle, l'ennsylvBnia. Counllel have stl.pulated
that the valUe of the pr.operty is $9B,OOO.00. There is a
tirst mortgage with a payoff of around $B3,300.00, and a
second mortgBge with a payoff of around $5,700.00. The
seoond mortgage as 110ted is being paid by wife in the amount
ot $130.00 per month.
currently the 199B real estate taxes are
unpaid. Husband is going to attempt to refinance the
mortgages on the property in order to remove wife's name all
an obligor on the debt. The property is also in need ot
some repairs, including a roof, a termite infestation, and a
leaking sewer pipe. Counsol ar.e going to ask the parties to
get estimates of tho costs to make the necessary repairs to
the premises which will be used in determining the net
equity in the property.
Wife is Blso claiming a rental credit of
$2,400.00 since September 199B. This credit is based on the
house having a rental value of $1,200.00 per month. We will
need Bome expert testimony to subatantiate that rental value
olaim because counslll for husband disagrees that the
property in its ourrent condition could rent for $1,200.00
monthly.
Husband has a 1984 Dodge Caravan Which he
claims is inQperable and has h~d to be junked, Which means
that aooording to husband the vehiole has nu Value tor
purpo.ell ot distribution. wire has a 1989 Ch~vrolet
Clonverslon van, which both parties a9roo lias a value or
$3,000.00. Noithor vehiole ia aubjoct to any liens. As a
rellult or husband having to "junk" tho Caravan, he had to
inoul' tho costs of purchasin'1 another vohicle. Wife claims
that the van doos not worl< although the porties have agreed
that it has a $3,000.00 value.
The parties own two boats which are referred
to as a "big boat" and a "1 ittle boat". 'rho parties have
lIubstantial disagreement liS to the value or. these boats
beo~use there is sarno iBsue regarding whnt Was inoluded in
the valuation. Husband currently has Includli1d the boat and
motors and Borne large equipment/ wife claims that there Is a
lot or other equipmont which shOUld be included in tile
valuation. In any event, we wJ.ll need to have tllstimony by
ellperts after IIppraJ.sals of the boats and equipment In order
to determine tho value of tho boats,
The partios agreo that the diamond blnck
horse trailer has n value of $2,200.00, and at separation
the troller wan in wife'a pOl3session. She Bold the trailer
but did not receive for the trailer a market value/
therefore we will use the value of the trailer that: both
part;ios agree to at $2,200.00.
The parties have three horses. Wife claims
that the three horses are worth $1,450.00/ husband claims
that one of the horses has no value, lind, therefore, he has
appraised two horses at $1,000.00.
With respect to the household tangible
personal property, wife is willing to agree that the
property can be considered evellly distributed if she
reoeives the it~ms which she has put on a list which she has
set forth in her pretrial statemellt. If she gets those
items then she is willing to agree that the parties have
nearly equal value in the personalty. If there is any
dispute as to the items and husband will not agree to
provide wife the items on the list, then the parties will
have to have the property appraised.
Wife has a pension with the federal
government through her employment and Attorney Hughes is
going to have that pensJ.on valued. Wife is directed to
provide husband's counsel with the necessary i.nformation
about the pension in order for Pension Appraisals to do the

valu~tion. Wife also ha. a TSP plan with a valUe of around
$4150.00.

Husband does not have any p~n.ion with hi.
There ill a queetion about whether or not
hUll band has any intereet in the bUBinesl known as Chesapeake
Medical. Husband olaims that he ill eimply an emPlOyee{ wite
on the other hand assertll that he ill a partner. We wi 1
take testimony on that issue at the same time we take
telltimony on the factor of marital misoonduct at a separate
hearing.
The marital debt consiuts of tho two
mortgages and an unsoeurllld 10al1 wh ieh husband is pay ing.
The wife as noted is paying the second mortgllgel husband is
paying the first mortgage which is IIround ~702.00 monthly,
whioh does not inolude talles and inSllrllnrJe. Ilushllnd is Illso
paying the unsecured loan which runs around $200.00 per
month.
Thero is also an issue about a loan to wife'lI
parentll with II curront balanco of around $5,000.00. We need
to have some records showing the basis for that loan.
There is a question as to whether or not payments have been
made on this alleged loan by the parties. If payments were
made on a ~eguLar basis, that information certainly would
help substantiate the fact that there is an obligation to
wife's parents.
In addition to the mortgages, the unsecured
loan, and the issue regarding the loan to wife's parents
there were some credit ca~d loans which have been paid by
wife totaling around $1,200.00 to $1,300.00.
Husband as previously noted is going to
attempt to refinance the marital residence I husband is alllo
going to have wife's pension appraisedl and the parties will
accomplish the other appraisals as needed in order to place
a value on the assets. currently wife is Claiming that
husband shOUld pay to her between oight to thirteen thoulland
dollarsl husband does not believe there is any basis for any
payment to wife. After the appraisals have been completed
and the valuations obtained regarding the pension, wo will
then be able to determine if there is any basis for any
payment from husband to wife.
Wife also asserts her claim for alimony. She

2. Tho Defendant, STEVEN L. ASPER, is an adult individual
who ourrently reaidell at 1065 Zeigler Road, Welhville, York
County, Pennaylvania 17365.
3. A Complaint in Divoroe, including a oount for the
equitable diatribution of marital property, waa filed before this
Court in the above-captioned matter on Ootober 11, 1996.
4. A Petition for Speoial Relief waa filed by the Defendant
on November 14, 1996, requeuting that Ma. Aeper tranBfer marital
property. in the form of a 1989 Chevrolet, to the Defendant for
liquidation 130 that he might pay hiu billa. See the Petition for

6. The partie. enter"d into a stipulation whioh pro~ided in

7. On or about February 9, 1997, the DefendAnt unilaterAlly
removed tho above-mentioned 1989 Chevrolet from the poslleosion of
MI. Alper and hal refuled to return the vehiole.
8. The 1989 Chevrolet walS MI. Alper's only transportation to
work three daye per week, from Bhippenlburg to New Cumberland.
9. The Defendant hae recently purohalled a new van, and doee
not require the 1989 Chevrolet for hill own traneportation.
10. The Defondant unilaterally deoided that MIS. Alper should
drive a company van, titled solely in the Defendant'e nAme, whioh
both partiee have desoribed ae An unreliable "piece of junk."
11. On Friday, February 14, 1997, MI. Asper was forced to ueo
the oompany van to get to work. True to form, the vehicle broke

THE MASTERI Today is Wednesday, AUgUllt 2~, 1999.
Thil ~s the date that we set for a oonferenoe with oounsel end
the parties to attempt to resolve the outstandinq eoonomio
claimll in tho above referenoed divoroe prooeedingll.
Present are the Plaintiff, Traoey R. Asper, and her
counsel Matthew J. Eshelman, and the Oefendant, steven ~. Asper,
and his counsel Rebeooa R. HUghes,
This aotion was oommenoed by the filing of B
divoroe complaint on October 11, 1996, raising grounds for
divoroe of irretrievable breakdown of the marriage. The divoroe
complaint was served on Ootober 16, 1996, by certified mail
restrioted delivery. Mr. Eshelman has presented a return
receipt card and he con prepare and file an affidavit of service
to complete the reoord.
Counsel have provided the Master with affidavits of
consent and waivers of notice of intention to requeat entry of
divoroe decree signed by both parties which will be filed by the
Master's Office. The affid~vits and waivers arQ dated August
25, 1999.
The complaint also raiaed the economic claims of
equitabl. distribution, alimony, alimony pendante lite, and
aoun..l re.s and coat..
The partie, were married on July 9, 1976, and
.eparated Augu't 23, 1996. They are the natural parents or two
ohildren, Alee.ha who i. now emanoLpated, and Bryan who i. a
minor living with the Defondant.
After negotiations this morning, the Master has
b..n advised that the parties and counsel have reached an
agreement with respeot to the outstanding eoonomio claims. The
agreement is going to be plaoed on the record in the presence of
the parties. Tlreagreemene-as placed on the reoord will be
considered the substantive agt'eement of the parties not subjeot
to any changes or modifications eKoept for oorreotion of
typographioal errors whioh may be made during the transcription.
Later this morning the parties and counsel are going to return
to the Master's offioe to review the draft of the agreement for
typoqraphical errors, they will make oorrections as neoesoary,
and then affiK their siqnatures by way of affirmation of the
terms of the agreement whioh is being placed on the reoord at
this time.
Following t'eceipt by the Master of the signed
aqreement, the Master will prepare an order vacating his
appointment and counsel can then file a praecipe transmitting
the record to the Court requestinq that the Court enter a rinal
decree in divorce. Mr. Eshelman.

that they have SKeouted affidavit. of oonlent and
waivers. ~he Plaintiff has agreed to finaliEe the
divoroe and assumo the ooats for the same.
The Plaintiff will withdrow oKisting oounts for alimony,
alimony pendente lite, fees and oosts, and waive any
rights to olaim tho ssmo. The Dofendant has stipulated
to l\greeing to permit this withdrawal. 'rhe Plaintiff
will perform suoh withdruwals by praeoipe to the Court.

shall be no award, assignment, apportionment, or division
of Plaintiff's CSRS, FERS, TSP, rEHB, or FEGLI benefits
as a result of divorce, legal separation, or annulment of
the parties. OPM shall not poy Defendant under any
method for computing a former spouse's benefits or
survivor's annuity from any of wife's federal employment
benefits, whether or not Plaintiff leaves federal service

The part iDs shall DKecutD 8 deed tranSferring the title
to the marital residence from their ownership as tenants
by the entireties to the ownership of husband as an
individual, This deed shall be placed into escrow with
the LaW Offices of Patrick F. Lauer pending the
refinancing of the loan ond mortgages as set forth
above.
The parties agree upon request of husband to execute a
memorandum of said transaction to be recorded with the
York County Recorder of Deeds. The escrow agent shall
deliver the deed to husband immediately upon demand
subsequent to the refinoncing of the two mortgages and
loan or payoff of the same.
ll. The parties shall cooperate in effecting the transfer of
title to the 1989 Chevrolet conversion van from husband
and wife to husband. It is eKpected that this transfer
shall take effect within two to three weeks from the date
of this stipulation. Wife agreea that the van shall be
in proper running condition for husband to pick up the
vehicle. HUlband may pick up the vehicle at anY time
after title to the v~~iole hal been tran.terred.

of the 1989 chevrolet oonversion van that the title,
reqi.tration, and similar documentation effecting the
transfer of the property, ohall take plnce on or before
Friday, September 10, 1999, permitting the partiee to
remove the vehiole from its current location on or about
Saturday September 11, 1999.
12. The parties further agree to give at least 24 hours
notice from wife to husband prior to wife ooming by the
marital residenoe to piok up the pernonal property whioh
is listed on Exhibit A whioh is attaohed hereto and made
a part hereOf.

13. EKoept ae heroin otherwise provided, each party may
dispose of his or hQr property in any way and each party
hereby waives and relinquishes any and 011 rights he or

property or the estate of the other as a result of the
marital relationship inclUding without limitation,
statutory allowance, widow's allowance, right of
intestacy, right to taka ogainst the will of the other,
and right to act as administrator or executor in the
other's estate. Each will at the request of the other
