County Pri~on, Carlisle, Pa. serving a sentence of no leslS than 11~
months, nor more, than 23 months on a misdemeanor charglil of theft by
unlawful taking.
2.) The Defendants in the instant case are Ronald E. Klair
District Justice for the Magesterlal Pis~rict 09-3-5, Mechanlcsburg,
PB./ and/ Patrolman William Menes of the Borough of ~Iechaniollburg,
Police Dapllrtment.
3.) Venue Is predicated in the instant case pursuant to the
statutory Provisions implicit j n Pa. Rules 0 f Ci vll Proc. (Rule 1092)

After hir; committment to Cumberland County prison on the slime day (evening)
of December 29, 1995 on the Charges related to the domestic inllident at
(9) Old Willow Mill Park Rd, No further criminal procells Woe issued, until
about (3) w~!lks' later. On or about January 20th, 1996 the plaintiff recieved
a Non-'l'raffic citation of a Summary Nature charging the petitioner/ plaintiff
I-lith" Defiant 'l'rellpllr;s" Docketed at No.H N'1'-0:;(10013-96, Citation No. 286207.
Tbe respondant Defendants "knew" that the plaintiff was incarcarated in the
cumberlal1d County Prison.
On or about February 24, 1996 the plaintiff "r;igned" the "Mnil~in Portion"
of the oitation, tendering a plea of Not Guilty. Since the ~Iail~in Portion
war; not timely returned by the plaintiff/defendant. Apparently District
Justice Klair arbitrarily "adjudicated" th. plaintiff" guilty" by Default,
Additionaly, the plaintiff was abjeotly impoverir;hed and could n9t have
posaibly posted the fines and costs aggr;egat.ed at $375.50 all collateral
for any trial.

Crimination in contravnetion to the equal protection clause of the

The fact that the plaintiff was indigent and the defendant's knew where
he wall for purposes of appearance, r:lhould have militiated againr:ll:
the r.equirement for poati'ng Collateral.
5.) The Defendantsl Respondentll are in manifest violation of the
6th and 14th amendment right to a speedy trial or dispollition as well
as Pa. RUles ol! Crim, Pt'oc. (84) and the unecessary delay rule.
