1, The Plaintiff is Farmere and Merohanta Trust company of
Chllmbenburg, which has ita principal place of buaineal!l at P.O. 80x
"T>>, Chambersburg, Pennaylvania, 17201-0819.
2. The Defendant ia Scott E. Hoover, iltdividual whose last
known address il9 30 Foreman Mill Road, Shippenaburg, PA 17257.
3. On or about March 21, 1994, Oefendant executed an
Adjuetable Rate Note in favor of Plaintiff in the original
principal amount of $48,000,00, being the l!Iame Adjustable Rate Note
amended, reatated and consolidated by a certain Nnended, ReBtated
and Consolidated promiseory Note executed by the Defendant on or
about September 6, 1995 (said Adjustable Rate Note and said
Amended,
Restated and Consolidated Not"! are hereinafter
collectively referred to as "Note") .
A true and correct copy of
said Adjustable Rate Note is marked aa Exhibit >>A-1", attached
hereto and nlade a part hereof. A true and correct copy of said
Amended, Reatated and Consolidated Note is marked aa Exhibit IA-2",

in the Offioe of the I~ecorder. of Deed", of cumberl.and county on
Maroh 25/ 1996, in Mortgage Book Volume 1202, Page 1143 ("Original
Mortgage"), a", moMfied by IJ certain Modification of Mortgage
("Modificat ion") dated September B / 1996 and ncorded in thlll Of fice
of the Reoot'der of Deeds of cumberland County September 25, 1995,
in Mortgage Book Volume 504, Page 814 (the Original Mort-gage and
the Modifioation are herE/inafter colleotively referred to as
"Mortgage"). A true and correct copy of said or.iginal Mortgage
containing a description of the premise", subject to said Mortgage
is marked as Exhibit "B-1", attached hereto and made a part hereof.

6. Oefendant is the record and real owner of the aforesaid
mortgaged premisea.
6, Defendant is in default under the terms of the
aforesaid Mortgage and Note for, inter alia, failure to pay the
monthly installmenta of principal and interest when due. Defendant
is due for the May 1, 1996 payment.
7. On or about June 27, 1996, Defendant waS mailed Notice
of Homeowner's Emergency Mortgage Assistance Act of 1983, in
compliance with the Homeowner's Emergency Mortgage Assistanc;e Act,
Act 91 of 1983. A true and correct copy of said Notice is marked
