A divorce complaillt was filed on October 15, 1996,
raising g~oundB for divorce of irretrievable breakdown of the
marriage and the economic claims of equitable distribution,
alimony, alimony pliIndlilnto lite, and counsol fees and costs, On
MlIrch ll., 1997, an amended cl)mplail1t was filuJ ".1"III(J tho
additional grounds for divorc. of adultery and desortion.
Counsel have advised that the partiel1 will Bign and tile
affidavits of consent under Section JJ01(c) of tho Domestic
Relations Code. With respect to the claim for alimony and the
factor of marital misconduct, attorney llottman is going to
prepare a stipulation to presont to attorney Jacobson regarding
an alleged extra marital relationship which huaband engaged in
while the parties were still married and living together. If
the parties can come to an understanding of the general facta
regarding husband's extra marital relationship we will then
defer any specific testimony on that factor. Counsel are to let
the Master know at least two weeks prior to the hear ing if the
stipulation has not been entered into and if in the alternative
we are going to need testimony on marital misconduct. Also, if
test imony is necessary, counse I are requ i red to pro v ide each
other a list of witnesses at least two weeks prior to the
hear ing on that factor,
'rhe parties were married on Od:ober 10, 19B1, and
separatad on April 14, 1996. They are the natural parents of
two ohildren, Robert G., born June B, 19B5, and Kathleen L.,
born May 20, 19BB. Both children reside with the mother.
Husband is currently paying, pursuant to an order
of court entered by .Tudge Oler on November 15, 1996, the sum of
$1/600,00 per month directly to the two mortgage holders on tho
marital residence. The payment which husband is making is for
spousal Ilnd child support and there is no allocation indicating

the portion ot the payment tor wite and the portion tor the two
ohild....n.
Wite is 30 years of age and resides at 023 Anthony
Drive, Heohaniosburg, PennBylvania, with the two ohildren. She
hae an assooiates degree and is employed at capitol Blue Cross
a. a major medical olaims examiner. she has a gross biweekly
inoome of around ~441.00 with a net of around $34H.OO. she
works fleK time Which means that occftsionally her income will
vary trom that Btated on the income statement filed herein.
Wite has not raised any health issues. We believe after
disoussion with counsel that sho is eligible fo~ medicnl
insurance benefits through her employment which are paid by the
employer. If that is not the Cllse then oounsel should provide
at the hearing the coot of medical insurance benefits that wife
will have to incur arising out of the divorce.
Husband is 44 years of ago and resides at 252
Lawrence Prive, lIarrisburq, l)ennsylv~nia, with a female friend.
The temftl~ friend owns tho property where husband is residing
and husband sharos eKpenaos. Husband has a bachelor's degroe
and was employed by NAVICI' as a suporv isor, lie 16 now retired
and ourrently working as e substitute toacher for the Central
Dauphin Bchool District and 1IS a conch for girls basketball. lie
is attempting to obtain a full-time position with the district
or another district as a teacher. currently, his monthly incoml!!
from the substitute teaching and coaching positions is around
~400.00. He is anticipating receiving from his retirement gross
eaoh month $1,900.00 and a net sum of $1,273.00. lIusband has
not raised any health issues.
counsel are requested to provide copies of the
parties' 1996 income tax returns at the hearing.
The r~al estate at 023 Anthony Drive,
Meohanicsburg, Pennsylvania, has been ostimated to be worth
$200,000.00 as stated on both pre-trial statements of the
parties, The property is subject to a first mortgage in favor
of Blue Ball National Bank of around $140,700.00 and a second
mortgago in favor of Fulton Bank which is a home equity loan in
the amount of $10,000.00. We have discussed the possibility
that perhaps the real estate ought to be listed for sale and
sold so that the costs of sa le can be shared by the parties.
otherwise if the real omtate is awarded to wif~ as part of her
equitable distribution she will most likely not receive any
oredit tor any cost of sale or taK consequences arising out of a
sale.
The parties owned two vehioles, a 1992 Ford
"ero.tal:' and 1994 ClEO 'l'ncker. ItUllband hili the Tl:'IIClker and wife
ha. the Aero~tllr. 80th oounsel have plaoed a value on the
vehiole. .imilarly, the Aerostar having a value of $10,~~O.oo
and th. GEO Tracker a value of $11,3~~.00. Those valuo.,
howev.r, are gro.. values and do not tako into account the debt
on the vehiclea. The debt on tho Aorostar is around $4,773.00
and on the GEO 'I'rackoT.' $6,250,00. In any event counsol l\re
requested to provide at tho hearing a not value tor each of tho
vehiclos which valuo will be used in the computation for
purposos at equLtable distribution.
Thero is alao a camper in wife's possession which
the parties have valued at around $5/000.00. Ther~ is a lion
against the titlo in favor of the Uank of Itanover and tho
current bslanco on that lien is around $1/100.00. Likewiso,
counsel shOUld attempt to agree to the net value of that camper
for purposes of the oquitablo distribution computation.
Husband, whon ho retired, was veated in II pension
---W-it:h the f.edsral civll service lInd counael at'.. IIU<>mpl'!I'g to
work out a Qualified Domestic Relations order with respect to
dilltributinq that pension. Issuos involve tho survivor betIC/fits
and deductions whLch may be made which would benefit the
parties, such as medical insurance. There is alao a question
about a sum of money ($25/000.00 Which was netted to be
$16,800.00) which husband receiv~d following his retirement.
The question is whether or not that money should be considered a
marital asset or a nonmarital aBset since it was received
following the separation. Mr. Jacobson indLcated he is going to
try to provide aome case law on his poaition although the Master
has indicated that he may consider that money a marital asset.
Itusband ia also the ownor of a Membera First IRA
with a value of around $14,037.00. That IRA value should be
updated to the date of the hearing and that IRA will be most
likely distributed to husband in the equit3ble distribution
IIcheme.

With respect to the household tangible personal
property, oounsel have advised that the property is currently
all in the possession of wife. We do not have a value for the
property and will need to have the property appraised so that
the value can be included in the computation for equitable
distribution. Husband can also provide any list that he would

The parties were involved in a business known as

4. With regard to the penllian of husband, the parties have
reooived a pension evaluation from lIarry Leister and have
Iccllpted that ao the appropriate valuation, Wife shall
receive 50' of the marital portion of husband's pension
and shall include spousal sur.vivor benefits. All costs
cf living adjustments mode by the government sholl
inure to the benefits of both parties with their
respective shares. Husband's attorney sholl draft a
Qualified Domestic Rolutiona order to be submitted to the
pension office.
The 50% portion is computed on the gross number as stated
by Mr. Lelster as the marital portion of the pension,
5. Additionally, husband has received a net early retirement
bonus. With those proceeds, it is husband'S
responsibility to payoff the joint credit card accounts,
the VisB and the Members 1st. Those shall be husband's
responsibilities,
6, With regard to tax deductions which the parties have,

available for the parties' two minor children, wife shall
compute her taxes based on utilization of both deductions

have the option of purchasing the right to use those
