COMPLAINT
AND NOW, this 10 day of April 1997 comes Mccuen and
Associates, above-named plaintiff, by and through its attorney,
Richard E. Guida, Esquire, and respectfully avers the following:
1. The plaintiff is MCCuen and Associate., located at
205 GrandviewAvenue, Suite 211, Camp Hill, Pennsylvania 17011.
2. The defendants are Nancy and David Stouffer, husband
and wife, residing at 231 Reeser Road, Camp Hill, Pennsylvania
17011.
3. During January 1993, the defendant Nancy Stouffer
obtained services from the plaintiff. Specifically, the plaintiff
perfo~ phylical therapy to treat the defendant Nancy
Stouffer'. adhesive cap.uliti. of the .houlder. S.. Exhibit A
attached.
4. The bill for the.e services was $513,00. S..

5. The defendants have failed to pay the plaintiff for
the.e .ervice..

Complaint", On November 22. 1996. PlaintitT tiled an Answer to the defendant's Preliminary
Objections, On January 21. 1997, PlaintitTforwarded to Defendant's a Praecipe For Listing Case
For Argument. On February 18, 1997, PlaintitT filed "The Plaintift's Brief For The Plaintift's
Answer To Defendants' Preliminary Objections". On March II. 1997 the "Original Complaint"
was heard upon the Briefs submitted to your Honorable Court by both the Defendant's and the
Plaintift's. On March 24. 1997. the Court GRANTED the Defendant's relief and DISMISSED
Plaintift's Complaint for "lack of specificity", and also atTorded PlaintitTtwenty (20) days to tile
an "Amended Complaint", this Order Of Court, hereinafter referred to as "Exhibit One", On
April 14, 1997, Defendant's received an additional third Complaint.

DEFENDANT'S PRELlMINARV OBJECTIONS IN RESPONSE TO PLAINTIFF'S
THIRD COMPLAINT
I. Plaintift's were ordered by Your Honorable Court. in compliance with PI. R,C,P, 1028
(d), (" Exhibit One"), to file an "Amended Comnlaint" in twenty (20) days or Plaintift's
Complaint would be dismissed"
2. Plaintiff failed to file an "Amended COIl\plaint"
3. On April 14, 1997, Defendant's received I third Complaint. hereinafter refemd to as
"E.Ulibit Two"

back to January of 1993,
8. Defendant discarded all records at the end of January 1996 according to Federal Tax
law Requirements For Record Keeping, hereinafter referred to as "Exhibit Three",
9, Plaintiff did not file the original Complaint directed to the aforementioned Defendant's
until July 26, 1996; as noted on the face of District Justice Farner's "Notice Of
Judgementffranscript", hereinafter referred to as "Exhibit Four".
10. Defendant, in the absence of the aforementioned records, denies Plaintiff's avennent
as described by Plaintiff in paragraph three (3) of Plaintiff's third Complaint.
II. In paragraph four of Plaintiff's third Complaint, Plaintiff sites foundational proof of
services and costs thereof by reference to a "bill" marked as "Exhibit A", Defendant's "Exhibit
Two", page four (4).
12. Plaintiff's "Exhibit A", ( see "Exhibit Two", page four (4)), is not a bill as represented
by the Plaintiff in Plaintiff's third Complaint. paragraph 4
13. Plaintiff's "Exhibit A", (see Exhibit Two", page four (4)), is in fact a Statement of
Account, not a bill, nor an invoice.
14. "Exhibit Two", page four (4), establishes no material facts that would suppoft such
services were rendered.
IS. "Exhibit Two", page four (4) does not establish Plaintiffever advised Defendant's of
the existence of this "Statement of Account" prior to any of these multiple Complaint's filed
before the Court by the Plaintiff

21, Plaintiff. in the issuance and construction of Plaintiffs third Complaint, failed to
comply with Pa. R.C.P. 1023 (a), Pa. R.C.P. 1025, Pa. R.C.P. 1024 (a), (b), (c). (see "Exhibit
Two", Pages two (2) and three (3)), by not only the failure to include appropriate certificates,
by additionally failing to endorse the "Verification", (see "Exhibit Two", page three (3) ).
22. Plaintiff. in the issuance, construction and Manner of Service of Plaintiffs third
Complaint, failed to comply with Pa. R.C.P. 401 (c), by failing to endorse, nor include a
"Cenilicate of Service",
23. Plaintiff illustrates the Complaint was filed on April 10. 1997, Verilication of
Counsel's Administrative Assistance declares April 8, 1997, and the Plaintiffs postmarked
envelope represents a meter date of April II, 1997.
24. Defendant receiving Plaintiffs third Complaint on April 14, 1997, assume senice
was effected either April II, or 12, 1997, only reinforcing the need for all parties to follow Pa.

summary form must contain the specific elements of materiality, specifically what, specifically
where, specifically when. specifically how, as outlined in the aforementioned Defendant's
Preliminary Objections To Plaintiffs Third Complaint.

Court and the Defendant's by referring to the Plaintifl's "Exhibit A" as a "bill" (see Exhibit Two,
pages two (2) and four (4)), when in fact there are no olTer(s) of writing of any "bill", and
this flagrant and intentional misuse of Judicial Licensing has caused these Defendant's undue
hardship. If there were/are olTer(s) of writing(s) as described in Plaintil1's third Complaint, they
have never been attached to any of Plaintil1's prior Complaints, or any other prior Pleading
before the Courts, nor were they ever presented to the Defendant's. no reason(s) for the
absence thereof. set forth substantially in writing, not at any time, in any form.
In Plaintil1's third Complaint, PlaintilT does not site any particular Pa. R.C.P. that the
Plaintil1's third Complaint was governed by, or in compliance with, because demonstratively the
PlaintilT has shown the Defendant's and this Court. that the Plaintil1's have their own set of rules
Unjustly, these Defendant's before the Court in the abovementioned action, are placed in an
impossible and inequitable position The Defendant's, pro se Defedant's, can only be governed in

2. In the aforementioned Complaint, Plaintiff/Appellant alleged and erroneously named
Nancy and David Stouffer as the Defendant's in the aforementioned action, denied by Defendant's
and;
3. In the aforementioned Complaint before District Justice Farner, Plaintit17Appellant
erroneously alleged that these same Defendant's had received services during the month of
January, 1993, denied by Defendant's, and;
4. On July 26, 1996, two and one half years following the aforementioned alleged
services, Plaintit17 Appellant stated in the body of their Complaint that Defendant's incurred a debt
ofSS 13.00, Defendant's deny, and,
S On July 26, 1996 the Plaintiffs! Appellant's Complaint gave an insufficient and
erroneous description of the Defendant's alleged senices, and,

service illustrated in the aforementioned paragraphs 8, 9, 10, II, 12, and 13, there has been an
effort to circumvent Defendant's ability to respond in a timely manner preventing the Couns from
properly applying PeMsylvania Rules of Civil Procedure 106 and 126, and;
18. Pennsylvania Rules ofCi\;1 Procedures 1028 (a) (3) provides that a Defendant may
move to strike off a pleading for insufficient specificity in a pleading. and,

Associates, above-named plaintiff, by and through its attorney,
Gail F. Guida, Esquire, and respectfully avers the following:
1. The plaintiff is HcCuen and Associates, located at
205 Grandview Avenue, Suite 211, Camp Hill, Pennsylvania 17011.
2. The defendants are Nancy and David Stouffer,
residing at 231 Reeser Road, Camp Hill, Pennsylvania 17011.
3. From January 5, 1993 to January 20, 1993, the
defendants received services from the plaintiff incurring a debt
to the plaintiff in the amount of $513.00.
4. The defendants have failed to pay the plaintiff for
the above-mentioned services.
WHEREFORE, the plaintiff respectfully requests that judgment be

9. In paragraph three (3) of Plaintill's third Complaint, Plaintilfalleges that Defendant
Nancy Stouffer, during January 1993, obtained services from Plaintiff, Plaintiff provided either
by written example and/or explanation for the lack thereof in Plaintiffs' any of the three prior
Complaint's filed for this action, nor in Plaintiffs' (third) Complaint Defendant has no records of
said services. nor records of any other services dating back to January of 1993.
10. Defendant discarded all records at the end of January 1996 according to Federal Tax
Law Requirements For Record Keeping, hereinafter referred to as "Exhibit Three".
II. Plaintiff did not file the original Complaint directed to the aforementioned Defendant's
until July 26. 1996; as noted on the face of District Justice Farner's "Notice Of
JudgementfTranscript". hereinafter referred to as "Exhibit Four".
12. Defendant assens that the Plaintiff has brought this complaint on innuendo verses
with the sufficiency ofverifiable e\;dence that would allow a defense or decision.
13. In paragraph four of Plaintill's third Complaint. Plaintiff sites sudo- foundational
proof of services and costs thereof by reference to a "bill" marked as "Exhibit A" of Plaintiffs'
complaint, marked by Defendant's in this response as "Exhibit Two", page four (4). Plaintiffs'
own exhibit clearly demonstrates that Plaintiff did not pro\;de any bill at any time to Defendant's,
and that a statement printed-out on any processor. does not constitute \;ability or authenticity
14. Defendant assens that a Statement of Account, is not a bill an invoice, or proof that
the Defendant's ever received sen;ces. billing for said sen'ices, or notification required by any
fair debt act, to effect a billing Plaintiff must meet the standard of submission before Plaintiff can
allege the existence of said bill. a statement is a summary of QJ)inion of accountability by one

the existence of this "Statement of Account" prior to any of these multiple Complaint's filed
before the Court by the Plaintiff
17. Defendant's deny Plaintitl's averment as depicted in Plaint ill's third Complaint,
paragraph 4, (see "Exhibit Two"), Defendant's assert there can be no "failure to pay" for the
reasons setforth in Defendants' aforementioned paragraph 14.
18. In Plaint ill's (third) Complaint, paragraph 5, Plaintiff alleges" Defendant's failed to
pay Plaintiff for these services, Defendant's deny Plaint ill's averment, paragraph 5, of Plaintiffs
(third) Complaint.
19. Plaintiff failed to conform to law or rule of court in Plaintiffs closing paragraph of
Plaintiffs (third) Complaint when Plaintiff "requests that judgment be entered ordering the

Objections. On January 21, 1997, Plaintiff forwarded to Defendant's a Praecipe For Listing Case
For Argument. On February 18, 1997, Plaintiff tiled "The Plaintill's Brief For The Plaintill's
Answer To Defendants' Preliminary Objections". On March II, 1997 the "Original Complaint"
was heard upon the Briefs submitted to your Honorable Court by both the Defendant's and the
Plaintill's. On March 24, 1997, the Court GRANTED the Defendant's relief and DISMISSED
Plaintill's Complaint for "lack ofspeciticity", and also afforded Plaintiff twenty (20) days to tile
an" Amended Complaint", this Order Of Court, hereinafter referred to as "Exhibit One". On
April 14, 1997, Defendant's received an additional third Complaint.
