WHEREAS, David S. and Betty Jo Hill~r, of Dillsburg, 'York'
County, Pennsylvania, the OWner, contemporaneously herewith has
executed or is about to execute a contract with Jim Hiller, of
Dillsburg, York County, Pennsylvania, the Contractor, for the
construction of a dwellilng house, and related structures or
improvements, upon that certain land situate in Upper Allen
Township, Cumberland County, Pennsylvania, more particularly
bounded and described as set forth in Exhibit "A" attached hereto
and made a part hereof.
NOW, this 10th day of October, 1996, at the time of and
immediately before the execution of the said principal contract,
and before any authority has been given by the said Owner to the
said Contractor to commence work on, or to furnish or purchase
materials for the aforesaid buildings or construction, in
consideration of the making of said contract with laid Contractor
and the further consideration of One Dollar to said Contractor paid
by said Owner, it ls agreed that no llens or clalms Ihall be filed
or made against laid buildings and/or land, or any part, piece,
parcel or lot thereof. by said Contractor. or any sub-contractor.
or by any materialmen. workmen or other perlonl for or on account

of any labor provided or materials furnished or purchased, or any
extra labor or materials provided, furnished or purchased for said
buildings or construction, hereby expressly waiving any and all
rights to file or make such liens and claims.
AND, in furtherance hereof, the said Contractor does hereby
represent and warrant that as of the time of the execution hereof,
neither said Contractor, nor any sub-contractors, materialmen,
workmen or any other persons have commenced any work on, or
furnished or purchased any materials for the aforesaid buildings or
construction.
IN WITNESS WHEREOF, the said Owner and Contractor, each
intending to be legally bound hereby, have duly executed this
Stipulation on the aforesaid day, month and year.

EXHIBIT "A"
ALL THAT CERTAIN piece, parcel or lot of land situate in Upper
Allen Township, Cumberland County, Pennsylvania, bounded and
described as follows: .
BEGINNING at a point located on the southern right-of-way line
of Bradford Court (50.00 feet wide) said point being located at
the northwestern corner of Lot No. 125; thence along the western
boundary line of Lot No. 125 South 20 degrees 13 minutes 54
seconds West for a distance of 130.00 feet to a point located at
the southwestern corner of Lot No. 125; thence along the
southern boundary line of Lot No. 124 North 69 degrees 46
minutes 06 seconds West for a distance of 109.43 feet to a point
located on the eastern right-of-way line of Bradford Court said
point being located at the southwestern corner of Lot No. 124;
thence along the eastern right-of-way line of Bradford Court
(50.00 feet wide) on the arc of a circle curving to the left
having a radius of 525.00 feet an arc length of 45.78 feet to a
point; thence continuing along the eastern right-of-way line of
Bradford Court North 01 degree 25 minutes 55 seconds West for a
distance of 51.51 feet to a point; thence on the arc of a circle
curving to the right having a radius of 15.00 feet an arc length
of 23.56 feet to a point located on the southern right-of-way
line of Bradford Drive; thence on the arc of a circle curving to
the right having a radius of 275.00 feet an arc length of 103.98
feet to a point; thence continuing along the southern
right-of-way line of Bradford Drive (50.00 feet wide) South 69
degrees 46 minutes 06 seconds East for a distance of 33.55 feet
to a point and the place of BEGINNING.
BEING Lot No. 124 on the Final Subdivision Plan for Canterbury
Estates, Phase IV, which said plan is recorded in Cumberland
County Plan Book 71, page 142.
