THIS AGREEMENT made the 16th day of October, 1996, by and ~
between D. W. KETNER ENTERPRISES, hereinafter referred to as
Contractor, and KEHNBTH P. BOWLBY and LORRAINB J. BOWLBY,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a custom built home on that
certain lot of ground situate on Lot 110, Buckingham Place (14
Downing Street), Carlisle, Cumberland County, Pennsylvania, more
fully described in Exhibit "A" attached hereto and made a part
hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to Contractor
in hand paid by OWner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of the. against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of the. under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said contractor, for th....lve., their subcOntractors and

All that certain tract of land situate in North Middleton Township, Cumberland County, Pennsylvania,
being Lot No. 10 on the Final Subdivision Plan for Section Three of Buckingham Place, prepared by John R.
Williams, R.S., dated May 5, 1987, and recorded in Cumberland County Plan Book 56, Page 143, and more
fully bounded and described as follows:
BEGINNING at a point on the eastern right-of-way line of Downing Street, at the dividing line between
Lots Nos. 9 and 10 on the abovementioned plan; thence along said dividing line North 74 degrees 52 minutes
01 second East 350.00 feet to a point; thence along lands now or formerly of Marlin E. Miller South 15
degrees 07 minutes 59 seconds East 240.00 feet to a concrete monument; thence along the dividing line between
Lots Nos. 10 and lion the aforementioned subdivision plan South 74 degrees 52 minutes 01 seconds East
350.00 fect to a point on the northern right-of-way line of Downing Street; thence along said right-of-way
North 15 degrees 7 minutes 59 seconds West a distance of 240.00 to a point; the Place of BEGINNING.
CONTAINING 1.928 acres.
BEING the same premises which Frank A. Sabatini and Karen L. Sabatini, his wife, by their Deed dared
September 5, 1995 and recorded September 6, 1995 in the Office of the Recorder of Deeds of Cumberland
County in Deed Book 127, Page 1003, granted and conveyed unto D. W. Ketner Enterprises, the Grantor
herein.
