Both parties acknowledge that they have boen afforded tho opportunity
to consult with an nttol'ney of their choice lll'ior to signing this Agreement, WIFE is
reprl'sented by Debra A. Denison, gsquire, HUSBAND is unrepresented, HUSBAND
is cognizant of his right to legal representation Ilnd declares that it is his express
voluntary Ilnd knowing intention 1I0t to nvnil himself of his right to r.:ouJlsel and chooses
instead to represent himself with respect to the preparation and execution of this
Agreement.
'I'he parties further declare that each is executing the AlfI'ecment freely
and voluntarily having either obtained sufficient knowledge and disclosure of their
respective legal rights and ohligations or, if counsel has not been consulted, expressly
waiving the right to obtain such knowladge, 'I'he parties each acknowledge that this
Agreement is fail' and equitable and is not the result of any fraud, coercion, duress,
undue influence or collusion,
2, SUBSEQUENT DIVORCE
An action seeking the dissolut.ion of the marriage is pending in the
Cumberland County Court of Common Picas anll hears docket number 96.5781, Said
action was filed on October 21, 1996. HUSBAND and WIFE acknowledge that the
marriage is irretrievably broken and each agree to execute both an Affidavit of Consent
for divorce and a Waiver of Notice of Intention to Request Entry of a Di~orce Decree
within fUteen days of receipt of the request from WIFE's attorney, Said request will

come nt the end of the ninety (90) day waiting pOl'iod, This Agreement shall be
incorporated with thp. divorce decree, ~ut not merged,
3, SF.PARA'l'ION ^ND NONINTRRFlmRNCE
It will be lawful for each party at all times hereafter to live separate and
apart from the other party at such plnee or plnces as he or she may from time to time
choose or deem fit,
Each party shull be free from interfel'ellce. authority and control, direct
or indirect, by the other, as fully as ifhe or she were single and unmarried, Neither
shall bother the othcr or compel or endeavor to compel the other to cohabit or dwell
with him or her,
4. E~FRCTlVE DNI'E
This Agreement shall be eITective on the date above first written if both
parties sign on the same date; otherwise, it shall become effective upon the signing by
the last party to do so,
5, WARRANTY 0.E.lliS.C100!lRE
Each party hereby confirms that he or she fully understands the terms,
. l.)nditions and provisions hereof and believes same to be fair, just, adequate and
reasonable under the existing facts and circumstances. The parties further declare
that each is cxecuting the Agrcement freely and voluntarily, having either obtained
sufficient knowledge and disclosure of their respective legal rights and obligations or,

This transfer is contingent on Samuel Reed obtaining finnncing which

the home, Said refinnnce 01' satisfnction of the existing mortgage shall occur within
sixty (GO) dllYs of thc cxecution of this AgrlJl!lIIcnl. llUSllAND and WIFr: ngrce thnt
they will be Jointly responsible to preserve nnd maintnin the house and grounds and
to pay nll mOl'tgage pnyments, tnxes, utilities, insurance, repairs and all other costs
associated with the property as they full due until the entry of the final divorce decree,
HUSBAND and WIFE will execute a deed transferring the property to
Samuel Reed upon proof of their release from financinl obligation on the home,
8. PERSONALPROPRRTY
The parties acknowledge that they have heretofore effected an equitable
division of all their personal property and it is understood and agreed that each party
shall retain as his or her sole and ,separate property, free and clear of any claim of the
other, all those items of personality which each now has in his or her possession and
control respectively without the necessity of any documents or further assurance except
as otherwise provided herein,
Notwithstanding the above, WIFE hereby agrees to return her diamond
and gold engagement ring to HUSBAND which has an approximate vnlue of $7,000 to
$10,000,

necessary to transfer the title of the Thunderbird into WIFE's name nlone, The 1987
Toyota Corolla is titled in WIFE's father's name, It is the [larties understanding that
Samuel Reed has nb'1'eed to trnnsf'er Lhe title in the 1987 'I'oyota Corolla to HUSBAND,
WIFE hereby waives any right, tWe or interest that she may have to said Toyota
Corolla.
10, PENSION, RETIHEMEN'l' AND OTHER EMPLOYEE BENEFITS
HUSBAND and WIFI~ acknowledge that the marital property of the
parties includes HUSBAND's individual retirement account (IRA). Neither
HUSBAND nor WIFE have a >lOIK or pension plan, WIFE hereby waives and
relinquishes any right, interest or claim to HUSBAND's IRA which has an
approximate cash value of $5,000,
11. CHECKING AND SAVINGS ACCOUNTS
HUSBAND and WIFE ncknowledge that marital property of the parties
included a checking and money market account at Harris Savings and Loan.
HUSBAND and WIFE acknowledgo that this property has been divided equally, Each
hereby waives and right, interest or claim to the other's share of said accounts.
