You have been sued in court. If you wish to defend against
the claims set forth in the following pages, you must take prompt
action. You are warned that if you fail to do so, the case may
proceed without you, and a decree of divorce or annulment may be
entered against you by the court. A judgment may also be entered
against you for any other claim or relief requested in these papers
by the Plaintiff. You may lose money or property ~r other rights
important to you, including custody or visitation of your children.
When the ground for the divorce is indignities or
irretrievable breakdown of the marriage, you may request marriage
counseling. A list of marriage counselors is available in the
Office of the Prothonotary at the Cumberland County Courthouse,
Carlisle, Pennsylvania.

annulMent between the parties docketed to this court at number
93-3940 of the Civil Term and withdrawn on 12/6/95.
7. The marriage is irretrievably broken.
B. The Plaintiff has been advised that counseling is
,! available and that the Plaintiff may have the right to request that
the court require the parties to participate in counseling.
9. This action is not collusive.
10. There is one dependent child to the marriage, Logan A.
Lebo, born December 21, 1994. The parties intend to make
alternative arrangements with respect to the custody and visitation
of the child.

11. The parties have legally and beneficially acquired

I. Respondent/Plaintiff is Jeffrey L. Lebo of 83 Winchester Gardens, North
Middleton Township, Cumberlund County. f'ennsylvunia,
2. Petltioner/Defendant is of 1932 Sterrells Gup A venue, North Middleton Township,
Cumberland CQunty, Pennsylvania,
3. Respondent/Plaintiff und Petitioner/Defendant are the natural purents of Logun A,
Lebo, born December 21, 1994, a minor" currently residing Ul 1932 Sterrells Gup Avenue, North
Middleton Township, Cumberland County, Pennsylvania.
4. Respondent/Plaintiff and Petitioner/Defendant have entered into an agreement
concerning the custody and visitution of the aforesaid child, which agreement is alluched hereto us
Exhibit "A",
5, Respondent/Plaintiff und PetitionerlDefendant agreed as u purt of the Agreement thut
the Agreement should be entered us an Order of Court us it is believed thut the terms of the
agreement will best serve the interests of the aforesuid child.
WHEREFORE, Plaintiff respectfully requests that the Court grant shared legal custody
of the aforesaid child to the parties herein and primary physical custody to Plaintiff with purtial
physical custody to Defendant as agreed to by the purties in Exhibit "A".

AGREEMENT CONCERNING CUSTODY AND CHILD SUPPORT
ENTERED INTO this 1.1)L day of 1\/\" '7 ,J 997
BETWEEN, Jeffrey L. Lebo, of 113 Winchester Gardens, North Middleton
Township, Cumberland County, Pennsylvania, hereinafter referred to as "Father",
AND Cathy J. Lebo, of 1932 Slerrells Gap Avenuc, North Middlelon
township, Cumberland County, Pennsylvaniu, hereinafter referred to as "Molher",
WHEREAS, Father and Mother arc the parenls of Logan A, Lebo, born December 21,
1994, a minor, hereinafter referred to as "the child' ;
WHEREAS, Father and Mother are no longer living together;
WHEREAS, a Counlcrclaim in the action for Divorce was tiled by Mother in the Officc of
the Prothonotary of the Court of Common Pleas of Cumberland County concerning custody of the
child to No. 96.57117 Civil Term.
WHEREAS, Father and Mother acknowledge that the child is now living with Mother;
WHEREAS, Father and Mother believe that the best interests of the child is served by Ihe
present custodial arrangement;
WHEREAS, Father and Mother believe that it i!\ in Ihe best interesls of their child 10 reach
an agreement as 10 thc relativc custody, partial custody, visitation and responsibilities concerning
financial support of their child;
WHEREAS, Falher and Mother desire to have said agreement enlered as an Order of
Court having jurisdiction over
NOW THEREFORE, in consideration of Ihe mutual covenants, promises, and
agreements as hereinafter sel forlh, the parties agree as follows:
I . Mother and Falher shall have joint legal custody of the child,
2, Mother shall have primary physical custody of the child,
3. Father shall have reasonable periods of partial 01' lemporary cuswdy wilh the child,
which periods, unless otherwise agreed to by the parties in writing shall consist of
a. every other weekend from Friday at 5:30 p.m. to Monday morning at 7:00
a.m" beginning Friday, March 28, 1997.
b. Holidays to be split between Ihe parties so that eaeh has the child for a
substantially equal portion of the holiday, New Years day, Easter, Memorial Day, Independence
Day, Labor Day, Thanksgiving, and Christmas.
c, Two evenings each week from 5:30 p.m. 1011:30 p.m.. the spccific evenings to
be agreed in advance by Mother and Father.
d. Such olher periods of visitation as .Igrecd 10 by MOlhcr and Falher.
