for Service of Notice of the Sale of Real Property Pursuant to
Special Order of Court under Pennsylvania Rule of Civil Procedure
430 as follows:
1, On pr about October 21/ 1996/ Plaintiff filed a Civil
Action - Complaint in Mortgage Foreclosure against the Defendants,
Frederick L. Seiler and Claudette B. Seiler, at the above-captioned
number and term,
2, Plaintiff delivered to the Sheriff of Cumberland County
a copy of the Civil Action - Complaint in Mortgage Foreclosure
filed by Plaintiff at the above-captioned number and term along
with directions requesting' that Defendants, Frederick L. Seiler and
Claudette B. Seiler, be served a copy of the Complaint at their
last known address being 1120 Newville Road, Carlisle, Pennsylvania
17013. True and correct copies of the Directions to Sheriff are
marked Exhibit "A", attached hereto and made a part hereof,

3, On or about November 4, 1996, Plaintiff received
Notices from the Allegheny County Sheriff's Office indicating that
Defendants, Frederick L, Seiler and Claudette B, Seiler were served
with a copy of the Complaint at their last known address being 1120
Newville Road, Carlisle, PA 17013, A true and correct copy of the
Sheriff Returns are marked Exhibit "B", attached hereto and made a
part hereof,
4. On or about December 10, 1996, Plaintiff entered
Default Judgment against Defendant in this action in the anlount of
$71,177.64 and for foreclosure and sale of the mortgaged premises,
5. On or about Decemb~r 11, 1996, Plaintiff filed with the
Prothonotary a Prap.cipe for Writ of Execution on the judgment in
this act ion.
6. In accordance with Pa. Rule of Civil Procedure 3129,
Plaintiff mailed Defendants, Frederick L. Seiler and Claudette B,
Seiler, true and correct copies of Plaintiff's Notice of Sheriff
Sale, by certified mail, return receipt requested at their last
known address being 1120 Newville Road, Carlisle, Pennsylvania
17013 and by directing the Sheriff of Cumberland County to post the
property at 1120 Newville Road, Carlisle, Pennsylvania 17013.
7. On January 16, 1997, the certified mail was returned to
Plaintiff unclaimed. True and correct copies of the returned
certified mail are marked Exhibit "C", attached het'eto and made a
part hereof.
8. An Affidavit of the Plaintiff stating the nature and
extent of the investigation which has been made to determine the
wh~reabouts of Defendants and the reasons why service of the Notice
of the Sale of Real Property cannot be made by certified mail, is
marked Exhibit "0", attached hereto and made a part hereof.

ALL that certain tract of land with the improvements thereon
erected situate in North Middleton Township, Cumberland County,
Pennsylvania, bounded and described as follows:
BEGINN!NG at a point in the middle of the public road leading
from Carlisle to Newville; thence in a southerly direction 207.5
feet to an iron pin in the northern line of a 16 foot alley; thence
along said alley eastwardly 50 feet to an iron pin; thence in a
northerly direction along lands formerly of Reuben Lintner 207.5
feet to a point in the middle of the aforesaid State Road; thence

4. On or about OGtober 10, 1991, Defendants executed a
Promissory Note ("Note") in favor of Beneficial Mortgage
Corporation (" Benef. icial") in the original. principal. amount of
$66,000.00. A true and correct copy of said Note is marked Exhibit
"A", attached hereto and made a part hereof.
5. On or about October 10, 1991, as security for payment
of the aforesaid Note, Defendants made, executed and delivered to
Beneficial a Mortgage in the original principal amount of
$66,000.00 on the premises hereinafter described, said Mortgage
being recorded in the Office of the Recorder of Deeds of Cumberland
County on October 15, 1991, in Mortgage Book Volume 1031, Page 915.
A true and correct copy of said Mortgage containing a description
of the premises subject to said Mortgage is marked Exhibit "B",
attached hereto and made a part hereof.
6. On or about October 18, 1994, Beneficial assigned said
Note and Mortgage to Plaintiff, said Assignment being recorded in
the Office of the Recorder of Deeds of Cumberland County on
February 14, 1995 at Mortgage Book Volume 491, Page 128. A true
and correct: copy of said Assignment is marked Exhibit "C", attached
hereto and made a part hereof.
7. Defendants are the record and real owners of the
aforesaid mortgaged premises.

Dear Sir:
You are hereby notified pursuant to the Federal Tax Lien Act
of 1966 (26 U.S.C,A. !i7425), that the real estate in which the
above named individuals are the record owners, real estate known
and numbered as 1120 Newville Road, Carlisle, Pennsylvania 17013,
Cumberland County, will be sold at Sheriff's Sale by the Sheriff of
cumberland County on the 5th day of March, 1997, at 10:00 o'clock
A.M. in the CUmberland County Courthouse, 2nd Floor, Commissioners
Hearing Room, Carlisle, PA 11013, A detailed description of the
aforesaid real estate is attached to this notice of sale. Said
sale will proceed pursuant to a levy by the Sheriff of Cumberland
County, which levy ts predicated upon a WrJ,t of Execution issued by
the Prothonotary of CUmberland County on the 11th day of December,
1996. at Docket Number 96-5797-Civil.

The aforesaid liene are subordinate to a judgment against
Defendants, Frederick L. Seiler and Claudette B. Seiler filed
December 10, 1996, at Docket Number 96-5797 Civil.
3. On or about January 16, 1997, the certified mail,
addressed to Frederick L. Seiler was returned to Plaintiff
unclaimed. A true and correct copy of the returned certified mail
is marked Exhibit "B", attached hereto and made a part hereof.
4. The undersigned counsel served Defendant, Claudette B.
Seiler, with a true and correct copy of Plaintiff's notice of the
sale of real property by certified mail, return receipt requested.
A true and correct copy of said Notice is marked Exhibit "C",
attached hereto and made a part hereof.
5. On or about January 16, 1997, the certified mail,
addressed to Claudette B. Seiler was returned to Plaintiff
unclaimed. A true and correct copy of the returned certified mail
is marked Exhibit "D", attached hereto and made a part hereof.
6. Pursuant to Judge Bayley's Order of Court dated January
22, 1997, service of the Notice of sheriff's Sale upon Defendant is
deemed complete and valid upon mailing by the Plaintiff by first
class mail, postage prepaid, addressed to Frederick L. Seiler and
Claud~tte B. Seiler at 1120 Newville Road, Carlisle, Pennsylvania
17013. A true and correct copy of said Order of Court is marked
Exhibit "E", attached hereto and made a part hereof.
7. On or about January 27, 1997, Plaintiff mailed the Notice
of Sheriff Sale to Defendants, Frederick L. Seiler and Claudette B.
Seiler at 1120 Newville Road, Carlisle, Pennsylvania 17013 by first
class r"ail, postage prepaid. True and correct copies of the
Certificates of Mailing, evidencing service by first class mail on
the identified Defendants, are marked Exhibit "F", attached hereto
and made a part hereof.
You may have the right to prevent or delay the Sheriff's Sale
by filing, before the sale occurs, a petition to open or strike the
judgment or a petition to stay the execution.
If the judgment was entered because you did not file with the
Court any defense or objection, you might have within twenty (20)
days after service of the Complaint for Mortgage Foreclosure and
Notice to Defend, you may have the right to have the judgment
opened if you promptly file a petition with the Court alleging a
valid defense and a relisonable excuse for failing to file the
defense on time. If the judgment is opened the Sheriff's Sale
would ordinarily be delayed pending a trial of the issue of whether
the plaintiff has a valid claim to foreclolge the mortgage or
judgment.
