LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in Hampden Township,
Cumberland County, penney1vania, being Lot No. 267 as shown on
the Plan entitled Kingswood Final Subdivision Plan of Phase VII,
dated January 11, 1996 and recorded in Cumberland County Plan
Book 72, Page 117, more particularly bounded and described as
follows:
BEGI~mING at an iron pin, being a westerly corner of Lot No.
266 and lying in a northerly right-of-way line of Saff~on Drive
(50-foot right-of-way), thence along the Saffron Drive
right-of-way, North 75 degrees 42 minutes 57 seconds West,
b~.65 feet to an iron pin; thence continuing along said
rig..~-of-way, along a curve to the left, having a chord bearing
of Non;, P: degrees 38 minutes 59 seconds West, a chord
distance ot 36.18 feet, a radius of 175.00 feet, and an arc
length of 36.25 feet to an iron pin, lying in said right-of-way
and being an easterly corner of existing phase IV (P.B. 57, Pg.
82); thence along said lands, North 02 degrees 24 minutes 58
seconds East, 162.21 feet to an iron pin, thence continuing
along said lands, South 75 degrees 42 minutes 57 seconds East,
158.00 feet to an iron pin, lying in said line and being a
northerly corner of Lot No. 266; thence along Lot No. 266,
South 14 degrees 17 minutes 03 seconds West, 155.00 feet to an
iron pin, being the place oe BEGINNING.
CONTAINING 0.51 acre.
UNDER AND SUBJECT, NEVERTHELESS, to Declaration of Conservation
Easement dated August 12, 1996 and recorded August 14, 1996 in
Cumberland County Miscellaneous Book 527, page 928, being a wetland
conservation easement area. The Declaration is amended to the
extent that the easement area is revised to reflect a corrected
direction and distance for line E2 and a corrected distance for
line E3 as more fully appears on Exhibit A, said easement area
being bounded and described as follows:
BEGINNING at an iron pin, being an easterly corner of existing
Phase IV and being a northerly corner of Lot No. 267; thence along
said line, South 75 degrees 42 minutes 57 seconds East, 63.00
feet to a point lying in said line, thence traversing through
Lot No. 267, South 51 degreee 10 minutes 45 seconds West, 81.99
feet to a point lying in a westerly line of Lot No. 267 and lying
in an easterly line of existing Phase IV, thence along said line,
North 02 degrees 24 minutes 58 seconds Eaet, 67.00 feet to an
iron pin, being the place of BEGINNING.
UNDER AND SUBJECT, NEVER~HELESS, to Declaration of Covenants,
Eaeements, Restrictions, Equitable Servitudes" Charges and Liens
dated November 9, 1988, and recorded November 10, 1988, in
Cumberland County Miecellaneous Book 356, Page 1095, as adopted
by Amendment dated August 12, 1996, and recorded August 14, 1996,
in Cumberland County Miscellaneous Book 527, Page 923.
BEING the same premises which pamay Development Co" Inc.,
a Pennsylvania Corporation, dated August 7, 1996 and recorded
August 29, 1996 in the Office of the Recorder of Deeds in and
for Cumberla.ld County, pennsylvania, in Deed Book 145, Page 83,
granted and conveyed unto William W. Babbs, Jr. and Tina L.
Babbs, Husband and Wife.
