PRAECIPE TO ENTER JUDGMENT BY NON PROS
TO THE PROTHONOTARY:
AND NOW, comes the Defendant, Gertrude M. Stoner, by and
through her attorney, Saidis, Guido, Shuff & Masland to request
that a judgment of non pros be entered against the Plaintiff,
Robert L. Ohrum, as follows:
1. The Notice of Appeal with a Rule to File a Complaint
was filed in the Offic~ of the Prothonotary for the Court of
Common Pleas of Cumberland County, Pennsylvania on October 24,
1996. Service of the Notice of Appeal with the Rule to File a
Complaint was served upon the Plaintiff on October 30, 1996. See
Exhibit "A".
2. Upon the expiration of the initial 20 day time within
which to file the Complaint, no Complaint was filed.
3. On November 21, 1996, the Defendant properly served the
Notice of Intention to Enter a Judgment of Non Pros upon the
Plaintiff. See Exhibit "B".
4 .
No resp~nse has been received from the Plaintiff in the
time period set forth in the Notice attached as Exhibit "B".
WHEREFORE, the Defendant respectfully requests that a
judgment of non pros be entered in favor of the Defendant,
