AND WAYNE MATSON, Defendant JURY TRIAL DEMANDED COMPLAINT 1. Plaintiff, Walter F, Seibert ("Plaintiff"), is an adult individual currently residing at 7C Creekside Drive, Carlisle, Cumberland County, Pennsylvania. 2, Defendant, West Shore Taxi Company, Inc. ("Defendant West Shore"), is a business organized and existing under the laws of the Commonwealth of Pennsylvania, with a principal place of business at 2103 Old Hollow Road, Mechanicsburg, Pennsylvania 17055. 3. Defendant, Wayne Matson ("Defendant Matson") is an adult individual currently residing at 111 Bridge Street, New Cumberland, Cumberland County, Pennsylvania. 4. At all times relevant hereto, Plaintiff was the owner of a 1984 Ford Ranger Pick-up, bearing Pennsylvania registration YD66317, which was being operated by Nancy Lehman ("Ms. Lehman"). 5, At all times material hereto, Defendant Matson was the operator of a 1985 Ford Taxi, bearing Pennsylvania registration TX17932, which was owned by Defendant West Shore. 6, At all times relevant hereto, Defendant Matson was acting under the scope of his agency and/or employment with Defendant West Shore. 7. On or about December 13, 1994, at approximately 5:14 p,m., Ms. Lehman was operating Plaintiff's vehicle in a easterly direction in the left lane of State Route 11 at or near its intersection with Crossgates Drive in Hampden Township, Cumberland County, pennsylvania. 8, At the aforesaid time and place, Ms. Lehman came to a lawful and complete stop to make a left hand turn. 9. At the aforementioned time and place, Defendant Matson who was also traveling easterly in the left hand lane of State Route 11, struck the rear of Plaintiff's vehicle. 10. At all times material hereto, Ms, Lehman, who had the legal right-of-way, was operating her vehicle in a reasonable, cautious, prudent and safe manner and in accordance with Pennsylvania law. 11. As a direct and proximate result of the negligent, reckless and careless conduct of Defendants, Plaintiff suffered the damages hereinafter described, - 4 - .... 0, >- [I; <'" ., ".
