Sl:J: Department's exhibit number 2, sub-exhibit number 2, The motorist, Mr, McCommon, testilied and in his petition he stated that he was not aware that his insurance had been canceled, He stated that when he became aware that his insural1ce was canceled, he immediately obtained insurance, The documents presented show that he obtained insurance from Progressive Insurance with an effective date of August 17, 1996, Mr, McCommon presented his insurance bill from Liberty Mutual indicating the premium was due on July 25, 1996. Mr, McCommon stated he paid the June premium but he presented no canceled check. Scction 1786 of the Vehicle Code, in part, states: 1786. OPINION AND ORDER OF COURT The Court held a hearing on November 22, 1996, regarding Petitioner's appeal from two vehicle registration suspensions imposed pursuant to S 1786 of the Vehicle Code. The Court gave the parties two weeks to submit a brief on the issues involved. The Commonwealth submitted correspondence to the Court with accompanying cases; Petitioner, appearing pro se, presented no brief or memorandum. FINDINGS OF FACT 1. The Court admitted two exhibits of the Department of Transportation (DOT), both certified documents that petitioner was notified his vehicle registration privileges for a Ford Escort station wagon and a Chevrolet truck would be suspended for ninety (90) days because of a lapse in insurance with the Liberty Insurance Corporation. The official notice sent to petitioner indicates that his insurance lapsed on 6/26/96. 2. Petitioner presented eight exhibits: insurance cards for a Ford station wagon and a Chevrolet truck with coverage through Liberty Insurance NO. 96-5862 CIVIL TERM Corporation, effective 5/17/96 through 5/17/97 (Petitioner's Exhibits II and 12); insurance cards for the same vehicles with coverage through progressive, effective 8/17/96 through 8/17/97 (Petitioner's Exhibits 13 and 14); a stub from Liberty Insurance Company showing a billing date and due date of 7/25/96, a previous balance of $23.50, the minimum due $23.50, and "in full" $23.50; in pen was written "Pd. 7-29-96" (Petitioner's Exhibit is) ; a letter from Petitioner to DOT regarding the suspension of his registration for his Chevrolet truck, stating that while he was out of town, he was notified that his insurance was cancelled on 6/26/96, and upon his return he immediately obtained insurance effective on 8/17/96; the letter further stated, "If th[e] insurance was cancelled in June, why did I receive a bill for J[u]ly?" (Petitioner's Exhibit '6); a letter from Petitioner to DOT regarding the suspension of his registration for his Ford station wagon indicating that the Ford was not driven while it was being repaired and when the work was completed, he iwmediately got coverage; the letter further repeated the statement concerning his receipt of a bill for July (Petitioner's Exhibit '7); and a computer print-out from Progressive regarding insurance coverage for the aforesaid vehicles (Petitioner's Exhibit '8). 3. Petitioner presented no proof that his insurance did not lapse from June 26, 1996 until August 17, 1996, other than the billing stub listed above noting in his own handwriting that the bill was paid. DISCUSSION Petitioner contends his insurance coverage lapsed for a period less than thirty-one (31) days. In support of this argument, he avers that had his insurance lapsed in June, he 2 NO. 96-5862 CIVIL TERM would not have received a bill for July. Petitioner maintains that his insurance lapsed from July 25, 1996, the date of Liberty Insurance Company's last billing date, until he secured new coverage with Progressive on August 17, 1996, twenty-three days. The law in this regard is found in Section 1786 of the Vehicle Code, stating as follows: (a) General ru1e.- Every motor vehicle of the type required to be registered under this title which is operated or currently regietered shall be covered by financial responsibility. . . , (d) Suspension of registration and operating privilege.- The Department of Transportation shall suspend the registration of a vehicle for a period of three months if it determines the required financial responsibility was not secured as required by this chapter . This subsection shall not apply in the following circumstances: (1) The owner or registrant proves to the satisfaction of the department that the lapse in financial responsibility coverage was for a period of less than 31 days and that the owner or registrant did not operate or permit the operation of the vehicle during the period of lapse in financial responsibility. (2) The owner or registrant is a member of the armed services of the United States, the owner or registrant has previously had the financial responsibility required by this chapter, financial responsibility had lapsed while the owner or registrant was on temporary emergency duty and the vehicle was not operated during the period of lapse in financial responsibility. The exemption granted by this paragraph shall continue for 30 days after the owner or registrant returns from duty as long as the vehicle is not operated until the required financial responsibility has been established. 75 Pa. C.S.A. SS 1786(d) (1) and (2). It is DOT's burden to prove that the vehicle in question is one which must be insured and that the owner or registrant of the 3 NO. 96-5862 CIVIL TERM vehicle either operated it or permitted it to be operated without insurance. Stone v. Department of Transportation, Bureau of Driver Licensing 166 Pa. Commw. 643, 646, 647 A.2d 287, 28B (1994) Once the Departm0nt satisfies its burden, the burden shifts to the Petitioner to prove he falls within one of the exceptions described in Sections 1786(d) (1) and (2) of the Vehicle Code, set forth above. rd. Because Petitioner's groundA for appeal fall under the first exception, he must show that the vehicle in question was not operated during the lapse period and that the lapse was for less than thirty-one days. See Dillon v. Department of Transportation, Bureau of Driver Licensing, 679 A.2d 291 (pa. Commw. 1996). Section 1377(b) of the Code permits DOT to sustain its burden of proof and establish its prima facie case exclusively through the production of certified documents.' There is no requirement that DOT establish the person was as fault or that the person intended to operate the vehicle without insurance. Stone, 166 Pa. Commw. 643 at 645,647 A.2d at 288 (1994). Furthermore, DOT is not required to prove that the owner or registrant actually received notice of an imminent lapse in insurance. rd. at 646, 647 A.2d at 288. Keeping in mind the previous law, this Court finds that DOT has clearly met its burden as evidenced by its two exhibits. Petitioner, however, has not met his burden to show that his 175 Pa. C.S.A. S1377 (b). 4 NO. 96-5862 CIVIL TERM lapse in insurance was for a period of less than thirty-one days for the following reasons. First, he presented no affirmative proof that he paid his insurance timely other than a handwritten notation on the bill he received for July stating that the bill was paid. Additionally, the fact that he received a bill for July does not undermine DOT's proof that Petitioner's insurancs lapsed in June. The bill indicates a previous balance of $23,50 and a due date of July 25, 1996, for payment of this amount. We believe that Petitioner did not pay his premium for June and had until July 25, 1996, to make this payment. When he did not, Liberty Insurance notified DOT that Petitioner's insurance had lapsed in June. Petitioner's receipt of a bill in July, therefors, was notice of a past due amount, not an indication that he was billed for a subsequent month. Accordingly, the following order is entered.
