AND NOW, this 4th day of April, 1997. upon
consideration of the Defendant's Emergency Petition for Special
Relief, and pursuant to an agreement reached in open court among
the Plaintiff and Defendant and their respective counsel,
Jennifer L. Lehman, Esquire, and Emily L. Hoffman, Esquire, it
is ORDERED and DIRECTED as follows:
1. The parties agree to cooperate with the
Commonwealth Land Title Insurance Company and will request that
amended 1099s be issued so that $60,000.00 of the sale of the
East pennsboro Township property is reported under each parties'
social security number.
2. Each partr shall receive $2,300.00 from the
escrow account held with PNC Bank. Wife shall be entitled to
use those moneys any way she so desires. Husband shall be
required to pay the taxes generated in 1996 on the joint escrow
account from his share of this distribution. Husband may use
the remainder of his share of the distribution of the $2,300.00
any way h& so desires. Nonetheless, the Divorce Master is still
free to reallocate the payment of this tax, if he so decides, by
giving husband a credit for the payment.
3. The remainder of the escrowed funds shall be

Present for the Plaintiff, Teresa Maciolka is
attorney Jennifer L. Lehman, and present for the Defendant,
Grzegorz Maciolka is attorney Emily L. Hoffman.
A divorce complaint was filed on October 25, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage, adultery, and indignities. Counsel have advised that
the parties will both sign and file affidavits of consent so
that the divorce can be concluded under Se~tion 3301(c) of the
Domestic Relations Code.
The complaint also raised the economic issues of
equitable distribution, alimony, alimony pendente lite, and
counsel fees and expenses. with respect to wife's alimony
claim, counsel are going to offer testimony on the factor of
marital misconduct; therefore, we will schedule a separate
hearing on that issue. At the same time, we will take testimony
on the incomes of the parties to establish the incomes that we
will be utilizing in the alimony claim. Counsel will provide to
each other a list of witnesses that they will present on the
marital misconduct issue and the income issue at least two weeks
prior to the hearing date.
On March 1B, 1997, husband filed a counterclaim
raising on his own behalf a claim for counsel fees and expenses.
The parties were married on January 17, 19B6, in
Florida, and separated in February, 1995. There is one child of
the marriage, Sandy, born February 26, 19BB.
Wife is a high school graduate and resides at 22
Roop Street, Highspire, Pennsylvania, with the daughter of the
marriage. The wife works for Personnel Source and is assigned
presently as a microfilmer at PHEAA. Her biweekly net income,
as shown on her income statement, is $430.46. Wife is a
,
naturalized citizen. She does not have any health insurance,
and her counsel is going to get an estimate on the cost of
health insurance for wife. The daughter is a participant in the
Blue Chip Program, which is a plan provided by the conlmonwealth
of Pennsylvania for minor children where the parents' income is
within the guidelines to allow the daughter to participate in
the program. Wife has not raised any health issues. Wife's
counsel indicates that her client receives a pension from wife's
circus employment but that the payment is based on a pension
earned before the marriage. The amount of the pension that wife
receives monthly is around $200.00.
Husband is 44 years of age and resides at 30
Westwood, Enola, Pennsylvania, where he lives with a female
friend. We do not know husband's educational background. He is
a cab driver with the Yellow Cab company and reports his net
weekly income on his income statement at $217.56. Husband is a
naturalized citizen. Husband had a heart attack in 1995 and has
been diagnosed with diabetes. He does not have any health
insurance, and his counsel advised that he currently owes
$8,000.00 in medical bills to the Holy spirit Hospital and also
physicians. Husband is currently paying support for the
daughter in the amount of $200.00 per month, which Order was
entered on August 9, 1996.
When the parties were before the Court on the
support issue in August, 1996, Judge Hess based the Order on
wife's income at $945.00 net monthly and husband's income at
$1,018.00 net monthly. According to wife, husband has
substantially more income, and she is going to attempt
that husband's income that he reports is not accurate.

The parties sold a property they owned at 107 and
111 Second street, West Fairview, Pennsylvania. The proceeds
from the sale were put into a CD in the amount of $42,264.49.
The proceeds represented by the CD do not include a $12,000.00
note which husband holds on the property representing financing
to the buyers. Husband is currently receiving payments on that
note in the amount of $104.14 monthly. With respect to the
monies in the CD, each party received $2,300.00, and then the
balance of the funds were put into separate CDs for each of the
parties. This was done for tax purposes so that each party is
obligated to report the income earned on each CD on their
respective income tax return.
Counsel are going to provide information on the
capital gain tax that was paid on the sale of the property and

that tax needs to be allocated between the parties.
There are three vehicles involved in this case,
namely, a 1990 Ford F150 pickup truck, a 1993 Toyota camry, and
a 1990 Geo Prism. The Ford pickup truck is currently in Poland
and is titled in husband's name. Wife has placed the value on
the pickup truck at $7,000.00. Husband has not suggested a
value for the truck. The 1993 Toyota Camry is in husband's name
and is in his possession and is in the United states. Wife has
suggested a value on the Camry at $3,000.00. Husband claims
wife used the Toyota for four months and would like to have some
credit for her use since he was making the payments while the
car was being used by wife. The $3,000.00 value that wife has
placed on the vuhicle is a net value exclusive of the loan that
i~ owed on the vehicle. The Geo Prism is no longer owned by the
parties. wife claims she sold the vehicle in Poland to payoff
husband's business debts. Therefore, there is no value
suggested for purposes of equitable distribution.
The parties own land in Poland, and, according to a
document in Polish attached to the pre-trial statement, the land
has a value of $400.00. (The Master did not read the Polish
exhibit but was given this information by wife'S attorney as to
what the exhibit states the value of the land as being.) Wife
is suggesting that rather than get into an issue about the value
of the land and having it appraised in Poland that the parties
simply subdivide the property and each take arproximately one
half of the land, to be held in their individual names. There
is also a question about a building Which the parties used to
run a grocery store in Poland; however, that building is on land
owned by wife's parents, and apparently it does not have any
value for purposes of distribution in this case as marital
property. However, with respect to the store that the parties
had, the inventory of the store has been valued by husband at
$10,000.00 and by wife at no value. The parties conducted a
grocery business out of the building. Husband's counsel has
indicated that the building is characterized as a Butler
building which the husband says can be moved, so perhaps there
is some value if the parties can be shown to have purchased the
building and simply temporarily placed it on this land of wife's
parents. There is also a question about some equipment used in
the grocery store aside from the specific grocery inventory.
Husband has placed a total value on the land, the Butler
building, and the store inventory at $30,000.00, but he will
have the burden of proving how he arrived at this value.
Husband sold some taxi parts, and, according to
wife, he received $500.00 for the parts, and the proceeds from
the sale of the parts should be included as marital property.
Husband claims wife has certain items ot jewelry,
and he is requested to provide a list to wite's attorney so she
can determine whether the jewelry, in tact, exists, and so we
can, it necessary, have it appraised.
Husband had a strongbox in Poland with his
grandtather's watch and a coin collection. He claims the watch
and the coin collection are missing. wite is requested to
address the issue as to the whereabouts of these items if she
knows.
There is no issue with respect to household
tangible personal property.
The parties applied for a loan with Price/Norwest.
wite did not sign the loan document, however, and does not know
what the funds which husband received were used tor. Husband
claims that he received around $7,000.00, which he says is
marital debt; howover, husband needs to show how those funds
were expended, inasmuch as wife claims she knew nothing of the
loan being completed and did not sign the note obligating
herself for payment.
A hearing is scheduled on the factor of marital
misconduct as that factor affects wife's alimony claim on
Tuesday, September 16, 1997, at 9:00 a.m. We will also take
testimony at that time on the income and expenses of the
parties. As previously indicated, counsel are directed to
provide each other with a list of witnesses at least two weeks
prior to the hearing. A hearing is scheduled to take testimony
on the remaining factors and the identification and valuation of
assets for Tuesday, october 14, 1997, at 9:00 a.m. Notice will
be sent to counsel and the parties.

XI. proposed Resolution of Economic Issues
1, Husbana will receive $15,500 from the escroW account
plus 50% of the interest earned.
2. Mrs. Maciolka will reimburse Mr. Maciolka for the
following expenses from her share of the escrow account:
(a) $500 which represents one-half of the
expense for the roof that he put on the
home;
(b) $175 which represents one-half of the appraisal
for the home:
(c) Reimbursement for one-half of the taxes which Mr.
Maciolka paid; and
(d) Reimbursement for the car payments that he made
on the Toyota while Mrs. Maciolka used the Toyota
which equals $1,232 ($308 per month x 4 months);
3. Mrs. Maci01ka will retain the pick-uP truck which her
parents had been using. Mrs. Maciolka will pay Mr.
Maciolka $7,000 for the truck. The $7,000 will be paid
to Mr. Maciolka from Mrs. Maciolka's share of the escrow
account and Mrs. Maciolka will return to the escrow
account the $6,000 that she received from the sale of
the Geo prism.
4. Husband shall be reimbursed the 1995 property taxes paid by
him.
5. While Mr. Maciolka is in poland, he will retrieve his
three CB radios, his strongbox with all contents which
includes but are not limited to his money collection and
his pocket watch. He will also retrieve his clothes
which include but are not limited to his sheepskin coat
for winter and his leather police jacket.
6. Mrs. Maciolka will retain the land and buildings located
in poland, as well as the inventory from the store. She
will also keep her jewelry. without Mrs. Maciolka
agreeing to an appraisal we are estimating the value of
these items are in excess of $30,000 or higher.

The plaintiff has filed this appeal from our order of August 9, 1996. In that order we
directed the defendant to pay the sum of $200.00 per month, effective Mareh 9, 1996, for the
support of the one child of the parties, Sandra, born February 26, 1988. This represented an
increase over our prior order of December 18, 1995, wherein the defendant was required to pay
$160.00 per month. It represented a reduction, however, of the amount of support recommended
by the Domestic Relations Office in a proposed order dated March 27,1996. Our support order
of $200.00 per month results in a situation where the amount of money available each month to
the defendant is roughly seventy percent of that available to the plaintiff.
The plaintiff, Teresa Maeiolka, is employed by Personnel Resources Agency and is doing
work, currently, for the Pennsylvania Higher Assistance Agency. In her statement of matters
complained of on appeal, she does not challenge our finding that her net monthly income is
approximately $945.00.
The defendant, Gregory Maeiolka, is a cab driver. We found that the defendant's
monthly net income is $1,000.00, more or less. Throughout this litigation, the plaintiff has
insisted that the defendant carns more than that. In fact, she is adamant that the defendant
carns twice as much. This conclusion is evidently based on the information received from and
subsequent testimony of one Robert Anspach. He was hired by ~he plaintiff as a priva~e
investigator. Prior to our support hearing, Mr. Anspach procured a cab ride with Mr. Maeiolka

and engaged him in conversation concerning his support case. In the course of this conversation,
Mr. Maciolka lamented that the court was allempting to assess child support hased on an income
which was twice what he was making. He then lold Mr. Anspach that he did not make
$45,000.00 but made between $24,000,00 and $2H,OOO,OO per year. On surrebuttal, Mr. Maciolka
testified that he did not recall quoting any such figures but that if he did, they were in obvious
error. There was, in any event, no stalement to Mr. Anspach as to whether these figures
represented net or gross income.
The defendant charges cab fare to his customers, ill addition to which he receives tips.
From this income he pays fees to the cab company and must also purchase gasoline. We have
reviewed Mr. Maciolka's most recent tax returns, as well as his log sheets from the cab company.
Our reperusal of these documents, in connection with drafting this opinion, satisfies us that in
setting Mr. Maciolka income at $1,000.00, we have been more than generous to the plaintiff. In
fact, we may have, in retrospect, overestimated Mr. Maciolka's income.
The remaining matters complained of on this appeal center around our failure to award
child care expenses. Sometime prior to the hearing, the mother switched to daylight work, from
8:00 a.m. to 4:00 p.m. Mrs. Maciolka pays a babysitter $45.00 a week to watch her daughter
Sandra before and after school.
One of the plaintiffs complaints is that she came to the support hearing unaware of the
fact that she would be called upon to deal with the issue of child care. We find this assertion
mystifying. Child care expenses are a well-known clement in child support cases. It was, in fact,
the plaintiff who first raised the matter at the support hearing. She described her financial
relationships with the babysitter on direct examination. On cross-examination she rejected the
idea that Mr. Maciolka could alleviate this expense by watching the child after school. Even if
