LOWER FRANK FORD TOWNSHIP
IN THE COURT OF COMMON PLEAS OF
CUMBERLAND COUNTY, PENNSYLVANIA
PETITION FOR APPOINTMENT OF SUPERVISORS
TO FILL VACANCIES
COMES NOW, Edward W. Harker, Esquire, Solicitor of Lower
Frankford Township and represents as follows:
1. On October 8, 1996, two of the three elected Supervisors
of Lower Frankford Township (Second Class Township) resigned
their positions thereby creating two vacancies.
2. The Second Class Township Code provides in pertinent
part that:
. . If two or more vacancies in the office of
supervisors occur on a three member board . . .
the court of common pleas shall fill the vacancies
upon presentation of a petition signed by not
less than fifteen electors of the Township.
53 P.S. S 65407.
3. The remaining Supervisor Joel D. Woolums cannot hold an
official Board meeting or transact new business of the Township
in the absence of a quorum as required by law.
4. On October 25, 1996, a special public meeting was held
at the Township Building to invite Township residents to offer to
serve as replacement Supervisors and enable the public to express
their views and opinions on such candidates as appeared.

We, the undersigned petitioners represent that:
1. Each of the petitioners whose name and signature below is
a bona fide resident and registered elector of Lower Frankford
Township.
2. We hereby Petition and Request that the Honorable Court
of Common Pleas of Cumberland County appoint Timothy D. Lush
and Gregory L. Brownawell
to act as Supervisors of Lower
Frankford Township until January 1, 1998.

AND NOW, this 6th day of Novamber, 1996, the
Court held a hearing today on a petition to appoint Timothy D.
Lu.h and Gregory L. Brownawe11 a. replacement .upervi.or. for
Lower Prankford Town.hip, Cumberland County, Penn.ylvania. The
act in question requires that the petition be .igned by not 1e..
than 15 elector. of the township.
It wa. testified in court today that all of the
petitioner. who singed the petition are registered electors of
Lower Prankford Town.hip. Counsel for the town.hip has also
presented to the Court a certification that all required notices
have been properly published.
Therefore, pursuant to the act the Court will
sign ~ order appointing Timothy D. Lush and Gregory L.
Brownawe11 a. replacement supervisors for Lower Prankford
Township, Cumberland County, Pennsylvania, and they shall
continue in that office until January 1, 1998.
