Keefer, her husband, by and through their attorney, Joseph J. Dixon, Esquire, who respectfully aver as follows I 1. The Plaintiffs are Patricia L. Keefer and Joseph L. Keefer, her husband, adult individuals who reside at 458 Crescent Street, Harrisburg, Dauphin County, Pennsylvania 17104. 2. The Defendant, Edward Hawk Darrah, is an adult individual who resides at 454 Swamp Road, Newtown, Bucks County, Pennsylvania 18940. 3. The Defendant, Nora R. Cannatadivito, is an adult individual who resides at 2199 Spruce Street, Trenton, New Jersey 08638. 4. The Defendant, Anthony Divito, is an adult individual who resides at 6 Clark Court, Titusville, New Jersey 08560. 5. At all times material hereto, the Defendant, Edward Hawk Darrah, was an employee and/or agent and/or servant of the Defendant, Nora R. Cannatadivito. 6. At all times material hereto the Defendant, Edward Hawk Darrah, was an agent and/or employee or servant of the Defendant, Anthony Divito. 7. The facts and occurrences herein took place on Nov6mber 1, 1994, at approximately 4101 p.m., on U.S. Route 15 North near west Lisburn Road in Upper Allen Township, Cumberland County, Pennsylvania. 8. At aforesaid time and place, the Plaintiff, Joseph L. Keefer, was the driver and the Plaintiff, Patricia L. Keefer, was the passenger in a 1989 Pontiac Grand Am. 9. At aforesaid time and place, the Defendant, Edward Hawk Darrah, was driving a 1993 Ford truck with box owned by the Defendant, Nora R. Cannatadivito, and/or Anthony Divito. 10. At aforessid time and place, the Plaintiffs' motor vehicle was stopped at a red light in the left hand lane proceeding north bound on U.S. Route 15. 11. At aforesaid time and place, the Defendants' motor vehicle was traveling in the left hand lane of U.S. Route 15 North when he was unable to stop for the red light. 12. At aforesaid time and place, the Defendants' motor vehicle struck a 1986 Chevrolet Spectrum owned by Joe Koonlavong pushing said motor vehicle 15 feet forward into the rear portion of the Plaintiffs' motor vehicle. 13. At aforesaid time and place, the Defendants' motor vehicle again etruck the motor vehicle owned and operated by Joe Koonlavong and the Koonlavong motor vehicle again etruck the Plaintiffs' motor vehicle in the rear. 14. Said collision was due to the negligence, carelessness and recklessness of the Defendants which consists of the followIng I (a) Traveling too fast for conditions; (b) Not adhering to the assured safe distance rule; (c) Driving their vehicle at an unsafe speed; (d) Unsafe lane change; (e) Failure to keep their motor vehicle under control; and (f) Operating a motor vehicle at an excessive rate of epeed under the circumstances. 15. Said collision was in no way caused by the actions or conduct of the Plaintiffs. 16. As a sole and proximate result of the accident, the Plaintiff, Patricia L. Keefer, has suffered from severe serious and permanent injuries. These injuries include, but are not limited to cervical sprain/strain, lumbar sacral sprain/strain, traumatic sacroiliac joint dysfunction of the right sacroiliac joint, post- traumatic lumbar radiculopathy, headaches, and cervical radiculopathy. 17. As a result of said injuries, the Plaintiff, Patricia L. Keefer, has undergone in the past and will undergo in the future great pain and suffering. 18. As a result of the injuries, the Plaintiff, Patricia L. Keefer, has been advised and therefore avers she will always have serious permanen~ problems and limitations in her activities. 19. As a result of said injuries, the Plaintiff, Patricia L. Keefer, is obliged to receive acd undergo medical care and spend various sums of money and incur various expenses for the injuries shot suffered. The total amount of these losses is unascertained at this time. 20. As a result of said injuries, the Plaintiff, Patricia L. Keefer, has lost wages from work. In addition, she will continue to lose opportunities to earn additional wages and has a loss of earning capacity. The total amount of these losses is unascertained at this time. 21. As a result of her injuries, thg Plaintiff, Patricia L. Keefer, may have to incur in the future additional financial expenses and losses, the total amount of which are unascertained at this time. 22. As a result of the aforesaid injuries, the Plaintiff, Patricia L. Keefer, has suffered a substantial inconvenience in her life and a decrease in the quality of her life. 23. At all time material hereto, the Defendant, Nora R. Cannatadivito and the Defendant, Anthony Divito, are vicariously liable for the actions and conduct of their servant and/or employee and/or agent, the Defendant, Edward Hawk Darrah. WHEREFORE, Plaintiffs pray this Honorable Court enter judgment against the Defendants in a amount in excess of Twenty-Five Thousand ($~5,OOO.OO) Dollars plus interest and costs of suit. Paragraphs 1 through 23 of this Complaint are incorporated herein by reference and made a part hereof. 25. As a result of said injuries to his wife, Patricia L. Keefer, the Plaintiff, Joseph L. Keefer, has been and will be deprived of assistance, companionship, consortium and society of his wife, all of which have been and will be to his great loss and detriment. 26. As a result of the accident, the Plaintiff, Joseph L. Keefer, has suffered a permanent diminution of his ability to enjoy life and life's pleasure.
