BUSER AND LORI A. BUSER FROM THE SEPTEMBER 20, 2002 WRITTEN DECISION OF THE SILVER SPRING TOWNSHIP ZONING HEARING BOARD Jonathan M. Buser and Lori A. Buser (hereinafter referred to as "Appellants"), by and through counsel of Andrew C. Sheely, Esquire, hereby file this Appeal pursuant to Section 1002-A of the Pennsylvania Municipalities Planning Code, 53 P.S. §l1002-A, as amended, from the September 20, 2002 written decision of the Silver Spring Township Zoning Hearing Board, a copy of which is attached hereto as Exhibit "A". In support of the instant Appeal, Appellants respectfully state as follows: 1. Appellants are adult individuals and reside at 9 Canterbury Drive, Township of Silver Spring, Mechanicsburg, Cumberland County, Pennsylvania. 2. Appellee, the Zoning Hearing Board of Silver Spring Township (hereinafter referred to "Zoning Hearing Board"), is a governmental agency or quasi-judicial unit of the Township of Silver Spring with principal offices located at 6475 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania. 3. On or about April 29, 2002, the Silver Spring Township zoning officer and codes enforcement officer sent a letter entitled "Enforcement Notice of Violation" to Appellants advising that Appellants were in violation of Section 204.2 of the Silver Spring Township Zoning Ordinance in the following respect: Section 204.2 Permitted Uses The operation of Apartments in the R-1 zone. 4. The subject property to which the Enforcement Notice of violation was directed is located at 20 York Circle, Mechanicsburg, Silver Spring Township, Cumberland County, Pennsylvania. 5. The April 29, 2002 "Enforcement Notice of Violation" advised Appellants of their right to appeal the Enforcement Notice to the Zoning Hearing Board. 6. On or about May 29, 2002, Appellants filed an Appeal to the zoning officer's written decision and requested a hearing before the Zoning Hearing Board pursuant to the Enforcement Notice of Violation. 7. Public hearings were held on Appellants' Appeal on July 15, 2002 and August 15, 2002 before the Zoning Hearing Board. 8. The Pennsylvania Municipalities Planning Code, Act of July 31, 1968, P.L. 805, No. 247, re-enacted and amended by Act 170 of 1988, as amended, 53 P.S. 10616 (d) et seq., requires that the municipality shall have the burden and responsibility of presenting its' evidence first. 9. Substantial, credible and uncontradicted testimony and exhibits were presented by the Appellants in support of their appeal and defenses to the Enforcement Notice issued by the township zoning officer. 10. On or about September 20, 2002, the Zoning Hearing Board issued written Findings of Fact, a Discussion and Conclusions of Law, together with an Order (hereinafter referred to as "Decision') denying Applicants' zoning appeal. 11. The Zoning Hearing Board's written decision denying Applicant's appeal to the Enforcement Notice constitutes an error of law, abuse of discretion and is not supported by substantial evidence for the following reasons: a. Silver Spring Township is barred by the doctrine of laches from initiating the instant Enforcement Notice where uncontradicted evidence was submitted demonstrating that the Township was aware of the multi-use property owned by Appellants and their predecessors for a period in excess of ten years by collecting and accepting taxes on such property as a multi-use property during such period of time; and b. Silver Spring Township is barred by the doctrine of estoppel from initiating the instant Enforcement Notice where the Township was aware of the multi-use property and Appellants expended substantial sums of money to acquire the property, continually paid taxes as a multi-use property and relied upon the manner in which the property was taxed, sold and reported by the taxing authorities of Silver Spring Township and the County of Cumberland; and 3 c. Silver Spring Township failed to meet its burden of proof in demonstrating that Appellants were using property in violation of the applicable Township Ordinance thereby requiring dismissal of the enforcement notice; and d. Applicants are entitled as a matter of law to continue using the property as a multi-use, secondary apartment use where Appellants have not expanded or changed the use of the subject property during their term of ownership and where no person appeared at a public hearing to contest, oppose or challenge the continuation of such use. WHEREFORE, for the reasons set forth above, Appellants respectfully request that this Honorable Court reverse the September 20, 2002 decision of the Zoning Hearing Board and dismiss the Enforcement notice issued by Silver Spring Township and return all monies paid by Appellants to appeal the enforcement notice as required by law. A I am James Hall. I am the Zoning Officer for Silver Spring Township. Q And Mr. Hall, as Zoning Officer for the Township, is one of your duties to enforce the Township Zoning Ordinance? A Q That is correct. Mr. Hall, are you familiar with the property, the subject property, with regard to this appeal? A Yes, I am. Q i~nd that address is 20 York Circle, Mechanicsburg? A That is correct. Q And Mr. Hall, how is it that you have become familiar with this property? 1 '2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 A Back in early part of May -- or I'm sorry -- April I received a call, an anonymous call, complaining about the property at 20 York Circle being an apartment building with an apartment in the front, and an apartment to the rear of the structure. Up to that point it was always considered by me, going by looking at it, considered a single-family dwelling, as well as other single-family dwellings there. Q Mr. Hall, according to the zoning map, what is the zoning of this particular parcel? A It is R-l, residential zone. Q And to the best of your knowledge, does the R-1 residential zone permit a multi-family dwelling, that is, a dwelling containing more than one residence? A It only permits single--family detached dwellings. Q Okay. And Mr. Hall, did you have occasion to visit the property? A I was out at the site, yes. Q Okay. And what did you find when you were at the site? A Well, at the time I was there, there was, of course, an entranceway to the rear., an entranceway to the front of the building, plus two PP&L service meters was on the building. Q They were both on the .same dwelling, we will call 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 it? A That is correct. Q Okay. And as a result of your inspection and the complaint that you received, what did you do next? A I sent a notice of violation to the property owner, and the violation was that he was operating an apartment building in a zone that only permitted single-famil dwellings. Q will mark Township exhibit -- do you like to use letters, A? MR. WEINGARTEN: A would be good. MR. STINE: -- and ask you to have a look at that, and tell me if that is, in fact, the notice of violation that you sent, Mr. Hall. THE WITNESS: Yes, this is the violation that I sent. MR. STINE: Do the Board members have copies of the notice of violation? THE BOARD: (NODDED HEADS) MR. STINE: You do. Okay. (Handed a copy to Mr. Sheely.) BY MR. STINE: Q And Mr. Hall, after issuing the notice of violation, that was then appealed by the Applicant. A Yes, the Applicant actually'had sent a letter to I am going to show you a copy of a letter which we 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 me stating that there was only one family living in there, and he appealed -- wanted to appeal the decision of the zoning officer. CROSS-EXAMINATION BY MR. SHEELY: Q Mr. Hall, you've been in the position of Zoning Officer since about 1997 or 1998; is that correct? A Yes. Q Are you familiar with this property back in 19907 A I knew that there were properties there, you know. I had absolutely no idea what the zoning was back in 1990 at 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that time. I was in a different life. Q Do you know what the zoning would have been for that property in 19907 A In 1990, that property was zoned as R-6. Q During your review of this, did you ever look into the township tax records to see if this property was listed as a multi-use property? A Yes, I did. Q Was that before or after you sent out the enforcement.notice? A Before. Q And I take it your position is that the property is not a lawful use? A That is correct. Q And how did you arrive at that decision? A Two occupants or two families living in the same building is not permitted within tlne current R-1 zone. Q You had indicated you received a complaint about the property. What was the nature of the complaint? I am not asking who submitted it, but what was the problem? A It was a complaint that was registered, stating that there were two families living in that property, and they wanted to know if that was something that was permitted by the township ordinance. Q knd the prior ordinance prior to that would have been September of 19957 A That is correct. Q Up until that point, the Township had been using 1968 ordinance? A '76 ordinance. Q '76. MR. Mr. Buser, could you state your name for the record, please? MR. SHEELY: For the benefit of the Board, I will give you a map so you have a chance to see where the property is located, if that would be helpful. MR. WEINGARTEN: Uh-huh. Did you make a copy of a map of the MR. SHEELY: area in question? THE WITNESS: MR. SHEELY: (NO RESPONSE) I may not introduce it as an exhibit MR. WEINGARTEN: Okay. MR. SHEELY: (Handed out copies) BY MR. SHEELY: Q Now, Mr. Buser you stated you live at 9 Canterbury; is that correct? A That's correct. A Um, I own both properties, the back yards touch at the one corner. So I can look out the rear of my house and basically look through the yards and, um -- Q Could you come up, and I will let you describe to them where the properties are. A Yeah. (COMPLIED) Q If you would just explain to the Board where you live? A I am the second house on the cul-de-sac here. (INDICATION) My yard goes over to about here, and then the property in question corners this way. (INDICATED) Actually, my neighbor has come along, and the backyard of -- he is at 11 Canterbury Court. The entire backyard of his property is across -- MR. WEINGARTEN: If you could just draw that for US. THE WITNESS: Okay. The property in question I will put a star on, and my property is right here with the number 1. And this would be my neighbor's property, Mr. Harber. CHAIRMAN DUNN: I look at maps the way the roads go, and I am having trouble figuring out which is Hogestown. THE WITNESS: Hogestown would be right here, and 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 then York Circle is actually, like, a little split or fork to the left. CHAIRMAN DUNN: This is York Circle. THE WITNESS: Yeah. And my property is, actually from the intersection, the second one. here. goes out. CHAIRMAN DUNN: THE WITNESS: CHAIR/~AN DUNN: THE WITNESS: CHAIRMAN DUNN: THE WITNESS: comes right back up. CHAIRM3U~ DUN-N: you are on -- THE WITNESS: Okay. So this is Hogestown Road Yep. That is actually Hogestown Road. Yep. And York Circle is that split that York Circle splits out and then Okay. I see where you are at. So I am on this cul-de-sac off of Rife Drive, to Canterbury. Right here on the corner, and then the Potteiger property is on the other side of my property in question. The Potteigers live there on York Circle. CHAIRMAN DUNN: You don't live on York Circle, you live back off -- THE WITNESS: Yeah, I live right off of this street here, (INDICATED) right on the end of the cul-de-sac. SHEELY: Q Mr. Buser, you purchased the property on York Circle in 1990; is that correct? A That's correct. Q And at some point thereafter you purchased the property at 20 York Circle? A 20 York Circle I purchased in 2000. Q And were you aware -- can you just tell the Board basically how you became aware of 'the property, and why you purchased the property? A Okay. I had been neiglhbors with the prior owner of 20 York Circle for that decade and, what appealed to me was the fact that she had an apartment in the rear, and she was renting it, and it would be so close to my house. It would be convenient to do repairs and things like that. So I had always said to her, if she ever put it up for sale, mention it to me, because it would be a convenient place for me to have a rental unit, and it wouldn't be my first rental unit. Q At the time you purchased the property in 2000, did she advertise the property as a multi-unit property? 13 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 A Yes, it was. And did you go over and look at ~he property? I actually saw the real estate agent -- I use York Circle as a road to cut through to the other side of town. I am on York Circle every day. So I was actually there when they were hanging the sign in the yard. So I pulled right in the night they put the sign in the yard, and she walked me through it again that night. And I think we had a sales deal within two or three days. Q Okay. And subsequently you had real estate settlement; is that correct? A That's correct. Q And did you eventually thereafter commence leasin¢ the apartment on the property? A Yes. Q And has it been rentedi since you've owned the property? A Yes, it has. I will comment on what Mr. Hall said I did send him a letter that said at the current time of the notice I wanted to appeal it, and at the current time there was only one tenant. The reason for a single tenant was because we were -- we had the tenant in the rear, we had him vacated because we felt it was a problem. He was making noise, comin( in late, rewing his motor. 14 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 At the time of my appeal notice to Mr. Hall, we only had one tenant in there. At the present time, during the aPPeal status of this proceeding, we have two people. We rent the very small unit in the back, we rent it to a single girl. Q Could you just describe to the Board the size of the unit, what it looks like, and 'the nature of it? A The front of the house, it dates back to the 40's. It's basically one of the oldest properties on the block, knd I would say from the front it looks like your basic cape cod home. There is a long wide driveway that goes the whole length of the property, close to 100 foot long, paved, probably about 20 feet wide, that goes back to the rear unit. It passes the rear unit that was built, and goes to an exterior or detached garage. And the rear apartment itself is probably only a total of 300 to 350 square feet, and can only be seen from the rear, not by people driving by. I think I failed to mention that my neighbor rented that out as a second unit. She rented it out since 1990. And the property -- the rear addition was built in '89 when it was in R-6 Zone. Q Now, Mr. Buser, when was the first time that you discovered that you -- that the township was citing you for violating the zoning ordinance? A The interesting thing was, i never received any 15 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 · call about this property. I just got a letter in the mail. And this -- I don't know the exact date, but it was late APril, I believe, that I got the letter. I think it was April 29th. Q And is that the first time you had any knowledge that you were violating the township zoning ordinance? A Yes, it was. I never received any complaints from any neighbors or anyone questioning it. Q Thereafter did you do any research into the property to find out what the use of the property historically was? A When I went in -- when I got the notice, I decided to go to the Cumberland County Courthouse. I have a handful of rental properties, when I buy them that seems to be the best place to research the property, because you can go for a one-stop location, and get all of the information you need. The information that you can get from the Township is limited. I can get the Recorder of Deeds at Cumberland County. I can get mapping, zoning, tax records. And, yeah, I went up to confirm that the two units that I was sold was registered as a two-unit. I went into the Tax Assessor's Office. I looked at her main -- they have a main card there that all of their notes for the history of the property are written on. And she had it recorded as a two-unit, being taxed 16 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 as such since 1990. ~nd I could even see the notations on the card, which we've copied and attached her signature, notations of which date back to 1989, where they sent an inspector out and reviewed it after construction. Everything I just said basically goes through all of the computer systems in Cumberland County. The Recorder of Deeds listed it as a two-unit, the tax assessor listed it as a two unit, and Debra Basehore Wiest her computer listed it as a two-unit as well. Do you remember who you talked to at the Q courthouse? A Cathy Waters. MR. SHEELY: I will mark this as Applicant 1, which is -- they don't have the seal there, but they just gave us a card, and initialled it, as far as a record goes. MR. WEINGARTEN: Okay. MR. SHEELY: (HANDED OUT COPIES) Mr. Buser, is it fair to say that what I have marked as A-1 is the information that Cathy Waters provided you concerning the property? THE WITNESS: Yes. In fact, if I could have the opportunity, the sketch is kind of complex. Could I have an opportunity to approach, and point out a few things on that? MR. WEINGA~TEN: Certainly. THE WITNESS: Cathy Waters, in the tax assessment 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 office, she told me that these are the notations that the inspector made to the property in i[989, what they saw after construction. And she noted to make change to the tax file to make it a two-unit. They both noted the two kitchens in the structure Let me see where that was. There should be a -- here it is. This second unit is basically this shaded area right here. The second unit that was built is basically this back area here. (INDICATED) These two rooms here. Basically it represents about 20 to 25 percent of the property. Like I said -- well., they have it marked as 320 square feet. I guessed 350. You enter the second unit from rear, right here on the side. There is no rear entrance. It is off the driveway here. This would be the street. The driveway goes all of the way back, paved. There is one notation of two kitchens, right here. If you read through this kitchen number -- kitchen number 1 and kitchen number 2, are also lis'~ed on the card right here. CHAIRMAN DUNN: Who was it -- you said someone inspected it. Do you know who? THE WITNESS: Cathy didn't tell me who that was, but they said -- I guess that is something they do routinely, that the assessor will send somebody out to examine a property. 18 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 , CHAIRMAN DUNN: Okay. The Township wouldn't have a record of an inspection of a property in 1989, would they? MR. HALL: information. CHAIRMAN DUNN: THE WITNESS: I think the Township does have that Okay. We will get to that later. I would throw in one more question, if the tax assessment office sent an inspector out and saw that the construction that was completed in '89 yielded a second unit, my question would be why the township isn't aware of it, and -- CHAIRMAN DUNN: Don't address that to us. That's a good question, but that is not one we can answer. That is not our role. THE WITNESS: Okay. BY MR. SHEELY: Q Mr. Buser, I believe you testified that you've beenpaying taxes on this as a two-unit property since you owned it. A property. Q A Q Since day one we have paid taxes as a two-unit Who was the prior owner? Patricia Stewart. And how long had she lived in the property to the best of your knowledge? A Talking with her, most -- I'concentrated my 19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 questions as to when that unit was built, and how long that was in use. So I am -- at this time I can't say how long prior to that she owned it. MR. SHEELY: I am going to mark Applicant's Exhibit 2, which is a series of tax notices from 1993 through 2000. BY MR. SHEELY: Q Did you have a chance to go out and see Mrs. Stewart prior to coming here 'this evening? A Yes, I did. Q Did she give you tax bills she had in her possession concerning her property'? A She was able to give me original tax receipts. I didn't want to bother her with all of them, but she had a set of them, and I picked out the ones dating back as far as 1990, which are originals. Q Is it fair to say that Applicant's Exhibit Number 2 is a copy of the tax receipts that you got, the original tax receipts? A Yes, it is. MR. SHEELY: I have the originals with me if the Board wants to see them. MR. WEING~-RTEN: The copies are fine. Mr. Stine, do you care to see the originals or do you accept the copies? MR. SHEELY: Q Could you tell the Board about how the property is presently serviced for sewer? A Presently we are billed for two units. The bill totals -- basically it totals what a single family home would total, doubled. It's just two charges. Q How is the property service for water? A The property has a well. So we do not get a water bill. unit? Q Was the well installed prior to your purchase? Yes, it was. Was the sewer installed prior to your purchase? Yes, it was. Is there any off-street parking for the second A I am pretty familiar with that, with having a handful of rentals, and the off-street parking we have is probably double what the requirement would be for two units. Q Now, as adjacent owner, do you pay particular attention to the use of that property? A Yeah, because of the fact that I let my dog in the backyard every day. knd like I mentioned earlier, I drive by the front of that every day because I use that road to go to Walnut Street. How much was that? 112,000. And you indicated that you bought the property as I paid 112,000 for the property, based on the fact that I was being sold a two-unit, based on the fact of what my rental return would be on the property. The property is old. It dates back to the 40's. And the condition it was in, I wouldn't have paid 112 for that condition if it was only a single-family home. Q Did you get a seller's disclosure statement as part of that purchase? A Yes, I did. Q I will mark it as Applicant's 3 a copy of the seller's disclosure statement concerning the property. MR. SHEELY: have two copies of it. MR. STINE: I apologize. For some reason I only Can I show it to Steve for a second? I'm sorry. It is not going to be admissible because you only have two copies. BY MR. SHEELY: Q On the disclosure statement is there a reference of this being sold with an apartment? A I believe there is a reference on Page 1 as it 22 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 being a two-unit. Q Is there anything else you would like to add? A Another item that I became aware of when I went down to Cumberland County, the Recorder of Deeds, at that office I was able to do a printout on my property in question. And when I did the printout on it, it says that the zoning is R-A, in parentheses it has 102 current zoning, which I took to mean R-2 for 102. And they had definition of all of their zonings notations, and I took a copy of that. And it says that R-A was residential apartments, which agrees with my current tax form. My current tax form does say residential, dash, apartment, and we have a copy of that. Q A Q I will mark this as A-4 Then I took the time to pull a sheet -- John, could you stop for just one second for Lorraine's benefit? (Whereupon, Applicant's Exhibits 1-4 were marked.) THE WITNESS: Then I took the time to pull a sheet on the neighboring properties on either side of mine, just to see if they were all listed as residential apartments or if there was a distinction being made in the legal records for my property in particular. SHEELY: Q You are in the property immediately to the north of 20, which is the subject property. Correct? A Yes. Q And did you receive an enforcement notice from Mr. Hall concerning that property? A Yes, I did. I had a total of two enforcement notices that came out. Q And were you using that property in violation of the Ordinance at that time? A A came along. Yes, I was. Have you corrected that? Yes, I did. Is your wife here today? Yes, she is. And who else came with you? Prior to purchasing the property, did you ever come into the Township to inquire into the zoning of that property or any of the zoning regulations for that property? A The reason I didn't was, like I said earlier, I felt that in my past experience, Cumberland County is a convenient, one-stop location, to get all of the information I need. Since the determination was sent to me, yes, I did come out to the Township to get some documents. I was told on 25 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 my first time when I came out that I would need to speak to a particular gentleman. And they said he wasn't in, and he would call me. MR. WEINGARTEN: For the benefit of the court reporter, could you just slow down a little bit? THE WITNESS: Oh, I am sorry. I think his name was Jeff. Do you have an employee in there Jeff? TOWNSHIP STAFF: (NO RESPONSE) THE WITNESS: But, an~;ay, he was to call me back. I missed him. And basically telephone tag started. And the reason I say that is just to enforce the fact that as a real estate investor, any real estate investor you talk to, if they are researching a property, they go to Cumberland County, because they are set up, and they can get immediate answers. BY MR. STINE: Q So the answer to my question was, then, that you didn't come into the Township prior to purchasing the property. A No, I did not. Q Now -- and, of course, you being a savvy real estate investor, you knew that the County wasn't responsible for zoning the property; is that right? A That's correct. Q And that they wouldn't be the source or the prime source of knowledge with regard to zoning in the township, 26 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 would they? A They are not a prime source, but they are a constant source for real estate assessment information. Q Now, since you've lived in the neighborhood for quite a number of years, what is the general character of that neighborhood over there? A (NO RESPONSE) Q Primarily single-family dwellings? A Primarily. Q Okay. So living there for that long, knowing that the general character of the neighborhood is single-family dwellings, didn't you find it kind of odd, that one house in the whole neighborhood had an apartment? A I didn't find it odd at all because there are plenty of streets in this township and other townships where there are unique properties that exist, and have been in usage for periods of several years or decades. Q Didn't you think it was kind of out of the ordinary, and maybe it should have prompted you to check with the Township with regard to that property? A Not at all considering the age of the home. Right next door to the home, at the time, was another home that had exceptions made to it, due to grandfather clausing. And I just figured that a usage that dates back a whole entire decade, is defined based on the fact that it was a prior use. 27 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Q By the way, you pointed out on the drawing that you showed the Zoning Hearing Board. a part of the house on which an addition was built. What actually is contained within that addition as far as rooms? A The addition that was built, I got to see the -- have never gotten to see the plan for when the construction took place. Basically all I did was discussed it with the homeowner previous to me, and then also the contractor that built it. And what is included in there is a TV room and full kitchen for a total of 320 square feet. Q There is not a bathroom in the addition? A The bathroom is there, but it wasn't built at that particular time, in 1989. Q It was not? A No. Q Oh, when was the bathroom built? A I wasn't told when that was built. Q Built prior to '89, is that what -- A Yeah. Q But that -- if that was built prior to '89, that is not really in the addition that. was built in '89, and that is alongside of it? A No, when they did the -- when they did the addition in 1989, they combined that. But the actual plu~in¢ fixture was not put in in '89. Q Do you have any idea whether they ever got a building permit for that? A Yes, they did. Q For the bathroom? A For the bathroom? Q Yes. A Again, I am not aware of when that was built, or if they used a building permit when they built that bathroom. Q You had mentioned a sewer billing, that it is being billed as two units; is that right? A That's correct. Q When was that set up as two units? A I received my first bill as a two-unit property on sewer, the most current bill that we got, so that would be, like -- I don't have the date of that in front of me. Q Okay. But it would be the most recent bill. In 2000? Yeah. And you purchased this-- No. I'm sorry. 2002? Yeah. Q Well, how was it billed then -- how was it billed when you purchased it? A It was being billed as one sewer and well, so we didn't get a water bill. Okay. So it was being billed as single-family Q dwelling. A Which is not uncommon at all. I have properties in the Borough of Mechanicsburg that are done that way, and they are zoned multi-density, for two units. MR. STINE: That is all I have for this witness. MR. WEINGARTEN: Any redirect, Mr. Sheely? REDIRECT EXAN[INATION BY MR. SHEELY: If you had gotten a sewer bill, would you have Q paid it? A Q Yes. Definitely. I paid the first one that came. Did you ever have knowledge of the fact that you were required to have a separate sewer bill for that property? A Um, for my properties over in the Borough of Mechanicsburg -- Q I am talking about this particular property. A I was never contacted for that. Q Just for the record, which -- I will strike that. At some point did you go to the Township to look to see if there ever was a building permit issued for that addition? A Yes, I made a request to them. And, again, it led into telephone tag. And it took nearly two weeks to get it, but we did get that. Q And what did the Township give you? A They gave me a log chart where they log all of the building permits for that month, and they also gave me a copy of the original building permit from the 1989 construction. MR. SHEELY: Steve, do you have a copy of that? MR. STINE: Yes, I do. MR. SHEELY: I don't have an extra copy for the Board, but I am just going to mark this collectively as exhibit 5. MR. STINE: Okay. THE WITNESS: I have, actually, a nun~ber of copies, and I can distribute them to the Board, if you would like. MK. SHEELY: Sure. MR. WEINGkRTEN: Is that Applicant's exhibit -- what is it? And she said it was her rental apartment, to come see her in front. Q Is Mr. Buser -- strike that. Are the people that reside at that premises good neighbors at 20 York Circle? A I don't know them. You mean, the old ones? Q Yes. Have they caused any problems to you? A No, I haven't had any problems. Q Does anyone have direct view to that property other than the properties on Canterbury Circle? A Not that I know of. Q Approximately what is the nearest distance from that property to another residential use? A It would be the next-door neighbor, Potteiger, on the other side of me. MR. There is an appeal of the zoning officer issuance of notice of appeal, but there is also a discussion of special exception for the -- I will read it, literally -- expansion of non-conforming use. SHEELY: Essentially our theory was that this was a non-conforming use since 1990, that the property owner purchased the property in 2000 as a non-conforming use, and that as such it should remain a non-conforming use. That is why he filed the appeal to the notice. MR. WEINGARTEN: Understood. MR. SHEELY: Understand there are other criteria for special exception in that district, and we are not submitting it at this point as a special exception. MR. WEINGAIRTEN: It is just the actual application said, nature of request, appeal under 604.5, which I understand we are dealing with here. Then it says 503.1 and in parentheses, 604.3 Special Exception. And it didn't -- you haven't made that case. And I don't know how that you would make that case, but I just wanted to clear up the record on what we need to consider, here. I would like on the record a statement that you are withdrawing that -- that this is simply an appeal, not a request for special exception. Do you understand that? THE WITNESS: (NODDED HEAD) MR. A This is the building permit application that was submitted to the property owner of Neil S. Stewart at 20 York Circle. Q A Q Okay. B_nd what is the date of that application? February 15th, 1989. Okay. B_nd what does it say that the building permit application is for? A It is for a 16-by-20 addition on the rear and for a family room. Q For a family room. Okay. And I take this is the property at issue here this evening; is that right? A That's correct. Q knd does it say anywhere on there that the application is for the addition of an apartment? Did you hear testimony this evening that the actual nu~er of rooms that were added on were two, a kitchen and TV room? A Yes, I did. Q The application doesn't reflect that, does it? A No, it does not. Q It references also the zoning classification for this particular address. What is that? A R-6. Q Okay. And what does R-6 permit as a permitted us( within that zoning district? A Single-family detached, homes. Q Okay. Does it permit any apartments or multiple family dwellings anywhere? A No, sir. Q Okay. Mr. Hall, do you recall what the zoning was prior to the 1976 ordinance? A In the 1961 ordinance, the zoning ordinance was residential, single. Q Meaning single-family dwellings? A That is correct. Q So to the best of you]: knowledge, Mr. Hall, ever since 1961, this property has been zoned for single-family 38 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 residence? You've heard a lot of testimony this evening about some information that was found at the courthouse with regard to the property being classified as residential apartments. What have you -- is it your job as a zoning officer to go to the courthouse and peruse the many records that the Tax Assessor and Recorder of Deeds has, to make sure that they are accurate, and in accordance with our zoning ordinance? A Q No, sir. And whatever the county has as far as classifications would not control the Township's Zoning Ordinance, would it? A No, sir. MR. STINE: I believe that is all I have for this witness. SHEELY: Q Mr. Hall, you testified to the 1980 Zoning Ordinance, correct, concerning the permitted uses? A In what year? Q The older ordinance, 1976. A 1976, yes. Q Was there a procedure back in that ordinance, similar to your current ordinance which allows for residential conversion to occur as a special exception? There was no record that I have found where that A occurred. Q Do you know whether or not the ordinance permitted that as an option? A The ordinance did permit for site plan waivers, and that was used for residents who wanted or businesses who wanted to do certain things. They could come into the Planning Commission to apply for those kind of things. To the best of my knowledge, that was not applied for. Q Was the procedure which you just discussed something which the Planning Commission had jurisdiction to decide or do they have the authority to decide that, who got that type of change? A In the '76 ordinance they did, yes. Q Was there a procedure in the '76 ordinance which authorized that, to the best of your knowledge? 40 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 A To the best of my knowledge, yes. But there was never anything in our records to -- for the Stewart's to do what they did there. Q And since you've been the zoning officer, you never were notified by the Stewarts or Mr. Buser that the property had changed uses from a single-family residence; is that correct? A No, no. I didn't know that Mr. Buser had owned the property until it was called to my attention. Q Are you familiar with the procedure in which properties get designated certain uses on the tax notices that are sent out? A No. Q So as far as you know, there is no procedure that the county would notify the Township as to whether or not a property was multi-use or use for change -- multiple uses? No. Does the Township notify the county as to that A procedure? A The county comes into the township and reviews the building permit applications, and permits that have has been submitted. And that's how they keep up with their tax records. They have to come here to get that information. Q If you don't know this question, and I don't expect you perhaps to, but the records in this case 41 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 demonstrate that the county had changed this in 1989 to a multi-use property. Do you have any knowledge as to how they would have gotten that information? A I have absolutely no idea how they got that information. MR. SHEELY: I have nothing further, Mr. Weingarten. Thank you. MR. WEINGARTEN: Very good. Anything more, Mr. Stine? MR. STINE: No. MR. WEINGA~{TEN: Good. At this point does the Board have any questions for Mr. Hall or Mr. Buser? CH3~IRF~AN DUNN: I want to make sure I understand the last line of questioning. County comes here and gets the information it uses to make up the tax bill; is that what I -- is that what I just heard? MR. HALL: The county comes here and looks through the building permits that have been issued, to see if there are any additions, new houses, etcetera, that is being built on properties. CHAIRMAN DUN/q: So this tax parcel, whatever the number is, this has the tax parcel number, so they would have looked -- they would have had to have seen some document in 1989 to make this a multi-unit. MR. HALL: (NO RESPONSE) 42 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 CHAIRMAN DUNN: MR. HALL: No. was on this -- No, they wouldn't have. The only thing they seen was what CHAIRMAN DUNN: Where would they have gotten the information that this was a multi-unit dwelling? MR. STINE: The property owner can call up and say, Hey, you have this property listed as a single-family dwelling. It is actually two apartments. Please change it. CHAIpuV~kN DUNN: So this isn't the only source -- the Township isn't the only source of information as to how a property should be rated. MR. WEINGARTEN: A~ I correct that the designation of this property on the county records did occur in 19897 In other words in 1988 or '87 it would have been A-l? THE WITNESS: Cathy Waters at the Tax Assessor's Office told me it was designated that in 1989, and the handwritten note on there states that as well. MR. WEINGAiRTEN: the property. CHAIRMAN DUNN: Okay. That's right. The note on The bathroom addition was discussed, and I wasn't sure whether the bathroom was built prior to '89 or after '89 or nobody knows? THE WITNESS: The bathroom -- the 320 square foot, which is notated on the building permit as one room, it is split-use room. 43 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 In other words, it is 320 square foot, there is one room when you look at it from the exterior; but when it was built, the contractor built a kitchen within that, like, a kitchen/TV room open. And then the bedroom is behind that. As you come in the entrance it is the kitchen/TV room and bedroom, and that is it, it is just three little rooms. And that room existed prior to '89, the bedroom. CHAIRPiAN DUNN: What about the bathroom? THE WITNESS: The bathroom is part of that bedroom, and it dates back before '89 as well. CHAIRMAN DUNN: So the bathroom was inside of the bedroom. Okay. What prompted the two sewer bills? And that happened in 2002. Was that as a result of you making a call saying, I have two units, here? How was that discovered? THE WITNESS: No phone calls for that. It just came from within the Township. They made a decision to bill me for two and I paid it. CHAIRMAN DUNN: happen? MR. HALL: I never made a phone call. Help ~me out. How would that When this all started to evolve, that was one of the places that I investigated to see what the property was being billed for on the sewer bills. When I first inquired, it was being billed for one unit. After that, 44 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 then they started billing for the 'two units. CHAIRMAN DUNN: Okay. MR. WEINGARTEN: Anything further from the Board? THE BOARD: MR. WEINGARTEN: Township or the Applicant? THE WITNESS: No. MR. WEINGARTEN: No. then what we will do -- MR. SHEELY: sorry, I didn't know? MR. WEINGA1RTEN: MR. SHEELY: more time up. (NO RESPONSE) Anything further from either the If there is nothing further Do you want closing remarks? I'm I'm sorry, yeah. Just brief, I don't want to take any Mr. Buser's position is that he is, in fact, a person who relied upon what was presented to him. He was presented with a property that had~ two uses. He relied upon what was presented to him as two uses. Now, two years after he owns it, nearly 10 years -- in excess of 10 years after, apparently, the county changes the record, he gets notice from the Township telling him that he is in violation of the ordinance. It was a surprise to him. He does wish to comply He did comply with the adjacent property. With this property, however, it's been used as a two-unit property for some period 45 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 of time. How records got changed, I can't state that. But they state what they are. He relied upon that. And now he is put in a position where he is going to lose, perhaps, an investment pursuant to the Township's notice. Our position is that -- and we are not asking for the Board to do anything other than grant this as prior non-conforming use. We established it as a non-conforming use, which is was, and what it has been used as, and what it currently is used as. We are not here requesting for a variance. We are not here to request a special exception. In those circumstances it is possible that Mr. Buser may not be entitled to such. But in this case we feel we presented adequate evidence to show that the property was, in fact, used as a rental property, in addition to the principle use of the property as an accessory apartment since 1990. And we would request that the Board continue to allow us to grant that, either as a denial of the -- Mr. Hall's letter or as establishing it as a prior non-conforming use. Mr. Buser is a township resident. He wishes to remain a township resident. He wants to be a good neighbor. The propertY is relatively off the beaten path. It is a 46 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 relatively small space. We are not trying to pull a fast one on the Township. We are just trying to present facts to you folks to show the position he is in. He doesn't really have another opportunity other than to request this appeal at this point, which he could continue to use the same means. Thank you. MR. WEINGA~TEN: Thank you. Any closing comments, Mr. Stine? MR. STINE: Yes. The Township is certainly sympathetic with Mr. Buser's situation. However, it is our position that his remedy is against the previous owner who apparently misguided him with regard to the proper use of the property. I suspect that that property owner on the seller's affidavit incorrectly and untruthfully stated that it was in compliance with all of the township zoning ordinances, which it was not. And he would certainly have a remedy against the property owner for that. Secondly, the Applicant's argument is that this is a pre-existing, non-conforming use. In order to be a pre-existing, non-conforming use, it first must have been at one point in time a lawful use. There has been absolutely no evidence offered this evening that that was ever the case. There was evidence offered that it has been used as two apartments for a long 47 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 period of time. However, that in and of itself does not mean that it was ever lawful. You will see from the 'testimony from Mr. Hall that, in fact, since 1961 this area has been zoned single-family, residential. And never allowed apartments as a permitted use. In fact, the evidence with regard to whether or not this was ever a lawful use, is actually contradicted in the building permit which states that it wasn't for an apartment to be added on, it was for a family room of all things. One room doesn't provide for any bathrooms, any of that sort of thing. So if, in fact, this was turned into an apartment in 1989, the Township knew nothing about it. A building permit was presented saying it was for a family room. The Township assumed that a family room is an add-on to a single-family residence, not to allow an additional apartment. So if anything, the Applicant can now not avail himself of a misrepresentation that was made by a previous property owner, in order to gain a use that that property owner desired in violation of the zoning ordinance. If, in fact, the building application had been truthful at the time that the building was constructed, it would not have been constructed, because a building permit would not have been granted. Because it would have been in 48 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 violation of a zoning ordinance. And the Township cannot now authorize a non-conforming use out of a use that was illegal and never conformed of a zoning ordinance. So it would be our request that the appeal be denied on that basis. MR. WEINGARTEN: Thank you. At this point we will close the record to deliberate and provide our decision. Thank you. If Groundwater has always been subject to contamination, being exposed ~o various sources of pollution. Early concerns dealt with problems of a bacterial nature, the type of contamination frequently generated by animal and other organic waste materials. The use of various purification devices and processes (i.e. chlorination) is not uncommon. Hore recently, complicated chemical substances have been discovered in underground water supplies. Recently developed tecknologies have identified health threatening chemicals orginating from many and varied (and sometimes unknown) sources. Hany such substances have resulted from the disposal of solvents, petroleum products and other previously acceptable materials not heretofore identified as harmful. Such chemical materials have been found in well-water at various locations in Silver Spring Township. The officials of this Township have cooperated with the Pennsylvania Department of Environmental Resources (DER) in locating the presence of and identifying various harmful substances. ~ile such information is helpful in developing wells, it is not exclusive or constant. Underground water migrates from many locations and carries with it whatever substances it may contact - some of ~ich may be harmful to health. Thus, new or different pollutants ca~ appear in a water supply without warning. Moreover, chemical substances are also known to change in character merely by the passage of time or by contact with other substances in the earth, providing additional sources of concern. Further, as scientific technology develops, new and different substances are being identified as potentially harmful. These concerns are not peculiar to Silver Spring Township. They exist in all'areas where wells are used as water sources. But~, because of the concern of this Township for its residents, this warning is being made in advance of the development of your project. The Township does not and cannot provide potable water to its residents. While public utility water systems are available in certain areas of the Township, connections thereto are entirely private matters between the utility company and the consumer. Moreover, the Township cannot assure that the health of future occupants of your project will not be adversely affected by groundwater contamination. It is also impossible to predict the effect that additional well construction and subsequent well use (pumping) may have on the migration and dissemination~of contaminants in the groundwater. Therefore, be aware that the use of well water may be harmful to health. Periodic testing is recommended. Monitoring of developments in groundwater research is suggested. You should engage appropriate qualified experts to assist in the original development and future maintenance of any well you may elect to use. The Township does not provide these services or advice and has no legal responsibility for future problems. As stated above, well water has always been a source of possible health threats; modern chemical substances have simply multiplied these threats, both in numbers and severity. Be aware of the problems and protect yourself, your occupants and others consuming well water. Date of Acknowledgement: BEFORE THE ZONING HEARING BOARD OF SILVER SPRING TOWNSHIP, PENNSYLVANIA In The Matter of JONATHAN AND LORI BUSER Application No. A~2002-3 Premises located at 20 York Circle Mechanicsburg, PA 17050 FINDINGS AND ORDER Pursuant to Sections 604.5 and 605 of the Silver Spring: Township Zoning Ordinance, as amended (the "Ordinance"), Jonathan and Lori Buser (the "Applicants") appeal the Silver Spring Township Zoning Officer's issuance of an Enforcement Notice of Violation dated April 29, 2002. The Silver Spring Township Zoning Hearing Board (the "Board") has evaluated the Applicants' request in accordance with Section 604.5 of the Ordinance. FINDINGS OF FACT 1. Public hearings on the Application were held on July 15, 2002 and August 12, 2002 at the Silver Spring Township Municipal Building, 6475 Carlisle Pike, Mechanicsburg, Pennsylvania, for the purpose of considering Applicants' request for relief. 2. Public notice of the July 15, 2002 on the Application was given by newspaper publication on June 25, 2002 and July 2, 2002, and by posting a notice on the Premises. Specific notice of that hear/ng was given to Applicants by first class mail. -1- constructed. 8. 3. Applicants have standing as owners of the Pmrnises. 4. At the heating Applicants withdrew their request for a special exception pursuant to Section 503.1 and 604.3 of the Ordinance. 5. The Premises consists of a single-family dwelling (the "Main Dwelling") that was constructed in 1945. An addition to the Main Dwelling was constructed in 1989 (the "Addition") (the Main Dwelling and the Addition collectively are referred to as the "Building"). A building permit for the Addition was issued by Silver Spring Township (the "Building Permit"). That Building Permit contemplated use of the Addition as a family room of a single family dwelling (not an apartment). 6. The Building and Premises were used solely as a single family dwelling until construction of the Addition was completed in 1989. The Building first began being used as apartments soon after the Addition was The Premises was located in the R-6 District when the Addition was constructed. Apartments were not a pemdtted use in that zone. The Premises was rezoned to the R-1 Residential Zone after the use of the Premises as apartments corrcrnenced. The Promises still is located in the R-1 Residential Zone. Apartments are not a pemfitted use in that zone. 9. In November 2000, Applicants purchased the Premises and began to use it as a two-unit apartment. Applicants currently have two tenants renting space in the Building. Applicants do not reside at the Premises. 10. Before purchasing the Premises, Applicants did not investigate the zoning classification of the Premises to determine whether the Premises could be used as apartments. -2- 11. The Silver.Spring Township Zoning Officer issued an Enfomement Notice of Violation dated April 29, 2002, notifying Applicants that use of the Premises and Building as apartments is not permitted within the R-1 Residential Zone (the "Enforcement Notice"). 12. Applicants appealed the issuance of the Enforcement Notice on the basis that use of the Premises as apartments is a lawful, preexisting nonconforming use. DISCUSSION AND CONCLUSIONS 1. Proper notice of the public hearing was given. 2. Applicants assert that use of the Premises as apartments is a lawfully preexisting nonconforming use. The Ordinance defines "nonconforming use:" as "[a] use, whether of land or of structure, which does not comply with the applicable use provisions in the Zoning Ordinance or amendment heretofore or hereafter enacted where such use was lawfully in existence prior to the enactment of such ordinance, or amendment or prior to the application of such ordinance or amendment to its location by reason of annexation." See Ordin~mce § 112. 3. Use of the Premises and/or Building as apartments is not a nonconforming use because that use is not (and never was) "lawfully in existence". 4. Applicants also claim that, since 1989, the Township has had knowledge of the apartment use at the Premises because the Township approved the Building Permit issued in connection with the construction of the Addition. The Building Permit was issued to permit construction of a family room at the Premises, not an apartment. Accordingly, Applicants are mistaken and failed to establish that the Township had knowledge of the apartment use. 5. Before purchasing the Premises, Applicants did not determine or even investigate whether the Premises could be used as apartments; therefore, any monetary expenditures of Applicants were not made in good faith or innocent belief or reli~mce that the Premises could be used as apartments.
