This is a rear-end automobile accident in which liability is conceded. The sole issue is
the extent of damages.
Both parties have sought stipulations concerning the authenticity of records. Expediting
the testimony in this case could result in a trial as short as one day. The usual number of juror
challenges will pertain.

I. NATURE OF ACTION
Motor Vehicle Accident:
Defendant, Eric Lay breached his duty
of care to Plaintiffs by driving his motor vehicle into the rear of
Plaintiffs' stopped motor vehicle.
II. SALIENT FACTS
On or about March
1995 on or about 8:00 a.m.. Plaintiff,

Mary Welker was stopped at the intersection of State Route 0641 and
State Route 3005, Oak Rd. in North Newton Township, cumberland
County, when Defendant Eric Lay crashed his Ford 150 pickup truck
into the rear-end of Plaintiff Mary Welker's vehicle.

II I . DAMAGES
As a result of this motor vehicle accident, Plaintiff Mary
Welker has suffered, among other things, acute cervical strain,
rotator cuff tear of the right shoulder which has been surgically
repaired resulting in permanent loss of range of motion, as well as
traumatic anxiety, depression, sleeplessness and continuing
headaches.
Plaintiff expects to introduce a summary of unpaid
medical bills totaling $ 2,019.60.
In addition, plaintiff Mary
Welker is seeking compensation for pain and suffering and loss of
life's pleasures. Plaintiff, Robert Welker is seeking compensation
for his loss of consortium.
IV. LEGAL ISSUES
Defendant has stipulated to liability. It is expected that
Defendant will stipulate to the admissibility of a summary of the
unpaid medical bills and medical records prior to trial.
V. EXPERTS
Plaintiff intends to present the videotape testimony of
treating orthopaedic surgeon, David C. Baker, M.D.

GEORGE H. EAGER AND SUBMITS THE FOLLOWING PRE-TRIAL CONFERENCE
MEMORANDUM PURSUANT TO LOCAL RULE.
I. STATEMENT OF THE DEFENSE ON LIABILITY AND ON DAMAGES
The above-captioned action arises from an automobile
accident which occurred on Monday, March 27, 1995 at
approximately 8:05 a.m. near the intersection of Oakville Road
(State Route 3005) and State Route 0641 in North Newton Township
in Cumberland County, Commonwealth of Pennsylvania. On that date
and time, both Plaintiff Mary Welker and Defendant were headed in
a westerly direction. Plaintiff Mary Welker was stopped at a
stop sign governing the aforementioned intersection. Defen~ant,
Eric Lay, noticed that Plaintiff was stopped and attempted to
brake his vehicle, but was unable to do so and rear-ended the
Plaintiff Mary Welker.

The Plaintiff Mary Welker alleges that she has suffered
acute cervical strain, rotator cuff tear of the right shoulder,
traumatic anxiety, depression, sleeplessness and headaches as a
result of this accident. Plaintiff Robert Welker alleges that he
has been deprived of the companionship, care, services, earnings
and consortium of his wife.
II. ISSUES INVOLVED ON LIABILITY AND DAMAGES

The above wa. seen for an orthopaedic evaluation on September 2. 1997.
The following history was obtained.
H:r8TORY
Ms. Welker is a 54-year-old right handed lady who injured the right shoulder
on J/~7/95 in an MVA. She was the reetrained driver of a 1981 Ford station
wagon that was rear-ended at the corner of Rt. 641 and Oakvil1e Road in
Cumb.rland county. The back of the front seat broke. Consciousness was not
lost. "The impact was so hard I thought my arm was broken. The pain stayed
then.
She was transported by ambulance to Carlisle Hospital. Treatment
conshted of a shoulder x-ray. "I don't know if they x-rayed my neck." A
bruise was diagnosed. The pain did not ease. A referral was made to Dr.
aaker.
Rehab was ordered. Exercises, heat and electrical stimulation were
used. This gave some relief. "It helped my neck." An MRI was ordered of the
right shoulder. A rotator cuff tear was diagnosed. Dr. Baker repaired the
cuff in August 1995. "He said he also removed several spurs that were
going into the muscle." Surgery gave relief to the shoulder. Neck pain
remained. Therapy was initiated after surgery. "They worked with my arm
until I got back range of motion."
Currently pain is in the back of the neck and trapezial area on the right.
Turning the head causes a "gritty" sensation. Headaches are frequent at the
posterior base of the head. The right shoulder is "achy feeling" at times.
"It bothers me if I use it a lot." Range of motion is limited. Cold. damp
weather causes a slight increase in symptoms. Sleep is disrupted from neck
and shoulder pain. The neck and right shoulder are stiff in the morning for
a couple of hours. Pain medication is taken when the condition is severe.
Household and personal chores are restricted. She cannot lift. The
grandchildren help carry laundry. She cannot hang clothes on a line.
Ms. Welker is not employed. Nor was she working at the time of the accident.

Her opinion is the condition has plateaued. Bending over, raising

She is married and has one grandchild living with her currently.
Smoking and alcohol uae is denied.
Ms. Welker arises at 0600 hours. Household chores are done. Grocery
shopping is done some days. She can cook the meals. Bedtime is 220 hours.
Current medications include Humulin 42 unitR. Glipizide 10 mg bid, Reglan
400 mg daily, Accupril 20 mg daily, Prempro 0.625 mg daily, calcium and
vitamins.
No history of prior neck or right shoulder discomfort.
PHYSICAL EXAMINATION
She is quite cooperative. The records were available including the films.
Neck motion was full with normal rhythm. She has tenderness over the right
lower lateral masses and C6 spinous process. Mild amount of left
mid-trapezial tenderness was present. No right trapezial triggering is
evident. The scapulae function normally. Shoulder elevators and depressors
are normal.
I check the left shoulder first. That is her normal side. And that was done
to get her acquainted with the exam on the opposite side. There is a
standard anterior shoulder incision on the right. The rotator cuff is intact
with all testing. There is no instability. She actively abducts to a right
angle. Internal rotation is lacking by about five to six inches compared to
the left side. External rotation. forward flexion, extension are normal. No
instability, cracking, or tenderness are evident about the right shoulder.
The AC joint is okay.
I reviewed the MRI films of the right shoulder and they show a tear of the
rotator cuff. Cervical spine films of 9/29/95 show a congenital fusion of
the posterior elements of C2-3 and that is a common variation. She does have
some evidence of a KlipDel-Feil impression of C1. The first and second
cervical vertebrae structure on open mouths films are normal.
I went through the extensive x-ray file including shoulder and neck x-rays.
Neurologic evaluation of the upper extremities is normal. Reflex absent at
the elbows. There is normal strength in the uppers at all levels. No
sensory deficit is noted in the arms nor is there any atrophy in the arms.
Reflexes are absent at the knee and ankles.
Gait is normal. It is heel to toe. Balance is fine. Again. she was able to
sit okay during the interview portion of the evaluation.

RE: Mary Welker
A Med-X assessment was done of strength in the extensor muscles of the neck.
She handled up to 76 inch pounds at her maximum of 63 degrees of flexion.
She was projected to handle 234 inch pounds. The normal forward flexion is
126 degrees. The curve was ascending indicating strength was properly
employed in the testing.
We tested her right shoulder isokinetically on the Lido machine. The left
and right side were compared in flexion and extension and they were
comparable in flexion and extension. Total work ~as slightly more on the
left than right, however, she had only done the right side in 9 seconds while
she handled 16 seconds on the left. In abduction and adduction of the
shoulders strength was 9 pounds left and 5 pounds right. In adduction they
were comparable. Tutal work showed adduction of 9 foot pounds on the left, 4
on the right and in abduction 10 and 8 re~pectively. However the times that
she had performed these tests reflect essentially the strength'is comparable.
In going through external and internal rotation. strength is close.
Surprisingly in external and internal rotation she endured longer on the
right than the left.
What does this all mean? Well. it means that she has a neck strain with some
weakness in the neck. There is some myofascial element and a mild frozen
shoulder is noted on the right. None of these conditions are serious, nor
would they preclude her from working. The shoulder repair surgery did very
well. There is some mild restriction of motion and it looks like that is
what she is going to have. She mentions a lot of restrictions that I cannot
find. I would classify her condition as mild but with respect to the neck
and right shoulder. She has excellent strength in the arms. The neck problem
would be classified as mild.
DIAGNOSIS
The diagnosis is chronic neck strain; post-operative status repaired rotator
cuff tear, right, with partial frozen shoulder.
DISCUSSION
The point is she has a chronic condition and the condition is not as marked
as she professes. I recommend the neck range of motion and strengthening
program that she can do on her own as well as continued maximal, comfortable
use of the shoulder and the shoulder exercises and that is about it.

1. Plaintiffs Mary Welker and Robert Welker, husband and wife,
are adult individuals who reside at 207 Running Pump Road, Newville,
Cumberland county, Pennsylvania.
2. Defendant Eric Michael Lay is an adult individual who resides
at 474 Crossroad School Road, Carlisle, Cumberland county, Pennsylvania.
3. Defendant Leonard S. Lay is an adult individual who resides at
474 Crossroad school Road, Carlisle, cumberland county, pennsylvania.
COUNT ONB - NBGLIOBNCB
MARY WBLKBR V. BRIC MICHABL LAY
4. Paragraphs 1 through 3 of this Complaint are incorporat.ed
herein by reference as if set forth at length.
5. On or about March 27, 1995, at or about 8:00 A.M., Plaintiff
Mary Welker, who was operating a 1982 Ford Granada station wagon, was
stopped at the intersection of SR 0641 and SR 3005 Oak Road in North
Newton Township, Cumberland County, Pennsylvania.
6. At said time and place, Defendant Eric Lay was operating a
1992 Ford F-150 pickup Truck which struck the rearend of plaintiff Mary
Welker's vehicle.
7. Defendant Eric Lay was negligent and careless in the operation
of said motor vehicle for the following reasons which include, but are
not limited to:
a. failure to keep said motor vehicle under proper control;
b. failure to operate said motor vehicle with due care for
the rights and safety of Plaintiff Mary Welker;
c. operating said motor vehicle at a hig\l and excessive rate
of speed under the circumstances;

d. operating said motor vehicle at a speed of 50 to 55 miles
per hour in a 40 mile per hour zone;
e. failure to maintain control of said motor vehicle so as
to insure his ability to stop within his assured clear
distance;
f. disregarding the rights, safety, point and position of
other vehicles on the road, including that of Plaintiff
Mary Welker,
g. failing to stop in time to avoid a collision with the
motor vehicle operated by Plaintiff Mary Welker,
h. violating Title 75 P.S.A. 53714 which was enacted
specifically for the protection of persons such as the
Plaintiff, Mary Welker, and/or
i. negligence per se.
8. As a direct and proximate result of Defendant Eric Lay's
negligence, carelessness and/or unlawfulness and not due to any act or
failure to act on the part of Plaintiff Mary Welker, said Plaintiff
suffered great pain and sUffering, traumatic anxiety, depression, shock
to her nervous system and other injuries, some or all of which may be
permanent including, but not limited to, rotator cuff tear of the right
shoulder, acute cervical strain, tenderness of neck muscles, tenderness
of sternocleidomastoid and posterior strap muscles, tenderness in the
right proximal humerus with contusion, decreased range of motion and
limitation of movement of her right arm, pain in her shoulder and
collarbone area, intense and persistent headaches, and protracted
periods of difficulty sleeping.

9. As a direct and proximate result of Defendant Eric Lay's
negligence, carelessness and/or unlawfulness, Plaintiff Mary Welker has
been in the past, and may continue to be in the future, unable to attend
to her usual habits, customs, vocations and enjoyment of life.
10. As a direct and proximate result of Defendant Eric Lay's
negligence, carelessness and/or unlawfulness, Plaintiff Mary Welker has
been in the past, and may continue to be in the future, required to
undergo medical treatment and procedures.
11. As a direct and proximate result of Defendant Eric Lay's
negligence, carelessness and/or unlawfulness, Plaintiff Mary Welker has
been in the past, and may continue to be in the future, required to
expend various sums of money for medicine and medical treatment and
procedures as a result of her injuries.
12. As a direct and proximate result of Defendant Eric Lay's
negligence, carelessness and/or unlawfulness, Plaintiff Mary Welker has
been unable to engage in any occupation and therefore may in the future
continue to suffer a loss of income and/or loss of earning capacity.
13. Plaintiff Mary Welker may recover damages under the full tort
option provided by the Motor Vehicle Financial Responsibility Law Title
75, Pa. C.S.A. S 1705, at seq.
WHEREFORE, Plaintiff Mary Welker hereby demands judgment in her
favor and against Defendant Eric Lay in an amount which exceeds the
jurisdictional amount requiring arbitration.
COUNT II - NEGLIGENT ENTRUSTMENT
MARY WELKER V. LEONARD 8. LAY

15. Said automobile driven by Defendant Eric Lay was owned by
Defendants Eric Lay and Leonard S. I.ay.
16. Defendant Eric Lay was operating said vehicle at the said time
and place and within the scope of the consent of Defendant Leonard S.
Lay.
17. Defendant Leonard S. Lay negligently and carelessly entrusted
his automobile to Defendant Eric Lay when he knew or should have known
that Defendant Eric Lay was a careless and reckless motor vehicle
operator so as to praClcnt an unreasonable risk of harm to others upon
the highway and Plaintiff Mary Welker.
18. As " direct and proximat.e result of the negligence and
carelessness of Defendant Leonard S. Lay, Plaintiff Mary Welker suffered
severe personal injuries and other damages as set forth herein.
WK2RErORE, Plaintiff Mary Welker hereby demands judgment in her
favor and against Defendant Leonard S. Lay in an amount which exceeds
