CIVIL ACTION - LAW SELENA WOODSON, Defendant COMPLAYNT AND NOW comes the plaintiff, ORCHARD APARTMENT ASSOCIATES, t/d/b/ a ORCHARD APARTMENTS, by and through its attorneys, cunningham & Chernicoff, P.C. and files this Complaint in ejectment and in assumpsit and in support thereof avers the following: 1. plaintiff, ORCHARD APARTMENT ASSOCIATES, t/d/b/a ORCHARD APARTMENTS, is a limited partnership which is registered with the pennsylvania Department of State having a registered address of 2204 Cedar Run Drive, Camp Hill, Cumberland county, Pennsylvania. 2. The Defendant, SELENA WOODSON, is an adult individual who resides at 2209-A Cedar Run Drive, Camp Hill, Cumberl&nd county, Pennsylvania. 3. At all times material to Plaintiff's cause of action, Plaintiff, ORCHARD APARTMENT ASSOCIATES, tldlbla ORCHARD APARTMENTS, has been the legal owner of the tract of land on which the building in which the Defendant resides is sited. 4. On or about May 5, 1992, Defendant executed a Lease Agreement by the terms of which the Defendant leased from the Plaintiff an apartment located at 2209-A Cedar Run Drive, camp Hill, Cumberland County, Pennsylvania for an initial term beginning June 1, 1992 and ending June 30, 1993, after which initial term, the Lease continued on successive terms for one (I) month each. A true and correct copy of the original Lease Agreement, together with the Riders, for 2209-A Cedar Run Drive, Camp Hill, Cumberland County, Pennsylvania are attached hereto, made part hereof and are marked Plaintiff's Exhibit "P-1". 5. The Defendant agreed to abide by the terms set forth in the Lease Agreement which specifically states in Paragraphs 3 and 5 of the Lease that rent is due and owing on the first (1st) day of each month and if rent is not paid by the fifth (5th) day of each month, a late fee of One and 00/100 Dollar 2 ($1. 00) per day, not to exceed Thirty and 00/100 Dollars ($30.00) per month was agreed to be paid by the Defendant. 6. The Defendant also agreed to abide by the terms set forth in Paragraph 23 of the Lease Agreement which provides that the Defendant could be evicted for failure to abide by the terms of the Lease and specifically if Defendant did not promptly report and supply all required information concerning income and family composition of the Defendant's household as required by Paragraph 16 of the Lease Agreemsnt. 7. Plaintiff receives rent subsidies under the provisions of the Fair Housing Act of 1937 for qualifying tenants, under a program commonly referred to as the Section 8 Program. The amount of rent subsidy received for each tenant and the tenant's share of the rent is based upon the tenant's income and household composition. Child support is defined under the applicable HUD regulations as income for the purpose of calculating rent. 8. On May 1, 1995, Defendant began receiving child support, but failed to advise Plaintiff of the receipt of the support. 3 (a) The Defendant's failure to report to Plaintiff an inorease in her inoome as the result of Defendant's reoeipt of ohild support as required by Paragraphs 16 and 23 of the Lease Agreement, whioh in the opinion of the Plaintiff, represents a substantial violation of Paragraphs 16 and 23 of the Lease Agreement, the Rules and Regulations of the apartment complex, and HUD Regulations set forth in Seotion 4-18 of the HUD Technioal Handbook, Transmittal 4350.3, all of whioh oonstitutes a material non-oompliance with the terms of the Lease Agreement as that term is defined under Paragraph 23 of the Lease Agreement and the applicable HUD Regulations. (b) Defendant's failure to pay rent in a timely manner in acoordanoe with Paragraphs 3 and 5 of the Lease Agreement in the months of Maroh, 1996, April, 1996, May, 1996, and August, 1996, all whiCh, in the opinion of the Plaintiff, represents a substantial violation of the terms of the Leas~ Agreement, Rules and Regulation~ of the apartment complex and HUD Regulations, specifically 1\ Paraqraphs 3 and 5 of the Lease Aqreement and section 4-18 of the HUD Technical Handbook, Transmittal 4350.3. The Defendant's actions also represent a material non-compliance with the terms and conditions of the Lease Aqreement as defined under HUD Requlations and Paraqraph 23 of the Lease Aqreement. (c) The Defendant's failure to pay rent for the month of March, 1996, which in the opinion of the Plaintiff, represents a substantial violation of Paragraphs 3 and 5 of the Lease Agreement, the Rules and Regulations of the apartment complex, and HUD Regulations set forth in Section 4-18 of the HUD Technical Handbook, Transmittal 4350.3, all of which constitutes a material non-compliance with the terms of the Lease Agreement as that term is defined under Paragraph 23 of the Lease Agreement and the applicable HUD Requlations. 18. The Plaintiff has not defaulted in its responsibility to provide a habitable premises to the Defendant and is of the opinion and therefore avers that the 7 ...-........ " - premises being occupied by the Defendant are in such a state as not to violate the applied warranty of habitability owed by the Defendant to the Plaintiff. 19. On August 6, 1996, the Defendant was properly served by the Plaintiff, at the Defendant's residence, with a Notice of Proposed Termination of her Lease Agreement. The Notice of Proposed Termination was served in accordance with HUD Rules and Regulations and the Pennsylvania Landlord/Tenant Act. A true and correct copy of the Notice of Proposed Termination is attached hereto, made part hereof and is incorporated herein by reference as Plaintiff's Exhibit "P-2". 20. On August 19, 1996, the Defendant was properly served by the Plaintiff, at the Defendant's residence, with a Notice to Quit. The Notice to Quit was served in accordance with HUD RUles and Regulations and the Pennsylvania Landlord/Tenant Act. A true and correct copy of the Notice to Quit is attached hereto, made part hereof and is incorporated herein by reference as Plaintiff's Exhibit "P-3". 21. The Defendant, although requested to do so by the Plaintiff, has refused to surrender 2209-A Cedar Run Orive, 8 COUNT II - IN ASSUMPSIT 23. Plaintiff incorporates by reference Paragraphs 1 through 22 of the Complaint as if more fully set forth herein. 24. Defendant has failed to pay rent to the Plaintiff since the filing of the Appeal of this matter from the District Justice Judgment. 25. However, she denies that this level of rent was based solely on her receipt of child support. 12. Admitted in part and denied in part. Defendant admits that as a result of the retroactive recalculation of her rent, she executed a rent arrearage payment agreement in the amount of $461.80 payable at the rate of $50.00 per month. However, Defendant did not believe she owed this amount, because she believed it improperly included retroactive late fees for the period of time she had received the child support pass-through. Defendant does not recall whether she had paid her March, 1996 rent at the time of the agreement, and therefore denies that she had failed to pay it. 13. Denied. After reasonable investigation, Defendant is without knowledge or information sufficient to form a belief as to whether her rent was paid in a timely manner for the months of March, April, May and August, 1996. 14.
