COMPLAINT
1.) plaintiff, Eli Cekovict is a partner of Joseph
Cekovich, Jr., who own and operate a Mobile Home Park in Silver
spring Township, cumberland County, Pennsylvania.
2.) Defendants, William C. Browning and Elizabeth
Browning, are individuals who own a mobile home approximately 14
by 65 feet which is installed on Lot 26 of said mobile home
court.
3.) In August, 1996, defendants commenc~d construction of
an addition to their mobile home whioh consisted of a permanent
one story frame structure approximately 8 by 23 feet.
4.) Defendants commenced construction without the approval
and without the knowledge of plaintiff.
5.) When plaintiff first noticed the construction in
August, 1996t he immediately notified defendants to cease
construction and remove the portion then completed as the
construction violated the terms of the lease.
6.) The lease between the parties was an oral month to
month lease which commenced when first defendants occupied Lot
26t approximately 3 years prior ~o start of construction.

7.) The defendants assumed the lease of Edyth G. Dodson
and moved into the mobile home belonging to Edyth G. Dodson whJch
they now own.
8.) Plaintiff has written Park RUles which are posted on
the premises and which were signed hy Edyth G. Dodson July 1,
1992t a copy of which is attached as Exhibit A.
9.) Defendants were given a copy of said rules and are
aware of the terms thereof.
10.) Defendants built the addition without approval of the
plaintiff which is in violation of the Park RUles and the size of
the addition exceeds 10 by 12 feett which is the maximum size ot
outbuildings.
11.) Defendants commenced construction without obtaining a
building permit required by silver Spring Township ordinance.
12.) Defendants were notified to cease construction and to
remove the portion of the addition then in place at least 5 times
between August and October, but they ignored plaintiff an~
continued construction; they have violated the Park Rules on more
than two occasions within a 6 month period.
13.) On October 14t 1996, Silver Spring Township notified
plaintiff that the construction was not authorized by the
Township and no building permit had been granted for the
addition, attached as Exhibit B.
14.) Silver Spring Township has threatened to hold
plaintiff responsible for permitting defendants to build without
a permitt as its ordinance imposes liability on the owner of the

land on which a tenant builds without a permit.
WHEREFORE, defendants have forfeited their rights under the
lease and plaintiff demands judgment in ejectment with costs.

You have constructed or have permitted construction of an
addition to a home without obtaining a building permit.
You are hereby notified that any and all work on any building,

No further action will be necessary by the township if the
said addition is removed, or a permit obtainedt by January It 1997.
Should the addition violation not be remedied by this date, we will
initiate legal remedies to correct the problem,
All persons shall have the right to appeal the building
officials decision with the procedures set forth in said ordinance.
A copy of the ordinance may be examined at the silver spring
Township Municipal Building, 6475 carlisle pike, Mechanicsburg, pa
during regular business hours.
Any person, firm or corporation who shall violate any
provision of this code, or who shall fail to comply with any of the
requirements thereof, or who shall erectt constructt alter or
repair a building or structure in violation of an approved plan or
directive of the code official, or of a permit or certificate
issued under the provisions of this code, shall be guilty of a
summary offense in proceedings instituted before a District
Justice, punishable by a fine not exceeding Three Hundred ($300.00)
Dollars, and in default of payment of such fine to undergo
imprisonment in the cumberland county prison for a period not
exceeding thirty (30) days. Each day that a violation continues
after due notice has been served shall be deemed to be a separate
offense.
This letter is being mailed both certified and first class.
If first class letter is not returned to the township by the postal
service it will be assumed that you have received it.

the defendants commenced construction of an addition to their
mobile home which can be bolted to the existing mobile home and
removed. It is denied that this is a permanent one-story frame
structure.

addition was without the knowledge and approval of the plaintiff.
The previous owner of the mobile home park, Joseph Cekovic, Sr.,
had given the defendants permission to build this addition to their
mobile home.

addition was in violation of the terms of the lease since the
previous owner, Joseph Cekovic, Sr. had given the defendants
permission to build this addition.

It is admitted that the lease between the
parties is an oral month-to-month lease, however, the Mobile Home
Park Rights Act is by law a part of the l~ase agreement and the
plaintiff must comply with all parts of the Mobile Home Park Rights
Act.

paragraph four of this pleading, the defendants were given
permission to build this addition by the previous owner, Joseph
Cekovic, Sr. To the extent that permission was given there is no
violation of the park rules referred to in the plaintiff's

11. Admitted in partt denied in part. It is admitted that
the defendants commenced construction without obtaining a building
permit, but it is denied that the Silver spring Township required
a permit. By way of further answer, the defendants went to the
Township prior to commencing construction and were advised by the
Township if construction costs would not exceed $500.00 no permit
was required. Construction costs did not exceed $500.00.
12. It is admitted that the plaintiff notified the defendants
that they were to cease construction and to remove that portion
which they had already constructed, but it is averred by the
defendants that the plaintiff was estopped from compelling them to
cease construction after having previously granted them permission
to do the construction. It is specifically denied that the
defendants have violated the park rules on more than two occasions
within a six (6) month period.
13. Admitted. By way of further answer, upon receipt of this
notification and the stop work order the defendants ceased
construction and have not continued with any construction pending
the outcome of this matter.
14. Denied. Defendants are without knowledge or information
to either affirm or deny this allegation despite reasonable
investigative efforts and therefore it is denied and strict proof
thereof demanded at time of trial.
WHEREFORE, defendants pray that this Honorable Court will not
hold that the defendants have forfeited their rights under either
their lease or the Mobile Home Park Rights Act and further that the
Court will not grant the plaintiff's request for jUdgment and
ejectment in this matter.
