In June of 1996, the plaster ceiling of the first floor fumily room directly below the msster bathroom shower began to crock, and water leaked through onto the floor. 7. In June of 1996, inspection by the Plaintiff's builder, Roger Nelson, and by on experienced ceramic tile contrnctor, lIarold Decker, was mnde. The water leak was due to leakage through the shower base due to its improper design And installation. 8. In July oC 1996 the master bathroom shower Cloor was broken up and removed. A solid vinyl shower floor liner WIIS installed, 0 new hose was poured, and the bottom three coursell oC wall tiles were removed and replaced. The Plain- tiff hall photographs of the water damage and work in progress. On July 30, 1996, Nr. Decker's invoice Cor $1630.00 was paid in fuU by the Plaintiff. 9. The remaining two tile showers in this home have been ulled only a Cew On two occasions the Plaintiff, JOliN SON G. COYLE has seen water dripping the basement floor under the mudroom after its use. The third floor &hower yet received signiCicant use. times. through has not 10. The Plaintiff states that the Defendant, ROY NcLAIN breached their contract to provide a properly constructed shower that would not leak water and damage the Plaintiff's home. This is a breach of implied warrenty. 11. The Plaintiff, JOHNSON G. COYLE nlso states that the Defendsnt, ROY ~lcLAIN was negligent in choosing and/or supervising his subcontractor who installed the three shower bases. 12. The improperly designed and in"tulled shower buse was the direct cause oC the water leak in the Plaintiff's home, and the cuuse for expensive repairs. Additionally, the two remaining shower" with improper bases will need to be rebuilt in a like fa"hion before they cnn receive normnl use. The cost of this repair is estimated at $1630.00 euch. ROY McLAIN, d/b/a ADVANCED KITCHENS and BATH, CIVIL ACTION.LAW Defendant DEFENDANT'S ANSWER WITH NEW MAlTER AND COUNTERCLAIM AND NOW, comes the Defendant, Roy McLain, trading and doing business as Advanced Kitchens and Bath, by and through is attorney, Michael A. Scherer, Esquire, and respectfully responds to the Plaintiff's Complaint as follows: I. Admitted. 2. Admitted. 3. Denied. The Defendant believes and therefore avers that the parties entered into an agreement whereby the Defendant would install a kitchen in the Plaintiffs home on November 3, 1993, and that the parties entered a subsequent agreement on August 9, 1994 regarding work the Defendant would do for the Plaintiff in the bathrooms and mud room of the Plaintiffs home. The remainder of the averments in this paragraph are admitted. 4. Admitted in part and denied in part. It is admitted that the Defendant hired a subcontractor to install the three shower bases in the Plaintiffs home. The Defendant believes that this work was completed August 16, 1994 and not in the spring of 1995. 5. Admitted. 6. Denied. After reasonable inve~tigation, Defendant is without knowledge or information sufficient to form a belief as to the truth of the averments contained in paragraph six of the Plaintiffs Complaint. 7. Denied. Defendant has no information regarding inspections done by Mr. Nelson and Mr. Dec.lcer. It is specifically denied that any water leakage that may have occurreo was due to any improper installation and design performed by the Defendant. 8. Denied. After reasonable investigation, Defendant is without knowledge or information sufficient to form a belief as to the truth of the averments contained in paragraph eight of the Plaintiff's Complaint. 9. Denied. After reasonable investigation, Defendant is without knowledge or information sufficient to form a belief as to the truth of the averments contained in paragraph eight of the Plaintiffs Complaint. 10. Denied. The Defendant performed the work in a good and workmanlike fashion and did not breach the contract in any way nor did he breach any implied warranty which may have been created. 11. Denied. The Dcfendant was not negligent in choosing and/or supervising the subcontractor who worked on this job for the Defendant. 12. Denied. It is specifically denied that the Defendant was responsible for any improper design or completed an improper installation of any of the work Defendant agreed to perform for the Plaintiff. To the extent there may be leaks, they have occurred through no fault of the Defendant. WHEREFORE, the Defendant respectfully requests that this Honorable Court enter judgment in his favor and against the Plaintiff. NEW MAlTER 13. The July 25, 1995 contract signed by the parties settled all outstanding claims between the parties relative to this matter. 14. The Plaintiff breached the contract between the parties by refusing to allow the Defendant from completing the work which was under way at the Plaintill's home 15. The Plaintiff hired a contractor to complete the work which the Plaintiff would not permit the Defendant to complete, and any leaks which may have occurred and resulting damage was caused by the poor and unworkmanlike performance of said contractor. 16. Any leaks which may have occurred and resulting damage to the Plaintiffs home were due to the house settling and/or the incorrect design or construction of other parts of the home. 17. Inspections of the Defendant's work were performed by the supplier of the materials used and the distributor of the materials used and both inspections indicated that the Defendant performed his work in a good and workmanlike manner. WHEREFORE, the Defendant respectfully requests that this Honorable Court enter judgment in his favor and against the Plaintiff. COUNTERCLAIM 18. The Plaintiff has failed to pay the Defendant $5,046.50 for amounts due pursuant to the parties' agreement for the Defendant to perform work on the Plaintiffs kitchen, mud room and bathrooms in the Plaintill's home. Inspections of the Defendant's work were performed by a biased party with a veated interest in upholding the reputation of the Defendant. The inspectors snd the Defendant had had a long term business relationship. and colluded together to mislead the Plaintiff. When 1 sought the opinions of five other experienced and unbiased con- tractora. each said that the job was unworkmanlike. By way of further denial, the Defendant's inspectors did find some problems, which are evident on close reading of their report. COUNTERCLAIM 18. Denied. The Plaintiff promptly paid all amounts agreed to. Specifically the July 25. 1995 contract referred to in item 13 settled all outatanding claime between the parties relative to this matter. In negotiations over this matter, the $5,046.50 now demanded by the Defendant was offset by even greater cost borne by the Plaintiff in repairing the Defendant's unworkmanlike job. The signed July contract supercedes any claim noW being made by the Defendant.
