Cumberland County Courthouse, South Hanover Street, Carlisle, PA
17013, to enforce the Court judgment of $174,281.61 obtained by

NOTICE OF OWNER'S RIGHTS

To Prevent this Sheriff's Sale you must take immediate action:
1. The sale will be cancelled if you pay to mortgagee the
back payments, late charges, costs and reasonable

2. You may be able to stop the sale by filing a petition
asking the Court to strike or open the judgment, if the
judgment was improperly entered. You may also ask the

4. If the amount due from the buyer is not paid to the
Sheriff, you will remain the owner of the property as if

6. You may be entitled to a share of the money which was

COMPLAINT IN MORTGAGE FORECLOSURE
],. Plaintiff conti Mortgage Corporation is a corporation with
a place of business at 500 Enterprise Road, Horsham, PA 19044.
2. Defendants Robert J. Gardner and Donno L. Gardner are
believed to be residing at 317 Erford Road, Camp Hill, PA 17011.
3. On August 24, 1995, the defendants made, executed and
delivered their note and mortgage to Resource One Consumer Discount
co., Inc. (hereinafter Resource One) in the amount of $142,000.00
with interest at annual rate of 10.49 percent, payable in monthly
installments of principal and interest of $1,297.87 for a term of
180 months. A copy of the mortgage is attached hereto as Exhibit
"A.II
4. The mortgage was recorded in the Office for the Recorder
of Deeds for Cumberland County, Pennsylvania in Mortgage Book
1281, page 79, and is on the premises at 317 Erford Road,
East Pennsboro Township, cumberland County, PA legally described in
the mortgage attached hereto as Exhibit "A."
5. The mortgage documents were subsequently assigned to
plaintiff who is the current holder of the mortgage. A copy of the
assignment is attached hereto as Exhibit liE."
6. The defendants are the real owners of the land subject to
the mortgage and their last known mailing address is set out in
paragraph 2 above.
7. Default has been made by the defendants in the payment of
the monthly installments since 3anuary 30, 1996 and as of May 24,
1996 the account is delinquent $5,451.04 ($1,297.87 per month
for the period January 29, 1996 through May 24, 1996; late charges
in the amount of $259.56); whereupon, under the terms of the
mortgage, the entire balance of principal became due and payable.
8. In accordance with the provisions of the mortgage
documents and/or the Act of 3anuary 30, 1974, P.L. 13, NO.6,
section 403 (41 P.S. section 403), a Notice of Intention to
Foreclose Mortgage dated April 1, 1996, was forwarded separately
to both defendants on or about April 1, 1996. An Affidavit of
Notice is attached hereto as Exhibit "B" and a copy of the notice
is attached hereto as Exhibit "c." The default has not been cured.
In the alternative, the notice required by the aforesaid Act does
not apply in this instance since the original amount of the
mortgage was in excess of $50,000.
9. In accordance with the provisions of the Act of December
23,1983, P.L. 385, No. 91, section 2 (35 P.S. section 1680.402c.),
a Notice of Homeowner's Assistance Emergency Act of 1983 dated
April 1, 1996 was forwarded separately to both defendants on or
about April 1, 1996, since the mortgage was more than sixty (60)
days contractually delinquent. An Affidavit of Notice is attached
hereto as Exhibit liB" and a copy of said notice is attached hereto
as Exhibit "D." More than thirty-three (33) days have elapsed
since the mailing of said notice and no notice has been received by
plaintiff advising that defendants have applied for assistance, nor
have defendants arranged for a face to face meeting with a
representative of the plaintiff during said period.
11. The mortgage is in default because of defendants' failure
to make the payments due and the following amounts are due on the
mortgage:

12. The attorneys' fees set forth above are in conformity with
the mortgage documents and Pennsylvania law, and will be collected
in the event of a third-party purchaser at sheriff's sale. If the
mortgage is reinstated prior to sale and/or if this matter is
contested, reasonable attorneys' fees will be charged.
WHEREFORE, the plaintiff prays the Court to enter jUdgment for
foreclosure and sale of the mortgaged property in the amount of
$158,180.93 as set forth above, together with costs, interest
thereon from May 25, 1996 at the rate of $40.75 per day; late
charges from M~y 25, 1996 at the rate of $64.89 per month and
all other amounts advanced by plaintiff prior to the sheriff's
sale of real property and properly chargeable in accordance with
the terms of the mortgage.
