STIPULATION AGAINST LlF..NB
THIS AORBBJUlNT made the JIi3t day of Dch'la<.v, 1996, by
and between RUSSELL C. GOODLING, of 2920 Dickinson Avenue, Camp
Hill, pennsylvania, hereinafter referred to as contractor, AND
RUSSELL C. GOODLING, of 2920 Dickinson Avenue, Camp Hill,
Pennsylvania, hereinafter referred to as Owner, whereby the
former undertook and agreed to erect and construct a single-
family residential dwelling on that certain lot of ground situate
in East Pennsboro Township, cumberland County, Pennsylvania,
being Lot 1-2, Pealer Land Development Subdivision Plan, Phase I,
as recorded in the Cumberland county Recorder of Deeds Office in
Plan Book 46, Page 4C. Being the same premises which Floribunda
Associates Limited partnership by Deed dated July 23, 1992 and
recorded July 30, 1992 in the Cumberland County Recorder of Deeds
Office in Deed Book "U", Volume 35, Page 713, granted and
conveyed unto Russell C. Goodling.
NOW THBREFORB, THIO AGREBMENT WITNESSETH I That the said
contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under thsm, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, tor, towards, in, or about the erection and
construction ot the said buildings on the lot above described,
and the said Contractor, tor themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, tile, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving tho right of lien, shall be an independent
covenant.
