2. True.
3. True, on the grounds that the television worked properly.
4. False, 1 agreed to purchase the television for $550.00. I gave a personal check in the
amount of $500.00 and agreed to pay the remaining $50.00 after the television was in my
home and determined to be functioning properly.

6. True, I informed Plaintiff of stop payment of my personal checkon July 3, 1996 at 9:30am
due to the malfunction of the television. It smoked immediately after being plugged in at
my home.

9. True, I do have possession of the television, but I have not refused payment to Plaintiff.. I
have attempted to make good on the pur~hase. My several attempts to work out a resolve
regarding the repairs, that 1 paid for, have been refused by the PlaintilT. I even agreed to
pay the agreed amount for the television and split the repair bill, but the I'laintilT relused
any part of the rcpair bill. 1 ask;:d the Plaintil1"to come to my home to witness for herself
the problems with the television but, she stated that it was too far to travel.

A. In storalle before the purchase, and had been for quite some time.
B. Was not in workinll condition. '.
You cannot rent a television that is not in workinll condition.
This matter could have been resolved lonll allo. The PlaintilTpromised me a television in Ilood
workinll condition for $550.00. This televisioll was in need of repair in the amount of $179.62.
The PlaintilTauthorized this repair. After I told the plaintifflhe cost of the repair, she refused to
deduct it from the purchase price of the television. I then offered to split the repair cost, allain she
refused.
After several attempts to settle this matter I still haven't received any cooperation from the
PlaintilT. The facts are that I was sold a television under the false pretense that it was in working
condition. I paid for repairs that I should not have had to pay. 1 am willing to pay for the
television but, I should be reimbursed for the repairF.

COMPLAINT
1. plaintiff Shirley Miller is an adult individual who
resides at 8 A Richland Lane, Camp Hill, PA 17011.
2. Defendant Joseph ciccocioppo is an adult individual who
resides at 401 Litton Hall Road, Duncannon, PA 17020.
3. On July 2, 1996, the plaintiff sold a RCA 46 inch
television to Defendant for the sum of $550.00 pursuant to an
oral agreement.
4. Defendant paid for the television with a $500.00 personal
check and promised to pay the balance of $50.00 to plaintiff
shortly thereafter. Upon said payment, Defendant took possession
of the television on July 2, 1996.
5. On July 2, 1996, plaintiff cashed the check at her bank
and received $400.00 in cash and deposited $100.00 in her
checking account.
6. On July 3, 1996, Defendant stopped payment of his check.
A true and correct copy of the returned check is attached hereto
as Exhibit "A" and made a part hereof.
7. Not long thereafter, plaintiff's bank demanded that she
reimburse them $500.00, the amount of Defendant's check, as a
result of Defendant's action of stopping payment of his check.
8. plaintiff's bank continues to demand such payment from
plaintiff. A true and correct copy of the bank's collection
letter is attached hereto as Exhibit "B" and made a part hereof.

9. Defendant has retained possession of the television since
July 2,1996 and has failed and refused to pay the agreed sum for
the television.
10. As a result of Defendant's actions, plaintiff has lost
the use, enjoyment and value of her television since July 2,
1996, which television has a reasonable daily rental value of
$4.20 based on an estimate of rental value obtained by plaintiff
from curtis Mathes, a company regularly engaged in the television
rental business in this area. A true and correct copy of the
estimate is attached hereto as Exhibit "c" and made a part
hereof.
WHEREFORE, plaintiff prays your Honorable court to enter
Judgment against Defendant for $550.00, plus the reasonable
rental value of $4.20 per day from July 2, 1996 until the date
payment is made by Defendant, interest at the statutory rate from
