STIPULATION AGAINST LIENS
WHEREAS, ANIL C, THAKRAR and NEEMA THAKRAR, and N.T,
MANAGEMENT, INC, of Cumberland County, pennsylvania,
(collectively the "Owner") the Owner of the hereinafter described
tract of land, have executed or are about to execute
contemporaneously herewith a contract with NYE CONSTRUCTION
COMPANY, INC, of 49 West Orange Street, Shippensburg, Franklin
county, Pennsylvania 17257, (the "Contractor") for improvements
to the premises located in Lower Allen Township, Cumberland
County, Pennsylvania, more particularly described on "Exhibit A"
attached hereto and made a part hereof (the "Premises") ,
NOW, October~, 1996, before any authority has been given
by said Owner to the said Contractor to commence work on said
Premises or to otherwise construct any improvements thereto, or
to purchase materials for the same, or to enter into any
contracts with any subcontractors, or materialmen, or to
authorize any purchases by or through any subcontractors or
materialmen, in consideration of the making of said contract with
the Owner and the further consideration of One Dollar ($1,00), to
Contractor paid by said Owner, and with the intent of all parties
to be legally bound hereby, it is agreed that no lien shall be
filed against the building or Premises or any part thereof, by
the Contractor or any subcontractor, or by any of the materialmen

BEGINNING AT A POINT along the eastern right-of-way line of
Woodland Street (a 50 foot private right-of-way) at the common
property corner of Lots #3 and #2. From said point along a
curve, curving to the left having a radius of 176.00 feet and an
arc length of 148,71, said curve also described as having a chord
bearing of North 39 degrees 44 minutes 41 seconds West and a
distance of 144.32 feet to a point; thence South 26 degrees 03
minutes 00 seconds West a distance of 1,00 feet to a point;
thence North 63 degrees 57 minutes 00 seconds West a distance of
93,84 feet to a point; thence North 47 degrees 43 minutes 17
seconds East a distance of 379.46 feet to a point; thence South
27 degrees 02 minutes 05 seconds East a distance of 252,00 feet
to a point; thence .South 47 degrees 06 minutes 45 seconds West a
distance of 254.59 to a point; thence South 74 degrees 27 minutes
38 seconds West a distance of 32,95 feet to a point. Said point
being the POINT OF BEGINNING,
The above described tract of land contains 1.7536 acres,
BEING a part of the same premises which Ralph S. Bailey and Carol
K. Bailey, his wife, and George S. Davis and Janet A. Davis, his
wife, by d~ed dated December 23, 1986 and recorded December 30,
1986, in the Office of the Recorder of Deeds in and for
Cumberland County, pennsylvania, in Deed Book K, Volume 32, Page
516, granted and conveyed unto Diversified-Wesley Drive Limited
partnership.
BEING known as Lot 3 as shown on a preliminary/Final Subdivision
Plan of the Wesley Plaza, recorded in the Cumberland County
Recorder of Deeds Office in Plan Book 70, Page 147,
