Wigbels, Esquire, and respectfully represents as follows in support of this Complaint I 1. The Plaintiff, Norrell Services, Inc., is a corporation engaged in the busineBs of providing short term and long term personnel and managed staffing, whose principle place of business is located at 1300 Market Street, Suite *2, Lemoyne, Pennsylvania, 17043. 2. The Defendant, Blue Mountain Search, is a company which is engaged in the business of finding employeeB for positions offered by its clients, whoBe principle place of bUBiness is located at 94 Motel Drive, Myerstown, Pennsylvania, 17067. 3. The Defendant, Allyson H. Schaeffer, is engaged in the business of finding employees for positions offered by its clients and is the owner of Defendant Blue Mountain Search. 4. On or about February 22, 1996, Plaintiff and Defendants entered into a contact which provided that Plaintiff would pay Defendants a flat fee of $2100.00 in exchange for Defendants' providing, and guaranteeing for six monthB, an individual to fill '",.. the position of sales associate for the Plaintiff. Said contract is attached as Exhibit A. 5. On February 21, 1996, Plaintiff paid Defendants $2100.00 for a six-month guarantee for the position of sales associate to be filled by M. Patrice Massey. I I Plaintiff on February 26, 1996. II 6. On April 26, 1996, Ms. Massey submitted her letter of II resignation. See attached Exhibit B. II II I I six-month guarantee contained in the contract. II I I failed to provide another sales associate to replace Ms. Massey i upon her resignation within the six-month guarantee contained in Ms. Massey commenced employment with 7. Defendants failed to provide a replacement pursuant to the 8. Defendants have breached the contract in that they have the contract. 9. Defendants' breach has resulted in a loss to Plaintiff of $2100.00, the cost of the contract. A claim is made therefore. 10. Defendants' breach has resulted in lost revenue to Plaintiff which would have been generated had a replacement been provided. A claim is made therefore. WHEREFORE, the Plaintiff, Norrell Services, Inc., demands judgment against the Defendants, Blue Mountain Search and Allyson H. Schaeffer, for the cost of the contract, lost revenue plus interest, court costs, and attorneys' fees as allowable by law, which amount exceeds that which requires compulsory arbitration. I have reached a difficult decision and would like to submit my resignation from Norrell. As per our contract, I am submitting written notice that my last day of employment would be May 28, 1996. I am sorry for the inconvenience and disappointment this will cause. When I accepted this position I really believed that this would be a long term career commitment. Unfortunately. I can not keep worklng for you past the above mentioned date. My reasons include a very high frustration level due to the client base I am worklng with. tensions within the office and feeling that no matter what I do I will never do enough.
