THIS AGREEMENT made this
CAROLE A. DULL (hereinafter referred to as "WIFE") and GARY A. DULL, (hereinafter
referred to as "HUSBAND").
WITNESSETH:
WHEREAS, HUSBAND and WIFE were lawfully married on March 22, 1976, in
Newville. Cumberland County, Pennsylvania; and were separated on October 23, 1996.
HUSBAND filed a Divorce Action in Cumberland County. Pennsylvania, on November 6, 1996,
docketed at 96-6071 Civil Tenn,
The parties hereto agree and covenant as follows:
I.
The parties intend to maintain separate and permanent domiciles and to live apart from
each other. It is the intent and pUrpose of this Agreement to set forth the respective rights and
duties of the parties while they continue to live apart from each other,

The parties have attempted to divide their matrimonial property in a manner which
cllnfonns to a just and right standard, with due regard to the rights of each party. It is the inlent
of the parties that such division shall be final and shall forever detennine their respective rights.
The division of existing marital property is not inlended by the parties to conslilute in any way a
sale or exchange of assets.

Further, the parties agree to conlinue living separately and apart from the other at any
place or places that he or she may select as Ihey have heretofore been doing. Neither party shall
molest, harass, annoy, injure, threaten or interfere with the other party in any matter whatsoever.
Each party may carry on and engage in any employment, profession, business or other activity as
he or she may deem advisable for his or her sole use and benefit. Neither party shall interfere
with the uses, ownership, enjoyment or disposition of any property now owned and not specified
herein or property hereafter acquired by the other.

The consideration for this contract and agreement is the mutual benefit to be obtained by
both of the parties hereto and the covenants and agreements of each of the parties to the other.
The adequacy of the consideration for all agreem~nts herein contained is stipulated, confessed,
and admitted by the parties, and the parties intend to be legally bound hereby.
Each party to the Agreement acknowledgcs and declarcs that he or she, respectively:

a. is represented by counsel of his or her own chClosing;
b. is fully and completely infonned of the facts relating to the subject
matter of this Agreement and of the rights and liabilities of the parties;
c. enters Inlo this Agreement voluntarily after receiving the advice of counsel;
d. has given careful and mature thought 10 the making of this Agreement;
e. has carefully read each provision of this Agreement; and
f. fully and completely understands each provision of this Agreement, both
as to the subject matter and legal effect.
This Agreement shall become effective Immediately as of the date of execution.

It is the purpose and Intent of this Agreement to settle forever and complelely the Interest
and obligations of the parties In all property that they own separately, and all property that would
qualify as marital property under the Pennsylvania Divorce Code, Title 23, Section 401(e), and
that Is referred to In this Agreement as "Marital Property", as between themselves, their heirs and
assigns. The parties have attempted to divide their Marital Property in a manner that confonns to
a just and fair standard, with due regard to the rights of each Party. The division of existing
Marital Property is not intended by the parties to constitute in any way a sale or exchange of
assets, and thu division is being effected withoUI the introduction of outside funds or other
property not constituting a part of the marital estate.
It is the further purpose of Ihis Agreement 10 settle forever and completely any obligation
under the Pennsylvania Divorce Code relating to spousal support, alimony, equitable distribution
of marital property, and counsel fees or costs.

Each party represents and warrants that he or she has made a full and fair disclosure to Ihe
other of all of his or her property interests of any nature. including any mortgagr., pledge. lien,
charge. security interest, encumbrance, or restriclkm to which any property is subject. Each party
further represents that he or she has made a full and fair disclosure of all debts and obligations of
tiny nalurc for which he or she is currently Iiablc or may become liable. Each further represents
lInd warrants Ihat he or she has not made any gifts or transfers for inadequate consideration of
Marital Property without the prior consent of the other.
Each Party acknowledges that, to the extent desired, he or she has had access to all joint
and separate Stale and Federal Tax Returns tiled by or on behalf of eithcr or both Parties during
marriage.

DIVORCE: The parties both agree to cooperate with each other in obtaining a final
divorce of the marriage. It is agreed that the parties will execule and file the consents necessary
to obtain the divorce. Any party who fails to cooperate with obtaining the Divorce shall pay all
the costs and legal fees of the party who is seekin($ the divorce.

BREACH: Ifeither party breaches any provisions of this Agreement, the other party shall
have the right. at his or her election, to sue for damages for such breach or seek such other
remedies or relief as may be available to him or her, and the party breaching this contract shall be
responsible for payment of legal fees and cosls incurred by Ihe other in enforcing their rights
under this Agreement.
16.
ADDITIONAL INSTRUMENTS: Each of the parties shall from time 10 lime, at the
request of the other, execute. acknowledge and deliver to the other party any and all further
instruments that may be reasonably required 10 give full force and effect to the provisions of this
Agreement.
17.
VOLUNTARY EXECUTION: The provisions of this Agreemcnt and their legal effect
have been fully explained to Ihe parties by their respective counsel. and each party acknowledges
that the Agreement is fair and equitable, and that it is being entered into volunlarily, and Ihal it is
not the result of any duress or undue innuence. The provisions of this Agreement are fully

WAIVER OF CLAIMS AGAINST ESTATES: Excepl as herein otherwise provided,
each party may dispose of his or her property in any way, and each party hereby waives and
relinquishes any and all rights he or she may now have or hereafter acquire, under the present or
future laws of any jurisdiction, to share in the property or the estate of the other as a result of the
marital relationship, including without limitation, dower, curtesy, statutory allowance, widow's
allowance, right to take in intestacy, right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at the request of the other, execute,
acknowledge and deliver any and all instruments which may be necessary or advisable to carry
into effect this mutual waiver and relinquishment of all such interests, rights and claims.
IN WITNESS WHEREOF, the parties hereunto have set their hands and seals the day

The parties have allempted to divide Iheir malrimonial property in a manner which
conforms to a just and right standard, with due regard to the rights of each party. It is the intent
of the parties that such division shall be final and shall forever determine their respective rights.
The division of existing marital property Is not intended by the parties to constitute in any way a
sale or exchange of assets.

Further, the parties agree to continue living separately and apart from the other at any
place or places that he or she may select as they have heretofore been doing. Neither party shall
molest, harass, annoy, injure, threaten or interfere with the other party in any mailer whatsoever.
Each party may carry on and engage in any employment, profession, business or other activity as
he or she may deem advisable for his or her sole use and benefit. Neither party shall interfere
with the uses, ownership, enjoyment or disposition of any property now owned and not specified
herein or property hereafter acquired by the other.

The consideration for this contract and sgreement is the mutual benefit to be obtained by
both of the parties hereto and the covenants snd agreements of each of the parties to the other.
The adequacy of the consideration for all agreements herein contained 15 stipulated, confessed,
and admilled by the parties. and the parties intend to be legally bound hereby.
Each party to the Agreement acknowledges and declares that he or she. respectively:

a. Is represented by counsel of his or her own choosing;
b. Is fully and completely Informed of Ihe facls relating to the subject
matter of Ihis Agreement and of the rights and liabilities of the parties;
c. enters into this Agreement voluntarily after receiving the advice of counsel;
d. has given careful and mature thought to the making of this Agreement;
e. has carefully read each provision of this Agreement; and
f. fully and completely understands each provision of this Agreement, bolh
as to the subject matter and legal effect.
This Agreement shall become effective immediately as of the date of execution.

It is the purpose and intent of this Agreement to settle forever and completely the interest
and obligations of the parties in all property that they own separately, and all property that would
quality as marital property under the Pennsylvania Divorce Code, Title 23, Section 401(e), and
that is referred to in this Agreement as "Marital Property", as between themselves, their heirs and
assigns. The parties have attempted to divide their Marital Property in a manner that confonns to
a just and fair standard, with due regard to the rights of each Party. The division of existing
Marital Property is not intended by the parties to constitute in any way a sale or exchange of
assets, and the division is being effected without the introduction of outside funds or other
property not constituting a part of the marital estate.
It is the further purpose of this Agreement to settle forever and completely any obligation
under the PeMsylvania nivorce Code relating to spousal support, alimony, equitable distribution
of marital property, and counsel fees or costs.

The WIFE hereby waives all right and title which she may have in any personal property of
the HUSBAND. HUSBAND likewise waives any interest which he has in the personal property
of the WIFE. Henceforth, each of the parties shall own, have and enjoy independently of any
claim or right of the other party, all items of personal property of every kind, nature and
description and wherever situated, which are then owned or held by or which Clay hereafter
belong to the HUSBAND or WIFE with full power to the HUSBAND or the WIFE to dispose of
same as fully and effectually, in all respects and for all purposes as ifhe or she were unmarried.
Each party agrees that neither will incur obligations, liens or liabilities on account of the
other and that from the date of this Agreement, neither pany shall contract or incur obligations,
liens or any liability whatsoever on account of the other.

14.
DIVORCE: The parties both agree to cooperate with each other in obtaining a final
divorce of the marriage. It is agreed that the parties will execute and tlIe the consents necessary
to obtain the divorce. Any party who fails to cooperate with obtaining the Divorce shall pay all
the cosls and legal fees of the party who is seeking the divorce.

BREACH: Ifeither party breaches any provisions of this Agreement, lhe other party shall
have the right, at his or her election, to sue for damages for such breach or seek such other
remedies or relief as may be available to him or her, and the party breaching this contract shall be
responsible for payment of legal fees and costs incurred by the other in enforcing their rights
under this Agreement.
16.
ADDITIONAL INSTRUMENTS: Each of the parties shall from time to time, at the
request of the other, execute, acknowledge and deliver to the other party any and all further
instruments that may be reasonably required to give full force and effect 10 the provisions of this
Agreement.
17.
VOLUNTARY EXECUTION: The provisions of this Agreement and their legal effect
have been fully explained to the parties by their respective counsel, and each party acknowledges
that the Agreement is fair and equitable, and that it is being entered into voluntarily, and that it is
not the result of any duress or undue intluence. The provisions of this Agreement are fully

WAIVER OF CLAIMS AGAINST ESTATES: Except as herein otherwise provided,
each party may dispose of his or her property in any way, and each party hereby waives and
relinquishes any and all rights he or she may now have or hereafter acquire, under the present or
future lc:ws of any jurisdiction, to share 1i1 the property or the estate of the other as a result of the
marital relationship, including without limitation, dower, curtesy, statutory allowance, widows
allowance, right to take in intestacy, right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at the request of the other, execute,
acknowledge and deliver any and all instruments which may be necessary or advisable to carry
into effect this mutual waiver and relillquishment of all such interests, rights and claims.

PLAINTIFF'S PETITION FOR SPECIAL RELIEF AND
ENFORCEMENT UNDER SECTION 8502 (0) OF THE DIVORCE CODE
And now comes Petitioner Gary A. Dull, and petitions this court for special
relief and enforcement of the Marital Settlement Agreement of the parties, as
follows:
1. Petitioner Is Gary A. Dull, plaintiff in the above captioned divorce
action.
2. Respondent Is Carole A. Dull, defendant in the above captioned divorce
action.
a. During the negotiation of pending economic claims before the Master
appointed In this matter, the parties resolved all maritai claims against each other
by the terms of a Maritai Settlement Agreement dated September 2, 1997. On the
basis of such agreement, this Court entered an Order of Court on September a,
1998, and vacated the appointment of the Master in this matter.
4. A final decree In divorce was entered on January 20, 1999 which
Incorporated the Marital Settlement Agreement into the decree. A true and correct
copy of the decree and the incorporated Maritai Settlement Agreement ie attached
hereto as Exhibit A.

10. Wife has failed to make such payments on a timely basis.
11. On or about December 28, 1998, Providian National Bank brought suit
against the parties in this court at Prouidian National Bank v. Carole A. Dull and
Gary A. Dull, No. 98-7182, for the unpaid obligations on the credit card account,
asserting that no payments had been made since 09.22.98. Judgment is demanded
in the amount of $l,817.6a plus interest from 09.2a.98 at the rate of 16.40% and
attorneys fees of $a6a and costs of the action. A copy of the Complaint in the
action is attached hereto and made a part hereof os Exhibit D.
12. On December ao, 1998, Husband's counsel wrote to Wife's counsel and
advised him of the civil action served upon Husband for Wife's non-payment of the
Providian National Bank debt. Demand was made that Wife immediately satisfY
the debt and take all steps necessary to hold Husband harmless with regard to the
obligation. A copy of counsel's letter Is attached hereto and made a part hereof as
Exhibit E. No response was received from Wife's counsel.
la, Husband has been harmed and continue!> to be harmed by Wife's
failure to make timely payment on the Providian Nationai Bank debt and by Wife's
failure to cooperate and provide information necessary for the preparation and
entry of a Qualified Domestic Relations Order protecting Husband's interest in
Wife's pension plan and 401K.
14. Without the information requested from Wife, Husband is unable to
secure his rights with regard to his interest in Wife's pension plan and 401K.
15. Husband has incurred and continues to incur expenses including
reasonable counsel fees a~ a result of Wife's failure to comply with the terms of the
Marital Settlement Agreement.
16. Paragraph 15 of the Marital Settlement Agreement states:
BREACH: If either party breaches any provisions of this Agreement, the
other party shall have the l'ight, at his or her election, to sue for damages for
such breach or seek such other remedies or relief as may be available to him
or her, and the party breaching this contract shall be responsible for
payment of legal fees and costs Incurred by the other in enforcing their
rights under this Agreement.
17. Paragraph 16 of the Maritlll Settlement Agreement states:

at the request of the other, execute, acknowledge and deliver to the other
party any and all further instruments that may be reasonably required to
give full force and effect to the provisions of this Agreement.
18. Wife has breached the provisions of the Marital Settlement Agreement
of the parties inter alia by her failure to make timely payments of the Providian
National Bank obligation, and her failure to deliver information In regard to her
pension plan and 401K to husband.
19. Husband seeks enforcement under Section 3502(e) of the Divorce Code
of the Marital Settlement Agreement of September 2, 1998, incorporated in the
Decree in Divorce entered in this matter with regard to the satisfaction of the
Providian National obligationj the indemnification of Husband with regard to such
obligation; the cooperation of Wife with regard to the entry of the QDROs
contemplated by the said agreement, and the reimbursement of reasonable counsel
fees and other expenses incurred by Husband for the preparation and presentation
of this petition and in the lawsuit related to the unpaid credit card obligation.

DIVORCE: The parties both agree to cooperate with each other in obtaining a fina1
divorce of the marriage, It is agreed that the parties will execute and file the consents necessary
to obtain the divorce. Any party who fails to cooperate with obtaining the Divorce shall pay all
the costs and legal fees of the party who is seeking the divorce.

BREACH: If either pany breaches any provisions of this Agreement, the other party shall
have the right, at his or her election, to sue for damages for such breach or seek such other
remedies or relief as may be available to him or her, and the pany breaching this contract shall be
responsible for payment of legal fees and costs incurred by the other in enforcing their rights
under this Agreement.

ADDmONAL INSTRUMENTS: Each of the panies shall from time to time, at the
request of the other, execute, acknowledge and deliver to the other party any and all further
instruments that may be reasonably required to give full force and effect to the provisions of this
Agreement.

VOLUNTARY EXECUTION: The provisions of this Agreement and their legal effect
have been fully explained to the parties by their respective counsel, and each party acknowledges
that the Agreement is fair and equitable, and that it is being entered into voluntarily, and that it is
not the result of any duress or undue influence. The provisions of this Agreement are fully

WAIVER OF CLAIMS AGAINST ESTATES: Except as herein otherwise provided,
each pany may dispose of his or her property in any way, and each pany hereby waives and
relinquishes any and all rights he or she may now have or hereafter acquire, under the present or
future laws of any jurisdiction, to share in the propeny or the estate of the other as a result of the
marital relationship, including without limitation, dower, cunesy, statutory allowance, widow's
a1lowancf:. right to take in intestacy, right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at the request of the other, execute,
acknowledge and deliver any and all instruments which may be necessary or advisable to carry
into effect this mutual waiver and relinquishment of aU such interests, rights and claims.

Dear Marcus:
As you will recall, the Settlement Agreement entered September 2, 1998 in this
matter provided for Carole Dull to satisfy and hold my client harmless with regard to
the outstanding obligation due to Provident National Bank on account of a balance
owing from a First Union credit card. The agreement expressly provided that in the
event of her failure to do so on a timely basis, your client would be obligated to pay
Gary Dull's reasonable legal fees and to a"aree to sign a Qualified Domestic Relations
Order to pay the balance from her 401K plan at work along with any costs and
expenees including counsel fees incurred by Gary Dull.
I regret to advise you that my client was served yesterday with a complaint in
a civil action suing him for the non-payment of the debt. I assume Carole was also
served. On Gary's behalf, I hereby demand that your client immediately satisfy this
obligation and take all steps necessary to hold my client harmless with regard to this
obligation.

AND NOW, this r2--day of February, 1999, IT IS ORDERED:
(1) Respondent, Carole A. Dull, shall provide petitioner, Gary A. Dull, not later
than February 19, 1998, all Information necessary for the drafting of a Qualified
Domestic Relations Order as required by paragraph 12 of the parties' marital
settlement agreement.
(2) If any judgment should be entered against petitioner regarding the First
Union Credit Card balance due to Provident National Bank as set forth In paragraph 7
of the parties' marital settlement agreement, wife shall within seven (7) days thereafter
sign a Qualified Domestic Relations Order to pay the debt as set forth In said
paragraph.
(3) Petitioner Is awarded $150 In counsel fees which shall be paid not later
than sixty (60) days from this date.
