Present for the Plaintiff, Carolyn D. Harrison is
attorney Carol J. Lindsay, and present for the Defendant, James
H. Harrison, is attorney Mark D. Schwartz
A divorce complaint was filed on Nove~ber 6, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. Counsel have indicated that the
parties will sign and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree so that
the divorce can be concluded under section 3301(c) of the
Domestic Relations Code.
The complaint also raised the economic claim of
alimony. Counsel have indicated that they do not intend to
present any testimony on the factor of marital misconduct unless
the parties cannot agree as to the date of separation. Then the
factor of marital misconduct may become an issue in this case.
On June 11, 1999, in a claim under new matter the
Defendant filed a claim for equitable distribution.
The parties were married on February 14, 1990, and
according to wife separated July 20, 1996. As noted, there may
be an issue with respect to the date of separation and Mr.
Harrison is to advise his counsel whether or not he wants to
contest the date of separation and if he does, what date of
separation he alleges. He is to provide that information to his
counsel who will then communicate to attorney Lindsay by July
19,1999.
Counsel and the Master have discussed the issues in
the case and the Master is not going to dictate a comprehensive
memorandum pending discovery matte~s that need to be resolved
and a further conference with counseL which will include the
parties. There may be an issue involving the date of
separation, the value of the real estate at 344 Lincoln Street,
Carlisle, Pennsylvania, and the marital debt. There is also a
,
valuation issue with respect to vehicles which are marital and
premarital.
Counsel are going to place on the record what they
need to have accomplished by the next meeting of counsel with
the parties. The information that needs to be produced will
assist hopefully in trying to bring the parties to a resolution
of the issues without the necessity of having a hearing. Ms.
Lindsay.
MS. LINDSAY: We need the following:
1. First of all with regard to the house, I would like to
have the amount of money that was borrowed on the
mortgage at the time Mr. Harlison purchased the house and
also a most recent statement of the mortgage payoff.
2. I would like to see Mr. HarriRon's most recent statement
from social security and also his most recent statement
from his pension benefit confirming the amount of his
income.
3. Also copies all of the receipts for the last six months
for work done out of his garage and his statement as to
the extent to which those receipts represent the monies
actually received for work.
4. I would like to see the original documentation for the
acquisition of the home equity line of credit. I would
like to have documentation of the amount owed on the
line of credit as of the date of separation, which I'm
going to call, July 20, 1996, and the present amounts
owed together with Mr. Harri~on's statement as to how
much, if anything, he charged on the line of credit
subsequent to July 20, 1996.
4. With regard to the HFC person;'l credit line, I would need
to know date of separation pr~sent balance and how much
Mr. Harrison used that credit line between July 20, 1996,
and the date of hearing.
5. With regard to the OPTIMA credit card account, I would
like to have the statements for May, June, and July 1996.
6. with regard to the 1993 Cadillac, I would like to have a
copy of the invoice or the purchase order which shows the
trade in that Mr. Harrison received from that vehicle and
I would also like a copy of the payoff to Fulton Bank, I
guess he paid off the loan on the vehicle at that time.

7. I would like to let counsel know when I can have an
expert take a look at the vehicles and have counsel agree
to have them made available in plenty of time for us to
get a value prior to August 10, and similarly between
July 19 and August 10, 1999, I will have an appraisal
performed on the house and I will ask counsel to be sure
his client cooperates in having that done.
The costs for these are ones that my client cannot afford
and I will advance the cost t'l get this discovery done
and ask Mr. Harrison to agree to pay 1/2 of the cost of
the appraisals and if not, to let me know in time so I
can add a count for costs, if I haven't already, to the
complaint.
8. I would like to see a copy of the statement on the
checking account in your client's name. I would like to
see a seatement for July 1996.
9. I think both parties ought to provide whatever
documentation they have about their mutual funds.
MR. SCHWARTZ:
1. Defendant would request any cocumentation that you have
about Plaintiff's retirement plans and/or pension plan
statements. I guess we will use for now the 1996 date
of separation, and depending on my client's ultimate
position on that, we will hav . to see how that goes.
2. Defendant would request any information from the
Plaintiff regarding the debts incurred on a JC Penney
credit card and a Hecht's credit card. Apparently there
is some dispute about the date those accounts were opened
and whether or not they were opened after the 1996 date
of separation.
THE MASTER: The Master has requested that each
party file a current income and expense statement. Ms. Lindsay
has suggested some figures for her client's income and we need
to have that substantiated; Mr. Schwartz has indicated that he
will provide income information and ~j,le a formal statement.
Also, the Master requests that husband and/or wife
provide any documentation they may have regarding improvements
that have been made to the residence at 344 Linclon Street,
Carlisle, Pennsylvania, from the dat.. of purchase to the date of
separation.

PLAINTIFF'S PRE.TRIAL STATEMENT
Carolyn Do Harrison, hereinafter Wife, was born on October 2, 1944. James A.
Harrison, hereinafter Husband, was born on October 27,1927. Both parties are natives of North
Carolina. They were married in North Carolina on February 14, 1990. They separated on July
20, 1996. Theirs was a si:;cond marriage for husband and a third marriage for wife, who had
been widowed two times previously. There are no children of the marriage, although both parties
have children from prior marriages who are now grown. Husband is a retired mechanic and
receives a pension of approximately $1,000.00 per month and Social Security in the amount of
approximately $1,130.00 per month. He has income from his business as a mechanic in the
garage he maintains of approximately $1,000.00 per month.
Wife is a daycare worker at Carlisle Barracks. She earns $641.54 net bi-weekly. Wife is a
diabetic with unrelmbursed medical expenses averaging $71.00 per month.
Husband resides in the marital home at 344 Lincoln Street, CarlislQ, Pennsylvania. He
purchased that home subsequent to the parties' marriage, but titled the home In his name only.
The house has yet to be appraised. but Wife expects that It Is worth approximately $100,000.00.
There Is a first mortgage of $58,000,00 and a second of $21 ,650.00. The equity Is approximately
$20,000.00. Husband claims the house Is non-marital since the down payment for the house was
Husband's pre-marital asset and the house Is tilled In his name only.

There are several vehicles, some of which were purchased during the marriage, most
notably a 1993 Cadillac, At the tima of the marriage, Husband owned a 1955 Chevrolet Impala, a
1964-5 Buick Electra, and a 1956 Chevrolet Pickup. In the course of the marriage, Husband
restored these vehicles, and Wife believes they had considerable value. In addition, the parties
owned a 1985 or 1986 Uncoln and a 1985 or a 1986 Oldsmobile.

So far as Wife is aware, there was at the date of separation, a first and second mortgage
on the marital home, a line of credit with a balance of $2,490.00, and an Optima credit card with a
balance of $118.00. Wife, additionally, had a pre-marital debt to the Internal Revenue SelVlce of
$5,000.00 on account of taxes owed on the estate of her former husband.
XI. PROPOSED RESOLUTION
Wife Is seeking a 60% share of the marital estate and reasonable alimony.

7. The court costs and fees are waived.
8. This Order shall remain in effect for a period of one
year or until modified or terminated by the Court. The Order can
be extended beyond ita original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.
9. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. g6113; ii) a private criminal complaint under 23
Pa.C.S. g6113.1j iii) a charge of indirect criminal contempt
under 23 Pa.C.S. g6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
under 23 Pa.C.S. 66114.1. Resumption of co-residence on the part
or the plaintiff and defendant shall not nullify the provisions
of the court order.
10. The Carlisle Police Department shall be provided with a
certified copy of this Order by the plaintiff's attorney an? may
enforce this Order by arrest for indirect criminal contempt
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of a police officer. In the event that an arrest is
made under this section, the defendant shall be taken without
unnecessary delay before the court that issued the order. When
that court is unavailable, the defendant shall be taken before
the appropriate district justice. (23 Pa.C.S, g 6113).

CONSENT AGREEMENT
~
This Agreement is entered on thia 02 day of August,
1996, by the plaintiff, Carolyn D. Harrison, and the defendant,
James A. Harrison. The plaintiff is represented by Joan Carey of
LEGAL SERVICES, INC.; the defendant is unrepresented but is aware
of his right to have an attorney. The parties agree that the
following may be entered as an Order of Court.
1. The defendant, James A. Harrison, agrees to refrain
from abusing the plaintiff, Carolyn D. Harrison, or placing her
in ~ear of abuse.
2. The defendant agrees not to harass and stalk the
plaintiff and not to harass the plaintiff's relatives.
3. The defendant agrees not to enter the plaintiff's place
of employment.
4. The defendant agrees not to remove, damage, destroy, or
aell any property owned by the plaintiff or jointly owned by the
parties.
6. The defendant agrees to relinquish to the sheriff's
department sny weapons which he used or threatened to use against
the plaintiff. The defendant understands that he is prohibited
from acquiring or possessing any other weapons for the duration
of the Order.
6. The defendant, on July 26, 1996, paid the plaintiff
$1,200.00 to provide her with suitable alternate housing.
7. The defendant, although entering into this Agreement,
does not admit the allegations made in the Petition.
8. The defendant understands that the Protection Order
~ntered in this matter will be in effect for a period of one year
and can be extended beyond it original expiration date if the
Court finds that the defendant has committed another act of abuse
or has engaged in a pattern or practice that indicates continued
this Order will be enforceable in the same manner as the court's
risk of harm to the plaintiff. The defendant understands that
prior Temporary Protection Order entered in this case.
9. Violation of the Protection Order may subject the
defendant to: i) arrest under 23 Pa.C.S. 66113; ii) a private
criminal complaint under 23 Pa.C.S. 66113.1; iii) a charge of
indirect criminal contempt under 23 Pa.C.S. 66114, punishable by
imprisonment up to siA months and a fine of $100.00-$l,OOO:00i
and iv) civil contempt under 23 Pa.c.S. g6114.1.

THE MASTER: Today is Tuesday, August 10, 1999.
This is the date that we set for a conference with the parties
and counsel in the above captioned divorce proceedings. Present
in the hearing room are the Plaintiff, carolyn D. Harrison, and
her counsel Carol J. Lindsay, and the Defendant, James A.
Harrison, and his counsel Mark D. Schwartz.
The parties were on married February 14, 1990, and
have agreed that they will use the separation date of July 20,
1996.
A complaint in divorce was filed on November 6,
1996, raising grounds for divorce of irretrievable breakdown of
the marriage and indignities. Counsel have provided the Master
with signed affidavits of consent and waivers of notice of
intention to request entry of divorce decree dated August 10,
1999, so that the divorce can be concluded under section 3301(c)
of the Domestic Relations Code. The Master's office will file
the affidavits and waivers with the Prothonotary's Office.
The complaint also raised the economic claims of
alimony and alimony pendente lite. The claim of equitable
distribution, which is also pending before the Master, was
raised on June 11, 1999, by the Defendant as a claim under "new
matter".
After discussion and negotiations this morning, the
Master has been advised that the parties and counEel have
reached an agreement with respect to the outstanding economic
claims. The agreement that the parties have reached is going to
be placed on the record in the presence of the parties and
counsel. The agreement as stated on the record will be
considered the substantive agreement of the parties not subject
to any changes or modifications except for correction for
typographical errors which may be made during the transcription.
The parties and counsel will return later this afternoon to
review the draft of the agreement for typographical errors and
will make any corrections as necessary. No changes can be made,
however, as noted, to the substantive part of the agreement.
After the typographical errors, if any, have been corrected, the
parties and counsel will affix their signatures by way of
affirmation of the terms of the agreement. The Master will then
be in a position to prepare an order vacating his appointment,
and the parties will then be able to file a praecipe
transmitting the record to the Court requesting a final decree
in divorce.
It is noted, however, that the Master will not
immediately prepare an order vacating his appointment until
certain provisions of the agreement have been complied with and
counsel have notified the Master that he can proceed with the
vacation of his appointment. The provisions of the agreement,
which are prospective, will be noted by counsel in their
statement of the agreement on the record and upon the completion
of those terms then the Master will be able to allow the case to
proceed to a final decree. Ms. Lindsay.
MS. LINDSAY: The parties agree as follows:
1. Husband will retain the home located at 344 Lincoln
street, Carlisle, Pennsylvania. Wife releases to husband
any right, title, or interest which she might have in the
home and will execute a quitclaim deed, if one is
provided to her by husband, in order to effectuate to
this agreement.
Husband will be solely and completely responsible for any
liens on the marital home and will indemnify and hold
wife harmless on account of any charges for those
obligations.
2. Husband will retain the 1991 Cadillac which shall be his
sole and separate property and shall pay any liens
thereon and shall indemnify wife on account of that
obligation.
In addition, husband will retain any other vehicles which
are presently in his possession and wife waives any
marital interest which she may have in those vehicles.
3. The parties hereto will each retain any interest they
have in retirement, pension, 401(k), or any other such
plan.
The parties also will retain whatever mutual fund
accounts they have, in particular, the Prime America
mutual funds which they may have.
4. Husband will retain the contents of the parties' checking
and savings accounts at Farmers Trust.
5. The personal property which has been mutually and
satisfactorily divided shall be the sole and separate
property of the party in whose possession it is as of the
date of this agreement.
6. Husband shall be solely and separately liable for all
marital debt which existed as of the date of separation
with the following exception:
Wife shall be solely responsible for the Montgomery Ward
obligation, the Hecht's, and the J.e. Penney'S accounts.
All other obligations shall be husband's sole and
separate responsibility including but not limited to the
Household Finance personal line of credit, any line of
credit which operated as a lien on the marital home, any
obligation to Fulton Bank, American Express, or Optima.
Within thirty (30) days of this agreement, wife will
execute any documents required to transfer into her name
alone the balances on the J.e. Penney, Hecht's, and
Montgomery Ward accounts. Husband will execute any
documents required or make any contact with the creditors
named in order to release the accounts to wife alone.
7. Husband will pay and wife will accept as alimony $550.00
per month for the months of September and October 1999,
and then commencing November 1999, $400.00 per month,
which shall be paid for a period of 24 consecutive
months, the last payment being due in October 2001.
The alimony payments as provided will be a total of
$10,700.00. Said payme~ts shall not be modifiable but
will terminate upon the death of either party. The
alimony will not cease upon cohabitation or remarriage of
wife. In no event will wife receive more than $10,700.00
in alimony whether that payment is made directly through
the QDRO or through the death benefit of an insurance
policy as more particularly described and explained
below. If wife does receive such excess payment she will
promptly refund to husband or to his estate.
Said payments will be made through a QDRO which will
be from husband's pension plan. Husband shall be
responsible for preparing and filing the QDRO which will
modify the current payment pursuant to a QDRO obtained
through the Domestic Relations Office of Cumberland
County, Pennsylvania.
The parties acknowledge that wife will be reporting the
payments of alimony as income to her for federal income
tax purposes and paying the tax thereon, and husband
will have the right to claim them as an offset to his
income for federal income tax purposes.
In order to secure the payment of alimony, husband
will maintain in effect life insurance in the face amount
of at least $10,000.00 with wife as the beneficiary of
said policy. Wife shall be denominated an irrevocable
beneficiary and husband will provide to the insurance
company instructions that she may at any time obtain
information sufficient for her to know that her
designation as beneficiary is being maintained and that
the premiums for said policy are being paid. Husband's
obligation to maintain life insurance with wife as
beneficiary shall cease the month after the last of the
alimony payments are made. Within thirty (30) days of
the date of this agreement, husband shall provide to wife
proof that the terms set out in this paragraph have
been complied with. This agreement, in its entirety, is
contingent upon the provision of an assurance of life
insurance coverage.
8. In the event that a party breaches a term of this
