GRIFJo'IN, Defendants roMfLAlliI AND NOW, comes comes Robert G, Frey, Esqo, attomey for the Plaintiffs and avers and respectfully states as follows: 1, Plaintiffs are Linwood B, Phillips, Jr, and Robert M, Frey, adult individuals, both residing in Cumberland County, Pennsylvania and having a mailing address and principal place of business at 5 South Hanover Street, Carlisle, Cumberland County, Pennsylvania, 2, Defendants are Jean B, Griffin and Scott C, Griffin, both adult individuals, Defendant Jean B, Griffin having as her residence and mailing address at 12 Carler Place, Carlisle, Cumberland County, Pennsylvania, and Defendant Scott C, Griffin having an address which is unknown, Defendant Jean B, Griffin is the mother of Defendant Scott C. Griffin, 3, Neither of the Defendants are members of the Armed Forces of the United States of America, nor is either in any way engaged so as to bring themselves within the Soldiers and Sailors Civil Relief Act of 1940, as amended, 4, On or about September 16, 1988, Defendants executed an Agreement Sale with Plaintiff whereby Defendants agreed to pay to Plaintiffs for the purchase of the condominium unit known as 12 Carter Place, Carlisle, Cumberland County, Pennsylvania, the sum of $64,500,00 with interest at the rate of ten and one-half (10,50%) percent per annum, A copy of said Agreement of Sale is attached hereto and incorporated herein as Exhibit "A", 5, Pursuant to said Agreement, Defendants agreed to make monthly payments of $590,00 on account of the purchase price and, in addition, to pay all real estate taxes and condominium assessments when due, . . COUNT I . ACTION ON CONTRACT t'OR MONETARY DAMAGES 6, Paragraphs 1 through 5 arc incorporated hcrcin by refcrcncc. 7. Defendants havc dcfaulted in the making of monthly paymcnts as cxprcssly rcquircd in the Agrcemcnt of Sale and have funher defaultcd in thc exprcss tcrms of thc Agrccmcnt of Sale. as set fonh in said Agreemcnt on page 2, by reason of thc failure to pay rcal estate taxes and condominium assessmcnts when due, 8, Notice of Default on said Agrecmcnt of Salc, in accordance with Section 403 of Pennsylvania Act No, 6 of 1974 was delivered to Jcan B, Griffin by rcgular mail to 12 Caner Place on October 3, 1996, cenified mail being unclaimed, Notice of Default has been dclivcred to Defendant ScottC, Griffin to 12 Caner Place, Carlisle, Pennsylvania as all correspondence to his last known address has been returned with no forwarding address having been given and Defendant Jean B, Griffin, Scott C, Griffin's mother, has told Plaintiffs that she has no know ledge of her son's address, 9, Defcndants have failed to reinstate the Agreement of Sale in accordance with the terms of the notice of Default, and as shown on the amortization schedule attached hereto and incorporated herein by reference as Exhibit "B", no payment has been received since July 5, 1996, 10, The amount due from Defendant to Plaintiff under the terms of the Agreeme;ll of Sale are as follows: Unpaid principal balance Current Real estate taxes due and unpaid Condominium fees due and unpaid Attorney's fee Total $64,934.46 1.437,99 250,00 $3,246,00 $69,R6R.45 II, Intcrcst is duc and owing from Dcfendants to Plaintiffs at thc contractcd ratc to November 3, 1996, as shown on thc amortization schcdulc attuchcd hcrcto IInd incorpomlcd hcrein liS Exhibit "B", in thc amount of $2,6330l!5. Principal, costs, and allomeys fee totaling $69,868.45; b, Interest to November 3, 1996 In the amount of $2,633,85plus funher interest accmed from November 3, 1996 to the date of judgment at the contracted rate of 10,5%; and c. Additional costs of Plaintiffs incurred in this suit. COUNT II . ACTION IN EJECTMENT FOR POSSESSION OF REAL PROPERTY 12. Paragraphs I through 11 are incorporated herein by reference, 13.Pursuantto the terms of the Installment Sale Agreement, and in consideration of the promises, covenants, and agreements of Defendants, Plaintiffs delivererd possession to Defendants and Defendants entered into possession of the real estate on September 16. 1988, 14. On November 4, 1996, Plaintiffs made wrillen demand for possesion of the aforementioned real estate, A copy of said demand is allached hereto and incorporated herein by reference as Exhibit "D," 15, Defendants have failed and refused to give possession to Plaintiffs and have funher failed and refused to make required payments pursuant to the Agreement 0: Sale WHEREFORE, Plaintiffs respectfully request judgment in ravor of Plaintiffs and against Defendants granting to Plaintiffs possession of the herein described real estete, costs of suit and such funher relief as the Coun may deem proper. Phillips. Jr. and Robert M. Frey, adult individuals. both residing in Cumberland County, Pennsylvania and having a mailing address and principal place of business at5 South Hanover Street, Carlisle, Cumberland County, Pennsylvania. 2. Defendants are Jean B. Griffin and Scott C. Griffin, both adult individuals. Defendant Jean B. Griffin having as her residence and mailing address at 12 Carter Place, Carlisle, Cumberland County, Pennsylvania. and Defendant Scott C. Griffin having an address which is unknown. Defendant Jean B. Griflin is the mother of Defendant Scott C. Griffin. 3. Neither of the Defendants are members of the Armed Forces of the United States of America. nor is either in any way engaged so as to bring themselves within the Soldiers and Sailors Civil Relief Act of 1940, as amended. 4. On or about September 16, 1988, Defendants executed an Agreement Sale with Plaintiff whereby Defendants agreed to pay to Plaintiffs for the purchase of the condominium unit known as 12 Carter Place, Carlisle, Cumberland County, Pennsylvania, the sum of $64,500,00 with interest at the rate of ten and one-half (10.50'70) percent per annum. A copy of said Agreement of Sale is allached hereto and incorporated herein as Exhibit "A". 5. Pursuant to said Agreement, Defendants agreed to make monthly payments of $590,00 on account of the purchase price and, in addition, to pay all real estate taxes and condominium assessments when due. Defendants have defaulted in the making of monthly paymcnts as expressly required in the Agreement of Sale and have further dcfaulted in thc cxprcss tcrms of thc Agreement of Sale, as set forth in said Agreement on page 2, by rcason of the failure to pay real estate taxes and condominium assessments when duc. 8. Notice of Default on said Agreement of Sale, in accordance with Scction 403 of Pennsylvania Act No.6 of 1974 was dclivered to Jean B. Griffin by rcgular mail to 12 Carter Place on October 3, 1996, ccrtificd mail being unclaimed, Notice of Default has been delivered to Defendant Scott C. Griffin to 12 Carter Place, Carlisle, Pennsylvania as all correspondence to his last known address has been returned with no forwarding address having been given and Defendant Jean B. Griffin, Scott C. Griffin's mother, has told Plaintiffs that she has no knowledge of her son's address. 9. Defendants have failed to reinstate the Agreement of Sale in accordance with the terms of the notice of Default, and as shown on the amortization schedule attached hereto and incorporated herein by reference as Exhibit "B", no payment has been received since July 5, 1996. 10. The amount due from Defendant to Plaintiff under the terms of the Agreement of Sale are as follows: Unpaid principal balance Current Real estate taxes due and unpaid Condominium fees due and unpaid Allomey's fee Total $64,934.46 1,437.99 250,00 $3.246.00 ~69 .1l68 .4~ 11. Interest is due and owing from Defendants to Plaintiffs at the contracted rate to November 3, 1996, as shown on thc amortization schedule allached hercto and incorporated herein as Exhibit "B", in thc amount of$2,633.85. WHEREFORE, Plaintiffs rcspcctfully requcstjudglllcnt in favor of Plaintiff" and again"t Defendants as follows: a. Principal, costs, and attomeys fee totaling $69,8611,45; b. [ntercstto November 3, 1996 in the amount of $2,633.85plus further interest accrued from November 3, 1996 to the date of judgment at the contractcd ratc of 10.5%; and c. Additional costs of Plaintiffs incuned in this suit. COUNT II . ACTION IN EJECTMENT FOR POSSt:SSJON OF REAL PRoPt:R'J'Y 12. Paragraphs Ilhrough II are incorporated herein by referencc. 13.Pursuantto the terms of thc Installmcnt Sale Agreement, and in considcration of the promises, covenants, and agreements of Defendants, Plaintiffs delivererd possession to Defendants and Defendants entered into possession of the rcal estate on September 16, 1988. 14. On November 4, 1996, Plaintiffs made wrillen demand for possesion of the aforementioned real estate. A copy of said demand is attached hereto and incorporated hercin by reference as Exhibit "D." 15. Defendants have failed and refused to give possession to Plaintiffs and have further failed and refused to make required payments pursuant to the Agreement of Sale WHEREFORE, Plaintiffs respectfully requcst judgment in favor of Plaintiffs and against Defendants granting to Plaintiffs possession of the herein described real estate, costs of suit and such further relief as the Court may deem proper.
